Two and a half solved problems: special maintenance funds for residential buildings are about to wake up.
"One square meter needs to be paid to 90 yuan. What is the special maintenance fund for this house? " In the past two days, Mr. Yan, a citizen who is going through the real estate formalities, made a big fuss about the special maintenance fund of 10620 yuan that needs to be deposited. There are not a few guilty buyers like Mr. Yan. The reporter learned that the scale of residential special maintenance funds collected within the city has reached 56 billion yuan. However, the utilization rate of residential special maintenance funds is not high, and a large amount of funds are sleeping in special bank accounts. According to industry insiders, it is difficult to use this money for "two-thirds", that is, the exclusive part accounts for more than two-thirds of the total construction area and accounts for more than two-thirds of the total number of owners within the scope of residential special maintenance funds. It is this hard indicator that keeps many communities out. Now, the good news is coming. The Civil Code of People's Republic of China (PRC) reduces the difficulty of using the maintenance fund for buildings and their ancillary facilities, and only requires the consent of more than half of the owners and more than half of the voters in the exclusive area. In other words, the original "two-thirds" has become "two halves", and the sleeping maintenance funds are about to wake up.

What is a residential maintenance fund?

Residential special maintenance funds refer to funds earmarked for the maintenance, renewal and transformation of residential parts and facilities after the expiration of the warranty period, and shall not be used for other purposes. Maintenance funds are basically paid when buying a house. The standard of special maintenance funds is: 90 yuan per square meter for high-rise buildings (including multi-storey buildings with elevators) and 50 yuan per square meter for multi-storey buildings (including villas). At present, the stock of maintenance funds in our city is about five or six billion yuan.

"According to the provisions of the Measures for the Administration of Special Maintenance Funds for Residential Buildings, the * * * part of a residential building refers to the part shared by the owner in a single house or the owner in a single house and the non-residential owner connected with the structure, generally including foundation, load-bearing walls, columns, beams, floors, roofs, outdoor walls, hallways, staircases and corridors. Supply facilities and equipment generally include elevators, antennas, lighting, fire-fighting facilities, etc. Set up a special account for maintenance funds and set up a sub-account with the house number. " Zheng of Taiyuan Special Maintenance Fund Management Center said, "The maintenance funds in our city have been collected since 2002, and the annual utilization rate is about 1 100 million yuan, which is not too low, and can reach 7% to 8%. As long as eligible communities can apply through normal procedures. " The house maintenance fund is the pension of the house, follow the house. Housing transactions, public maintenance funds with the automatic transfer of housing. If the house is demolished or lost, the remaining house special maintenance funds in the house ledger shall be returned to the owner.

"Two thirds" is a stumbling block.

Although the maintenance funds can be used according to the procedures, in the interview, many citizens still said that it is difficult to use the maintenance funds. Where is the difficulty? Zheng said that "two-thirds" is the key to blocking the application channels. According to the Regulations on Property Management in Taiyuan City and the Measures for the Administration of Special Maintenance Funds for Residential Buildings, if residential quarters need to use maintenance funds, firstly, property service enterprises can put forward suggestions on the use according to maintenance, renewal and transformation projects. If there is no property, the relevant owners will put forward suggestions for use. In the second step, the proprietary part accounts for more than two-thirds of the total construction area and accounts for more than two-thirds of the total construction area. The third step, the property service enterprise or the relevant owners organize the implementation of the use plan. The fourth step, the property or related industries should apply for fees from the real estate authorities with relevant materials. After the examination and approval of the real estate department, a notice of transfer of residential maintenance funds will be issued to the special account management bank, and the bank will transfer the required funds to the maintenance unit. Among them, the most difficult part is "two-thirds". "The' two-thirds' indicator is more difficult to operate: some owners are not motivated and think they are unwilling to sign, and some owners do not live in the local area, so it is difficult to sign in writing." Mr. Chen, the owner of Furun Jiayuan Community, said that when they used maintenance funds to repair the elevators in the community, they were stuck in "two-thirds" at that time. The property manager of a large residential area in Yifen Street told the reporter: "If it is a residential area of several buildings, it is easier to obtain the consent of two-thirds of the owners. After all, there are few households. But if it is a large community, it is very difficult to get the consent of this' two-thirds'. "

"Two halves" to solve the problem

Now these two "two-thirds" problems can be solved immediately. The latest "People's Republic of China (PRC) Civil Code" reduces the difficulty of using the maintenance fund for buildings and their ancillary facilities, and only requires the consent of more than half of the owners and more than half of the voters. In other words, the voting rights of owners include the number of owners and the number of areas. For example, a community with a total construction area of 90,000 square meters has 900 owners. More than 600 owners, 60,000 square meters need to vote to decide the use of maintenance funds, and more than half of the 600 voters agree, that is, as long as there are at least 300 owners, 30,000 square meters, the threshold is obviously lowered.

For the use of public maintenance funds, the Civil Code has also added a provision, "If it is necessary to maintain buildings and their ancillary facilities due to emergency, the owners' assembly or owners' committee may apply for the use of maintenance funds according to law." In addition, according to the regulations, this maintenance fund belongs to the owner, and can be used for the maintenance, renewal and transformation of elevators, roofs, external walls and barrier-free facilities. * * * With the consent of the owner, the collection and use of maintenance funds should also be announced. In this regard, the relevant person in charge of the Provincial Housing Society said that the previous regulations were demanding and difficult to operate in practice, which brought great inconvenience to residents' daily life. The civil code reduces the voting requirement of this matter to "half" of the area and number of people, which is conducive to awakening the public maintenance fund and making it truly serve the people.
