Annex I: Interim Measures of Beijing Municipality on Endowment Insurance for Migrant Workers
Article 1 In order to further improve the social insurance system and protect the legitimate rights and interests of migrant workers, these Measures are formulated in accordance with the spirit of the State Council's Provisional Regulations on the Collection and Payment of Social Insurance Fees (the State Council DecreeNo. 1999, Article 259) and the relevant provisions of the Ministry of Labor and Social Security.
Article 2 State-owned enterprises, collective enterprises in cities and towns, enterprises invested by foreign investors and businessmen from Hong Kong, Macao and Taiwan, urban private enterprises and other urban enterprises, party and government organs, institutions, social organizations, private non-enterprise units, urban individual industrial and commercial households (hereinafter referred to as employers) and workers who have formed labor relations with them and have rural hukou in this city or other places (hereinafter referred to as migrant workers) shall participate in old-age insurance and pay old-age insurance premiums according to law.
Article 3 The employing unit shall obtain the approval of the municipal, district (county) administrative department of labor and social security, and handle the Employment Certificate of Migrant Workers in Beijing (hereinafter referred to as the Employment Certificate). To recruit migrant workers in this city, it is necessary to go through the registration procedures with the administrative department of labor and social security at the labor export place (county), and fill out the List of Rural Labor Employed by Employers in Beijing. At the same time, the employer shall sign a labor contract with migrant workers from the month of employment, and go through the formalities of participating in endowment insurance for them.
With the approval of the municipal, district (county) administrative department of labor and social security, the employing unit that has gone through the formalities of recruiting migrant workers but has not gone through the formalities of endowment insurance for them shall, within one month from the date of promulgation of these measures, go to the social insurance agency that pays the endowment insurance premium for urban workers, go through the formalities of participating in the endowment insurance for migrant workers and pay the endowment insurance premium for migrant workers.
The newly established employer who has not yet participated in the endowment insurance shall go through the social insurance registration formalities at the social insurance agency in the district (county) where the business license of the enterprise is registered or where the unit is located, and declare and pay the endowment insurance premium for urban workers and migrant workers.
Article 4 When handling endowment insurance for migrant workers, the employer shall submit the following documents and materials to the social insurance agency:
(a) the social insurance registration certificate of the employer;
(2) Business license of enterprise as a legal person (photocopy), business license of individual industrial and commercial households (photocopy), certificate of legal person of public institution (photocopy) or administrative letter of introduction of the organ;
(three) submitted to the statistical department of the "labor statistics" (annual report 104 table);
(four) the city, district (county) approved by the labor administrative department of migrant workers;
(five) if the employer uses migrant workers, it shall provide the Employment Certificate;
(six) the "Beijing employers to recruit rural labor roster".
Article 5 The endowment insurance premium shall be paid jointly by the employer and the migrant workers. For more than one year, 19% of the monthly minimum wage for employees in this city, the endowment insurance premium shall be paid monthly according to the number of migrant workers recruited. Migrant workers themselves pay the endowment insurance premium at the rate of 200 1 7%, based on the monthly minimum wage of employees in this city for more than one year, and individual contributions are withheld and remitted by the employer in the wage payment era. In the future, the proportion of individual contributions will be uniformly adjusted with the proportion of employees' contributions, eventually reaching 8%.
Article 6 The employer shall pay the endowment insurance premium for migrant workers, and the social insurance agency shall entrust the employer's bank to withhold and remit it on a monthly basis in the form of "entrusting the bank to collect it (no payment period)".
Article 7 The employing unit shall, in principle, pay the old-age insurance premium for migrant workers according to the payment channels and methods of urban workers. However, for employers who use less migrant workers or use migrant workers relatively stably, it is not convenient to pay the old-age insurance premium on a monthly basis. After the social insurance agency agrees and signs an agreement, they can choose to pay the old-age insurance premium on a quarterly, semi-annual or annual basis.
Article 8 Social insurance agencies shall set up individual accounts for old-age insurance for migrant workers according to the payment wage base 1 1%.
Article 9 The amount stored in individual accounts of migrant workers shall be calculated according to the interest-bearing method of individual accounts of basic old-age insurance for enterprise employees in Beijing.
Tenth individual accounts of migrant workers can only be withdrawn when they reach the age of receiving pensions. Migrant workers die before reaching the age of receiving pension stipulated by the state, and the individual contributions in their personal accounts can be inherited.
Eleventh migrant workers and employers to terminate and terminate the labor relationship, re employment within the administrative area of this Municipality, can continue the pension insurance relationship, by the social insurance agencies to transfer their payment records. When continuing, only the pension insurance relationship will be continued, and the pension insurance fund will not be transferred; Cross-regional employment, you can transfer the pension insurance relationship, and all your personal accounts are transferred; Back to the countryside, you can keep the old-age insurance relationship and seal your personal account as the basis for continuing the old-age insurance relationship. After re-employment in this city, you can continue to pay old-age insurance premiums, and the payment period can be calculated cumulatively. And handle the formalities of transfer, inheritance, liquidation and termination of the old-age insurance relationship with the old-age insurance payment certificate issued by the social insurance agency.
Twelfth migrant workers must reach the state pension age (men over 60 years of age, women over 50 years of age) to receive basic pensions. The basic pension is temporarily treated as a one-time pension, and its treatment consists of two parts:
Part I: I will pay the amount and interest in my personal account in full at one time. Part II: According to the accumulated payment years, it is paid according to the average value of the minimum wage of employees in this city for the corresponding payment years 12 months (i.e. 1 payment year), and every increase in the accumulated payment years (counted as 12 months) is increased by 0. 1.
Thirteenth migrant workers in this city and the employer after the termination or dissolution of the labor relationship, according to Article 11 of these measures to retain the old-age insurance relationship and seal up their personal accounts, and continue to pay old-age insurance premiums after re-employment in this city. Those who have participated in the rural old-age insurance in this Municipality may also transfer their personal accounts of old-age insurance and the benefits calculated and paid according to regulations during their work in the employer to their personal accounts of rural old-age insurance; Those who have not participated in the rural old-age insurance in this Municipality may participate in the rural old-age insurance in the rural old-age insurance management institution where their household registration is located, and establish a new personal account. At the same time, the amount stored in the personal account of the old-age insurance and the benefits calculated and paid according to the regulations will be transferred to the new personal account, and the corresponding benefits will be enjoyed according to the relevant provisions of the rural old-age insurance in this Municipality.
Article 14 If an employer recruits migrant workers without going through the formalities of examination and approval of employment or participating in endowment insurance, the administrative department of labor and social security shall punish them in accordance with the relevant provisions of the state and this Municipality.
Fifteenth because the employer did not participate in the old-age insurance or did not pay the old-age insurance premiums in full, resulting in migrant workers can not enjoy the old-age insurance benefits in accordance with the provisions, the employer shall compensate in accordance with the standards of these measures.
Article 16 The Interim Measures of Beijing Municipality for Farmers' Contract Workers to Participate in Pension and Unemployment Insurance (No.99 of Beijing Labor Insurance [1999]) shall be implemented according to these measures.
Seventeenth national policies on migrant workers to participate in old-age insurance, these measures will be adjusted accordingly.
Eighteenth specific issues in the implementation of these measures shall be interpreted by the municipal labor and social security administrative department.
Article 19 These Measures shall come into force as of September 1 2006.
Annex II: Calculation formula for migrant workers to participate in endowment insurance and enjoy the second part of basic pension benefits.
The accumulated payment is for the whole year (more than 12 months), and the calculation formula of treatment is:
