In order to speed up the solution of the problems left over from the renovation project of shanty towns and urban villages in our district, According to the Guiding Opinions of the General Office of the Provincial Party Committee and the General Office of the Provincial Government on Solving the Legacy Problems of Real Estate Development ([217]-27), the Opinions of Baoding Municipal People's Government on Accelerating the Solution of the Legacy Problems of the Renovation Project of Shantytowns and Villages in the Main City (Bao Zheng Han [218] No.15) and the Supplementary Opinions of Baoding Municipal People's Government on Accelerating the Solution of the Legacy Problems of Real Estate Development in the Main City (Bao Zheng Han [218])
I. Scope of application
Since 24, the shed reform project that has not been completed with the approval of the municipal government in our district (see annex).
second, standardize the investment behavior of relocation
(1) the district government is the main body responsible for the relocation of the shed reform project, and the townships and sub-district offices are the main bodies for the relocation of the shed reform project. The district government will set up a working group composed of district land, housing construction, planning, township (street), village "two committees", evaluation institutions, surveying and mapping institutions, legal services and other units on a project-by-project basis to promote the relocation work according to law.
(2) within 6 days from the date of issuance of this plan, the district government will conduct a comprehensive review and collective research on the economic situation, performance ability, social credit and qualification grade of the real estate enterprises involved in the transformation. The specific implementation procedures are as follows:
1. Each township and sub-district office will sort out the unfinished shed reform projects approved by the municipal government in this area in detail, study them one by one, formulate the reform plan for each project according to the principle of "one village, one policy", and give preliminary opinions on whether the original development enterprises will continue to intervene. According to the sample of the framework of the four-party agreement (formulated by the district shed reform office), the first draft of the four-party agreement in line with this project is formulated and reported to the district shed reform office. The main clauses of the four-party agreement include but are not limited to the following contents:
(1) The real estate enterprise shall pay the compensation fund for expropriation based on the area of land within the scope of examination and approval that has not been demolished, and at the standard of not less than 3 million yuan/mu; Resettlement houses have all reached the occupancy conditions, and can be paid by half; If the demolition has been completed but the resettlement house has not been built, the resettlement house construction fund shall be paid according to the standard that the resettlement house installation cost and the floating rate are not less than 1%.
(2) implement the municipal government's real estate market regulation policy;
(3) At least 95% of the total households will be relocated before the end of December 218. If it cannot be completed, the funds to enjoy the policy will be reduced by 5% month by month, with a maximum of 3%. If the municipal government has other documents or instructions, they shall be implemented in accordance with the municipal government documents or instructions;
(4) When the planned land for urban infrastructure and the land not included in the shed reform policy are handed over within the scope of land requisition and relocation, the government will not pay any additional fees;
(5) Real estate enterprises should operate according to the law and build according to the law. In case of illegal occupation of land, illegal construction, illegal sales, unauthorized transfer of projects and unauthorized disposal of resettlement houses, the district government will deduct a certain proportion (not less than 1%) of the * * management funds until the shed reform agreement is terminated. The enterprise, legal representative, shareholders and other enterprises registered with legal representatives and shareholders are not allowed to participate in Lianchi area for five years.

2. The district shed reform office shall review and check the reform opinions of each project reported by each township and sub-district office and report them to the district government.
3. The district government held a joint meeting or a government executive meeting to study the shantytown renovation, and finally determined the renovation opinions of each project and the four-party agreement.
4. The real estate enterprises that have passed the examination shall, within 1 days after receiving the "Notice of Passing the Examination", set up a * * management account with the district shed reform office, and after paying the compensation funds, sign a four-party (district government, township or street, village and enterprise) cooperative transformation agreement, and the township (street) will publicize the specific project transformation plan (including the specific situation of the project, development unit and completion time limit, etc.). The four-party agreement shall be reported to the Municipal Bureau of Land and Resources, the Housing and Construction Bureau and the shed (city) for filing.
5. For the real estate enterprise that fails to pass the examination or fails to pay the compensation funds on time, the district government will issue a notice to suspend and terminate its participation in the transformation, order the real estate enterprise to provide relevant materials for the transformation within a time limit, and entrust an audit unit with Grade A qualification to audit the actual investment of its project and issue an audit report. The actual investment of the original development enterprise shall be compensated by the strategic investors introduced separately according to the audit report. The newly introduced strategic investors will sign a new four-party cooperation and transformation agreement after paying the compensation funds in accordance with the procedures.
if the original development enterprise has illegal land occupation, illegal construction, illegal pre-sale, etc., the district government instructs the administrative department to investigate, and handle it administratively according to law until it is handed over to the judicial organs.
6. the district government will set up a working group for each shed reform project to promote the relocation work according to law.
(3) For projects that have not been approved to enjoy the land scale of shed reform policy, the land scale of urban shanty towns = the registered area of housing property rights ×2.8/ planned plot ratio, and the maximum shall not exceed the original residential land area within the scope of relocation; The scale of the land used in the village in the city = the area of the homestead ×1+ the area of other collective construction land (excluding unused land, squares and breeding land) ×.3, and the maximum can not exceed the area of the existing planned construction land in the village.
