The Fisheries Law of the People's Republic of China (hereinafter referred to as the "Fisheries Law") and the Implementation Rules of the Fisheries Law of the People's Republic of China (hereinafter referred to as the "Implementation Rules") are formulated based on the actual situation of this autonomous region.
Article 2 In the waters of this autonomous region and the waters designated by the state to implement fishery management in this autonomous region (hereinafter referred to as the waters under the jurisdiction of this autonomous region), engage in fishery production activities such as breeding, multiplication and fishing of aquatic animals and aquatic plants, and engage in activities related to the proliferation of fishery resources,
Units and individuals involved in protection-related activities must abide by these implementation measures.
Article 3 People's governments at all levels must implement the policy of focusing on fishery production, focusing on breeding, fishing, and processing simultaneously, adapting measures to local conditions, and each focusing on policies.
In inland areas, farming is the main focus and fishing is reasonable; in coastal fishing areas, fishing is the main focus and farming is developed; in semi-fishing and semi-agricultural areas, farming is the main focus and fishing is combined.
Article 4 The fishery administrative department of the people's government of the autonomous region is in charge of fishery work in the entire region, and the fishery administrative department of the people's government at or above the county level is in charge of fishery work within its own administrative region.
Article 5 Units and individuals outside the autonomous region that enter the waters under the jurisdiction of this autonomous region to engage in fishery activities must obtain approval from the fishery administrative department of the autonomous region.
Article 6 Units and individuals within the autonomous region that engage in fishery production or fishery resource survey activities in the waters under the jurisdiction of the autonomous region through joint ventures or cooperation with Hong Kong, Macao, Taiwan or foreign countries must report to the autonomous region’s fishery administrative department for review and approval.
Report to the relevant competent authorities of the State Council for approval.
Article 7 Units and individuals who have made outstanding achievements in implementing fishery laws and regulations, developing fishery production, engaging in fishery science and technology research, making significant contributions to the proliferation and protection of fishery resources, and reporting and stopping behaviors that damage fishery resources,
People's governments at all levels or fishery administrative departments should provide spiritual or material rewards.
Chapter 2 Institutional Setup and Fishery Supervision and Management Article 8 The fishery administrative departments at or above the county level in autonomous regions and coastal areas shall establish fishery supervision, fishing port supervision and fishing vessel inspection and management agencies.
Fishery administrative departments at or above the county level in inland areas with large water surfaces may establish fishery supervision and management agencies as needed.
Large and medium-sized reservoirs may establish fishery supervision and management agencies as needed, with the consent of the water conservancy department at or above the county level and approval by the fishery administrative department of the autonomous region.
Article 9 The fishery administration supervision, fishing port supervision and fishing vessel inspection and management agencies at all levels shall exercise the power of fishery administration and fishing port supervision and management within the waters under their jurisdiction.
Higher-level fishery supervision, fishing port supervision and fishing vessel inspection and management agencies have the power to coordinate or make rulings on major issues that arise in the management work of lower-level fishery supervision, fishing port supervision and fishing vessel inspection and management agencies.
Article 10 Responsibilities of fishery supervision and management agencies: (1) Supervise and inspect the implementation of fishery laws and regulations, and supervise and inspect the implementation of fishery treaties and agreements concluded by the state within the waters under the jurisdiction of this autonomous region.
Implement administrative penalties in accordance with the law for violations of fishery laws, regulations and fishery treaty agreements; (2) safeguard national fishery rights and interests and handle foreign-related matters related to fishery supervision and management; (3) apply for fishery fishing licenses and other relevant fishery management certificates
Approval, issuance and cancellation; (4) Responsible for the collection, management and use of fishery resource enhancement protection fees; (5) Protect and increase fishery resources and rare aquatic animals, monitor and deal with pollution in fishery waters, and maintain the fishery environment and its ecological balance; (5)
6) Maintain the order of fishery production, mediate and handle fishery production disputes, and protect the legitimate rights and interests of fishery producers; (7) Organize and manage fishery communication and navigation services; (8) Handle other relevant fishery supervision and management matters.
