Legal analysis: Serious illness relief fund is the content of employee medical insurance. It is the excess after the highest reimbursement limit of the medical insurance co-ordination fund. In most areas, the maximum reimbursement limit of the medical insurance pooling fund is 80,000 yuan, and the part exceeding 80,000 yuan is reimbursed by stages in proportion. The maximum limit is 6.5438+0.8 million. Social security and medical insurance are not divided into diseases, but only reimbursed according to medical expenses. It should be noted that whether it is the reimbursement of the medical insurance pooling fund or the reimbursement of the serious illness medical assistance fund, it is only for the legal part, and the self-funded drugs are not reimbursed. In other words, the expenses for reimbursement are deducted from the self-funded part and reimbursed in proportion. However, according to China's national conditions, many high medical expenses are incurred on imported self-funded drugs. Therefore, if the medical insurance pooling fund reimburses 80,000 yuan, the actual cost may be around 1.0 1.200 yuan.

Legal basis: Article 29 of the Interim Measures for Social Assistance adopts the following methods:

(a) the individual payment part of the basic medical insurance for urban residents or the new rural cooperative medical system;

(two) to subsidize the basic medical expenses that individuals and their families can not afford after the basic medical insurance, serious illness insurance and other supplementary medical insurance are paid.

The standard of medical assistance shall be determined and published by the people's governments at or above the county level according to the level of economic and social development and the situation of medical assistance funds.
