Beijing Cultural Relics Protection and Management Regulations

Chapter 1 General Provisions Article 1 In order to implement the "Cultural Relics Protection Law of the People's Republic of China" (hereinafter referred to as the "Cultural Relics Protection Law") and strengthen the protection and management of cultural relics, these regulations are formulated in light of the actual situation of this city.

Article 2 Within the administrative area of ??this city, the following cultural relics with historical, artistic, and scientific value are protected by the state: (1) Ancient cultural sites, ancient tombs, ancient buildings, grotto temples, and stone carvings with historical, artistic, and scientific value

; (2) Buildings, sites and monuments related to major historical events, revolutionary movements and famous figures, with important commemorative significance, educational significance and historical material value; (3) Precious artworks, arts and crafts from various eras in history

(4) Important revolutionary documents and materials, as well as manuscripts, old books and materials with historical, artistic, and scientific value; (5) Representative objects that reflect the social systems, social production, and social life of various eras and ethnic groups in history.

Vertebrate paleontology fossils and ancient human fossils with scientific value and ancient and famous trees with historical value and commemorative significance are protected by the state in the same way as cultural relics.

Article 3 All cultural relics remaining underground and in waters within the administrative area of ??this city belong to the state.

Ancient cultural sites, ancient tombs, and cave temples are owned by the state.

Memorial buildings, ancient buildings, stone carvings, etc. designated for state protection shall belong to the state unless otherwise specified by the state.

Cultural relics collected by state agencies, military units, enterprises owned by the whole people, and public institutions belong to the state.

Article 4 The ownership of collectively owned and privately owned memorial buildings, ancient buildings and handed down cultural relics shall be protected by state law.

Owners of cultural relics must abide by state regulations on the protection and management of cultural relics.

When the ownership of collectively owned or privately owned memorial buildings and ancient buildings changes, they must be registered with the cultural relics administrative agency.

Article 5 The people's governments at all levels of this city shall protect cultural relics within their own administrative regions.

All organizations and individuals have the obligation to protect national cultural relics.

Chapter 2 Cultural Relics Management Agencies Article 6 The Beijing Municipal Administration of Cultural Relics (hereinafter referred to as the Municipal Cultural Relics Bureau) is the administrative agency for cultural relics in this city and is responsible for the protection and management of cultural relics in the city.

District and county cultural relics administrative agencies, under the guidance of the Municipal Cultural Relics Bureau, are responsible for the protection and management of cultural relics in their respective districts and counties.

Article 7 Garden, religious, housing management, education and other administrative agencies, under the supervision and guidance of the cultural relics administrative agencies, strengthen management of their affiliated units that use cultural relics, and do a good job in protecting cultural relics in accordance with the law.

Article 8 A cultural relics protection unit approved in accordance with the Cultural Relics Protection Law shall set up special agencies or staff full-time or part-time personnel according to the circumstances, and shall be responsible for the protection and management of the cultural relics protection unit under the guidance of the cultural relics administrative authority.

Article 9 The Municipal People's Government selects experts, scholars and heads of relevant departments to establish the Municipal Cultural Relics and Monuments Protection Committee to assist the Municipal People's Government in researching and reviewing major issues in the protection and management of cultural relics.

Chapter 3 Funds for the Protection and Management of Cultural Relics Article 10 Funds for the protection and management of cultural relics shall be included in the municipal, district and county financial budgets respectively.

Article 11 People's governments at all levels and cultural relics administrative agencies shall raise funds through multiple channels for the protection and repair of cultural relics.

Article 12: To establish a cultural relics protection fund, specific measures shall be formulated by the Municipal People's Government.

Article 13: Domestic and foreign groups and individuals are encouraged to voluntarily donate funds to develop cultural relics undertakings.

Article 14 Funds for cultural relics protection and management shall not be used for other purposes.

Chapter 4 Cultural Relics Protection Units Article 15 Cultural relics protection units within the administrative region of this city are divided into: national key cultural relics protection units, municipal-level cultural relics protection units, and district and county-level cultural relics protection units.

Municipal cultural relics protection units are proposed by the Municipal Cultural Relics Bureau, approved and announced by the Municipal People's Government, and reported to the State Council for filing.

District and county-level cultural relics protection units are proposed by the district and county cultural relics administrative agencies, approved by the municipal cultural relics bureau, approved and announced by the district and county people's governments, and reported to the municipal people's government for record.

Article 16 The cancellation of cultural relics protection units at the district or county level must obtain the consent of the Municipal Cultural Relics Bureau and be approved by the people's government that originally approved and announced the decision.

Article 17: For cultural relics and historic sites whose protection value is yet to be determined, the district or county people's government may declare them as cultural relics temporary preservation units and protect them as if they were district or county-level cultural relics protection units.

Within two years after the temporary preservation of cultural relics is announced, the identification of it must be completed.

According to the appraisal results, it will be announced as a cultural relic protection unit at the district or county level or announced to be revoked.

If the announcement is not made within the time limit, the temporary guarantee unit will be automatically revoked.

Article 18 For cultural relics and monuments that have not been approved as cultural relics protection units or cultural relics temporary preservation units, the Municipal Cultural Relics Bureau may require relevant units to take measures to protect them when necessary, and make timely decisions together with relevant municipal departments.

Article 19: Cultural relics protection units at all levels shall delineate the necessary protection scope in accordance with the law, and set aside certain construction control zones based on actual needs.

The protection scope and construction control zones of national key cultural relics protection units and municipal cultural relics protection units are delineated by the Municipal Cultural Relics Bureau in conjunction with the Municipal Urban Planning Administration (hereinafter referred to as the Municipal Planning Bureau), and are approved and announced by the Municipal People's Government.

The protection scope and construction control zone of cultural relics protection units at the district and county levels shall be delimited by the district and county cultural relics administrative agencies in conjunction with the district and county planning management agencies, and shall be approved by the district and county people's governments with the consent of the Municipal Cultural Relics Bureau and the Municipal Planning Bureau.
