The relevant administrative departments (institutions) of transportation, marine and fishery, water affairs, supervision and management of production safety, environmental protection, public security, comprehensive urban management, tourism, ports, waterways, sports, etc. shall, according to their respective functions and duties, do a good job in the related work of water traffic safety management. Article 5 The municipal, district (county) people's governments shall strengthen the management of water traffic safety, establish and improve the responsibility system of water traffic safety management and emergency rescue mechanism, coordinate and solve major problems in water traffic safety management, implement personnel and equipment, arrange corresponding funds, and ensure the normal development of emergency rescue work.
The town people's government and sub-district offices are responsible for establishing and improving the responsibility system for the safety of vessels and facilities of administrative villages (communities) and owners of vessels and facilities within their respective jurisdictions.
Units and individuals engaged in production and business activities related to water traffic safety shall establish corresponding responsibility system for water traffic safety. Sixth water traffic safety management should promote the construction of scientific and technological information, improve the scientific and technological level of water traffic safety monitoring. Chapter II General Provisions Article 7 Before sailing or engaging in related activities, vessels and installations shall be inspected in accordance with relevant state regulations, registered according to law and equipped with crew.
Vessels and installations shall be equipped with fire fighting, lifesaving, pollution prevention and emergency equipment, keep the technical condition in line with the inspection technical specifications, and ensure that they are suitable for safe navigation, berthing or related activities.
A ship shall be equipped with qualified crew members according to the manning requirements stipulated by the state. Facilities shall be equipped with personnel with professional skills such as collision avoidance, signaling, communication, fire fighting and lifesaving in accordance with state regulations. Eighth ships entering and leaving the port, should maintain sufficient water depth.
Overloaded ships and non-passenger ships are prohibited from carrying passengers. Ships engaged in passenger transport shall indicate the passenger quota in a prominent position, and shall not pile up goods in passenger cabins and personnel passages. Article 9 The maritime administrative agency may, according to the needs of the supervision and administration of water traffic safety, delimit and publish the areas for ship declaration in the waters of the special zone, and formulate regulations for the administration of ship declaration.
A ship shall report to the maritime administrative agency in accordance with the Regulations on the Administration of Ship Reports. The maritime administrative agency shall establish a dynamic data information service platform for ships entering and leaving the port, and open it to the port administrative agency and other relevant units to realize resource sharing. Article 10 Under any of the following circumstances, the maritime administrative agency may, according to the circumstances, take temporary measures to restrict and divert traffic, such as sailing in a limited time, sailing alone or banning navigation, and make an announcement:
(1) Severe weather such as fog, cold wave, strong wind and typhoon;
(two) large-scale water construction operations;
(3) Water traffic accidents affecting navigation;
(four) large-scale mass activities or sports competitions on the water;
(5) Other circumstances that have a significant impact on navigation safety. Article 11 A ship that needs pilotage according to law shall apply to the pilotage institution for pilotage.
Pilotage institutions shall meet the legal pilotage requirements put forward by ships, provide pilotage services for ships in a timely manner, and shall not refuse or delay without reason.
Pilots leading ships shall abide by the provisions on navigation management and safety supervision and management, and board and disembark the led ship at the pilot anchorage or the boarding and disembarking wheel point announced by the maritime administrative agency; In case of special circumstances, such as bad weather, it is necessary to change the place to board and leave the piloted ship or change the pilotage plan, and the pilotage institution shall take effective measures to ensure safety. Article 12 The following vessels shall report to the maritime administrative agency 24 hours before entering or leaving the port or sailing in the port waters, verify the sailing route, time and safety measures taken, and sail and take safety maintenance measures according to the requirements of the maritime administrative agency:
(1) Ships transporting liquefied gases;
(2) Ships carrying or towing overweight, super-long, super-high, super-wide and semi-submersible objects;
(three) other ships that may seriously affect the safety of water traffic or seriously pollute the ecological environment of water areas.
The specific scope of the ships specified in Items (2) to (3) of the first paragraph of this article shall be determined by the maritime administrative agency after soliciting the opinions of ports, pilotage and other units, and shall be announced to the public. Article 13 A ship shall, according to its type, tonnage, length and draft, and in accordance with laws and other provisions on water traffic safety management, berth at the anchorage, berthing area and operation area announced according to law.
It is forbidden for ships to anchor in navigation channels, U-turn areas, no-anchoring areas and harbor basins; In case of emergency anchoring under special circumstances, corresponding safety measures shall be taken and reported to the maritime administrative agency immediately, and the maritime administrative agency shall notify the relevant units after receiving the report.
When a ship berths, it shall display signals in accordance with regulations, and shall not hinder or endanger the safety of navigation, berthing or operation of other ships.
When a ship berths, there should be enough crew on duty to ensure the safety of the ship.
