Traffic accident relief fund is a new social relief system stipulated in Article 17 of Road Traffic Safety Law. This system is a supplement to the compulsory insurance system for motor vehicle traffic accidents (hereinafter referred to as "compulsory insurance"). The purpose is to ensure that victims can get timely assistance or appropriate compensation through the rescue fund when they can't get compensation according to the compulsory insurance system and the infringer.
According to Article 24 of the Regulations on Compulsory Liability Insurance for Motor Vehicle Traffic Accidents, under any of the following circumstances, the funeral expenses and part or all of the rescue expenses of the victims of road traffic accidents shall be paid in advance by the rescue fund, and the rescue fund management institution has the right to recover from the person responsible for road traffic accidents: (1) If the rescue expenses exceed the liability limit of compulsory insurance; (two) the motor vehicle did not participate in compulsory insurance; (3) A motor vehicle escapes after an accident.
The relief fund pays the relief expenses in advance. The relief fund generally pays the relief expenses within 72 hours after the victim receives the relief. Under special circumstances, if the rescue cost exceeds 72 hours, the medical institution shall explain the reasons in writing. According to the specific accounting standards approved by the price department of the place where the motor vehicle road traffic accident occurred. Rescue expenses refer to the medical expenses incurred by medical institutions to take necessary treatment measures for the injured whose vital signs are unstable and stable, or will endanger their lives if they are not treated, or cause disability, organ dysfunction, or obviously prolong the course of disease, in accordance with the Guidelines for Clinical Diagnosis and Treatment of the Injured in Road Traffic Accidents.
