1. If you don't pay the house maintenance fund, you may not be able to apply for the real estate license. Deposit special residential maintenance funds in accordance with the following provisions:
(1) The owner shall deposit the residential special maintenance fund according to the construction area of the property owned, and the amount of the first residential special maintenance fund deposited per square meter of construction area shall be 2% of the local housing reform cost price;
(two) units selling houses shall, in accordance with the proportion of multi-storey residential buildings and high-rise residential buildings, not less than 20% and 30% respectively, extract special maintenance funds from houses.
2. Legal basis: Article 13 of the Measures for the Administration of Residential Special Maintenance Funds.
Failing to deposit the first residential special maintenance fund in accordance with the provisions of these measures, the development and construction unit or the public housing sale unit shall not deliver the house to the purchaser.
Article 6
The owners of the following properties shall deposit special residential maintenance funds in accordance with the provisions of these Measures:
(a) residence, except that it is jointly owned by the owners and does not use parts and facilities with other properties;
(2) Non-residential buildings in residential quarters or non-residential buildings connected with single residential structures outside residential quarters.
If the property listed in the preceding paragraph belongs to the sale of public housing, the selling unit shall deposit special housing maintenance funds in accordance with the provisions of these measures.
Two, under what circumstances can use the maintenance fund?
The maintenance fund can be used under the following circumstances:
1. The maintenance fund can only be used when the warranty period expires, the public parts of the property and the * * * facilities and equipment are overhauled, updated and transformed. The specific owners shall share the cost proportion according to the determination standard of voting rights. When the maintenance fund is idle, it shall not be used for other purposes except the purchase of treasury bonds or other funds stipulated by laws and regulations;
2. The property management company can temporarily borrow the reserve fund equivalent to one month's daily maintenance and update cost of the property from the maintenance fund; Unless otherwise agreed in the property management service contract;
3, residential overhaul or special maintenance, update, you can extract the advance payment agreed in the construction contract, but the advance payment shall not exceed 30% of the total project;
4. The owners' committee may keep a reserve fund equivalent to one month's activity funds in the account of the property management enterprise, unless otherwise decided by the owners' congress.
