Notice of the People's Government of Yunnan Province on Forwarding the State Council's Interim Measures for the Administration of Raising and Using Water Conservancy Construction Funds and Printing and Distributing the Implementation Rules of Yunnan Province Article 1 In order to speed up the pace of water conservancy construction, improve the flood control and drought resistance of rivers, change the backward situation of key water conservancy facilities and river flood control system construction, alleviate the contradiction between supply and demand of water resources, and promote the sustained, rapid and healthy development of social economy, these detailed rules are formulated in accordance with the Interim Measures for the Administration of Raising and Using Water Conservancy Construction Funds of the State Council and combined with the actual situation of our province. Article 2 The Yunnan Water Conservancy Construction Fund shall be established to be used exclusively for water conservancy construction in the whole province, and shall be composed of three levels of water conservancy construction funds at the provincial, prefectural and county levels. It is mainly used for urban flood control, river and lake management and water conservancy project maintenance and construction. Major water conservancy projects across regions shall be undertaken by provinces and relevant cities; The management expenses of the key protection projects of national borders and rivers are shared by the central government and the provinces, prefectures and counties. Article 3 Sources of provincial water conservancy construction funds:

(a) from the relevant departments of the province centralized government funds (fees, surcharges) from 3%. Specific projects include: road maintenance fees, highway construction funds, vehicle tolls, highway transportation management fees, driver training fees, local electric power construction funds, market management fees, individual industrial and commercial management fees, land acquisition management fees, and municipal facilities supporting fees.

(two) water conservancy projects and flood control facilities funds (funds, fees and surcharges) approved by the provincial people's government. Four, the county water conservancy construction fund sources:

(1) 3% of government funds (fees and surcharges) retained by counties. Specific projects include: road maintenance fees, highway construction funds, vehicle tolls, highway transportation management fees, personnel training fees, local electric power construction funds, market management fees, individual industrial and commercial management fees, land acquisition management fees, and municipal facilities supporting fees.

(2) For cities with key flood control tasks, more than 15% of the retained portion of the urban maintenance and construction tax will be used for urban flood control construction.

Kunming City, Jinghong City, Chuxiong City, Yuxi City, Ruili City, Qujing City and Gejiu City with key flood control tasks, as well as key flood control cities determined by state and municipal people's governments and regional administrative offices, set aside 20% of the funds retained from the urban maintenance and construction tax for urban flood control construction.

(three) the county retained part of the water conservancy projects and flood control facilities construction projects (funds, fees and surcharges) approved by the provincial people's government.

Article 5 Measures for the transfer of water conservancy construction funds in Yunnan Province shall be formulated by the Provincial Department of Finance in conjunction with the Provincial Planning Commission and the Provincial Department of Water Resources and Hydropower. Article 6 The provincial water conservancy construction fund shall be specially used for: large and medium-sized water conservancy projects listed in the province; Managing and maintaining important rivers and lakes; Construction of key projects for soil erosion prevention and control; Maintenance of important water conservancy facilities; Maintenance and construction of provincial flood control and drought relief communication information system; Other water conservancy facilities approved by the provincial people's government. Article 7 The county-level water conservancy construction fund is specially used for: large and medium-sized water conservancy projects included in the province; Small and medium-sized rivers and lakes in counties and counties and soil erosion prevention and control projects; County water conservancy projects; Construction of urban flood control facilities; Maintenance of key water conservancy facilities in counties; Other water conservancy facilities approved by the people's government at the same level. Eighth water conservancy construction funds belong to the government funds, in accordance with the provisions of the "the State Council on strengthening the management of extrabudgetary funds" and "Regulations on the management of extrabudgetary funds in Yunnan Province", into the financial budget management at the same level. At the beginning of each year, the provincial, prefectural and county water administrative departments submit the annual plan for the use of funds to the finance department at the same level, and allocate funds after being audited by the finance department at the same level. Among them, the water conservancy construction fund for the capital construction of water conservancy projects should be included in the capital construction investment plan. The water conservancy construction fund is earmarked, and the year-end balance can be carried forward to the next year. Ninth departments at all levels should establish and improve the water conservancy construction fund revenue and expenditure accounting system and daily management system; Planning departments should strictly examine water conservancy capital construction projects. At the end of the year, the water conservancy departments at all levels that use the water conservancy construction fund shall prepare the final accounts of the water conservancy construction fund and report them to the finance department at the same level and the water administrative department at a higher level respectively; Belong to the basic construction expenditure, but also in accordance with the provisions of the preparation of basic construction financial accounts, reported to the finance department at the same level for approval. Article 10 No department or unit may raise the collection standard of water conservancy construction funds without authorization, expand the scope of use, and may not intercept, occupy or misappropriate them. Finance, planning and auditing departments at all levels should strengthen supervision and inspection of water conservancy construction funds.
