Social relief fund for road traffic accidents
Relief fund is a new system stipulated in Article 17 of Road Traffic Safety Law. This system is a supplement to the compulsory liability insurance for motor vehicle traffic accidents (hereinafter referred to as "compulsory insurance"). The purpose is to ensure that victims can get timely assistance or appropriate compensation through the rescue fund when they can't get compensation according to the compulsory insurance system and the infringer.

Source:

(a) according to a certain proportion of motor vehicle traffic accident liability compulsory insurance (hereinafter referred to as compulsory insurance);

(2) Financial subsidies given by local governments according to the amount of business tax paid by insurance companies for compulsory insurance;

(three) fines for motor vehicle owners and managers who fail to apply for compulsory insurance according to regulations;

(four) the fruits of the relief fund;

(five) the funds recovered by the relief fund management institution from the person responsible for the motor vehicle road traffic accident according to law;

(6) social donations;

(7) Other funds.

Advance payment situation

Under any of the following circumstances, the relief fund shall advance the funeral expenses and part or all of the rescue expenses of the victims of road traffic accidents:

(a) the cost of rescue exceeds the limit of compulsory insurance liability;

(two) the motor vehicle did not participate in compulsory insurance;

(3) A motor vehicle escapes after an accident.

Legal basis: Trial Measures for the Management of Social Assistance Fund for Road Traffic Accidents Article 3 The principle of unified policy, local fund-raising, graded management and division of responsibilities shall be applied to the assistance fund.

The Ministry of Finance shall, jointly with relevant departments, formulate relevant policies on relief funds, and guide and supervise the collection, use and management of relief funds in all provinces, autonomous regions and municipalities directly under the Central Government.

The provincial people's government shall set up a relief fund. The relief fund management departments below the provincial level and the relief fund management level shall be determined by the provincial people's government.

"Trial Measures for the Administration of Social Assistance Funds for Road Traffic Accidents" Article 6 The sources of assistance funds include:

(a) according to a certain proportion of motor vehicle traffic accident liability compulsory insurance (hereinafter referred to as compulsory insurance);

Article 12 of the Trial Measures for the Administration of Social Assistance Fund for Road Traffic Accidents shall pay the funeral expenses and part or all of the rescue expenses of the victims of road traffic accidents under any of the following circumstances:

(a) the cost of rescue exceeds the limit of compulsory insurance liability;

(two) the motor vehicle did not participate in compulsory insurance;

(3) A motor vehicle escapes after an accident.

In accordance with the law, if part or all of the funeral expenses or rescue expenses of the victim should be paid by the relief fund, the relief fund management institution in the place where the road traffic accident occurred should pay it in time.

The relief fund generally pays the victim's relief expenses within 72 hours after receiving the relief. Under special circumstances, if the rescue cost exceeds 72 hours, the medical institution shall explain the reasons in writing. According to the specific accounting standards approved by the price department of the place where the motor vehicle road traffic accident occurred.

Article 15 of the Trial Measures for the Management of Social Assistance Fund for Road Traffic Accidents shall, after receiving the advance notice from the traffic administrative department of the public security organ and the application and related materials for medical institutions to advance the outstanding rescue expenses, review the following contents within five working days in accordance with the relevant provisions of these Measures. The guidelines for clinical diagnosis and treatment of road traffic accident victims and the charging standards shall be formulated by the local price department, and the audit results shall be informed in writing to the traffic administrative department of the public security organ and the medical institutions:

(a) whether it belongs to the provisions of Article 12 of these measures;

(two) whether the rescue expenses are true and reasonable;

(3) Other contents that the relief fund management institution deems necessary to be audited.

In line with the requirements of advance payment, the relief fund management institution shall transfer the relevant expenses to the account of the medical institution. Do not meet the requirements of advance, not to advance, and explain the reasons to the medical institutions.
