The social assistance fund for road traffic accidents (hereinafter referred to as the "assistance fund") refers to the social special fund raised according to law to advance the funeral expenses and part or all of the rescue expenses of the victims in motor vehicle road traffic accidents. Relief fund is a new system stipulated in Article 17 of Road Traffic Safety Law. This system is a supplement to the compulsory insurance system for motor vehicle traffic accidents (hereinafter referred to as "compulsory insurance"). The purpose is to ensure that victims can get timely assistance or appropriate compensation through the rescue fund when they can't get compensation according to the compulsory insurance system and the infringer. The establishment of this system is an important measure to implement Scientific Outlook on Development. It adheres to the people-oriented principle in system design, fully embodies the care and help of the state and society for citizens' life safety and health, and is a new social security system.
The Trial Measures for the Management of Social Assistance Fund for Road Traffic Accidents stipulates that:
The Ministry of Finance shall, jointly with relevant departments, formulate relevant policies on relief funds, and guide and supervise the collection, use and management of relief funds in all provinces, autonomous regions and municipalities directly under the Central Government.
The local financial department is responsible for guiding and supervising the raising, use and management of the rescue fund at the same level.
The local insurance supervision and administration institution is responsible for supervising and checking whether the insurance company pays the relief fund to the relief fund management institution in full and on time according to the regulations.
The traffic administrative department of the local public security organ is responsible for notifying the relief fund management institution to advance the rescue expenses of the victims of road traffic accidents.