III. Standardizing land supply procedures
(1) After the compensation and conversion of the shed reform project are completed, the district government will allocate funds according to the shed reform policy, and the agricultural land beyond the scope of expropriation and relocation that does not enjoy the shed reform policy will be allocated at the standard of 36, yuan/mu.
(2) The land that enjoys the shed reform policy should be sold separately; Adjacent land that does not enjoy the shed reform policy, with independent planning conditions, should be sold separately; Do not have independent planning conditions, can be sold together with the shed land. The land for resettlement houses and the land for commercial housing that is not more than 1.5 times of the land for resettlement houses can be sold first.
(3) When transferring the shed-converted land, it should be indicated in the transfer plan that "the land belongs to the shed-converted project, and the problems existing in the project shall be explained by the district government", and the land use right holder who wins the shed-converted land shall be responsible for solving the problems left over by the project.
IV. Improve the system of fund allocation
(1) The district government strengthens the supervision over the expropriation compensation funds, and allocates them in strict accordance with the progress of expropriation and relocation. If the expropriation and relocation funds are insufficient to guarantee the remaining payable expropriation and relocation expenses, the real estate enterprises will continue to pay for them.
process of collecting and allocating funds: before the demolition and reconstruction, the township (street) will apply to the district shed reform office, and the district shed reform office will allocate 3% of the initial start-up funds to the township (street). The remaining transformation funds shall be allocated by the townships (streets) according to the progress of the project requisition and relocation.
fund allocation process for resettlement housing construction: after the resettlement housing has obtained the construction procedures, the township (street) will apply to the district shed reform office before the construction starts, and the district shed reform office will allocate 3% of the initial construction funds to the township (street). The remaining construction funds shall be allocated by the townships (streets) according to the progress of resettlement housing construction.
(2) For the unfinished project of supplying local land in advance, the land occupied by the homestead within the transfer scope (replacement) shall be taken as the land area for enjoying the shed reform policy. If the land for urban planning infrastructure on behalf of the demolition and collection has not been relocated synchronously, 1.3 times of its area will be temporarily withheld to enjoy the funds of shed reform policy.
(3) The land transfer fee for enjoying the shed reform policy can be paid in two phases, with the first phase not less than 5% of the total amount of funds payable. After the payment is completed, the District Finance Bureau will complete the disbursement within 15 working days after receiving the funds allocated by the Municipal Finance Bureau. After the second phase of land transfer fee is paid, excluding the funds set aside by the state and the province, the district government will implement it according to the original approval documents approved by the municipal government. The cost of expropriation, compensation, resettlement and land consolidation is determined by referring to the highest standard of the benchmark land price of the corresponding level in the year.
the district government applies for funding to the municipal shed (city) reform office, and provides information such as the project name, plot number, plot source, land transfer contract, land transaction confirmation and related accessories, general payment book, whether it involves new construction land and farmland occupation tax, etc. The municipal shed (city) reform office will inform the Municipal Finance Bureau of the above information and the opinions of the land to enjoy the shed reform policy.
V. Strengthening organizational promotion
(1) The district government will incorporate the completion of shed reform tasks into the performance appraisal system, schedule them regularly, and vigorously promote the shed reform work.
(2) All townships, streets, and relevant district departments should list the shed reform work as the "number one" project at all levels, put it on the important agenda, establish a collective research mechanism, strictly identify the approved shed reform projects, prohibit fraud, and prevent project hitchhiking and policy hitchhiking; Strictly supervise the shed reform projects being implemented, and resolutely eliminate real estate enterprises that violate the contract and disturb the order; Strictly supervise the unapproved shed reform projects, and it is strictly forbidden to sign agreements and start the demolition without authorization.
this scheme shall come into force as of the date of issuance and shall be valid until February 4, 22. if the relevant documents on shed (city) reform previously issued by the district government are inconsistent with this scheme, this scheme shall prevail.

1. shantytown renovation projects (18): renovation of Xinhua printing house, renovation of staff dormitory of First Hospital of Traditional Chinese Medicine, renovation of mosque area, renovation of Fuhe area, renovation of Lingyun Street area of Zhifangtou Village (part of state-owned land), renovation of dormitory of Baoding Automobile Refitting Company, renovation of Shuangsheng Street area (about 78 mu), Renovation of dilapidated living quarters of Rongjun Hospital, No.35 courtyard of Puqing Road, living quarters of Baoding Hotel, staff quarters of Baoding Academy of Agricultural Sciences, Dongguan Street, Huajian Wood Workers' Dormitory, Hutong Building Dormitory, Youth Palace Dormitory (about 1 mu), Sanfeng Road and Lianchi South Street (about 61.6 mu), and the west plot of Xigaozhuang Community (about 8.72 mu).
