3. The liability insurance premium of schools in compulsory education stage is paid from the public funds per student. The liability insurance premium of schools in non-compulsory education stage and schools run by social forces shall be solved by the schools or school organizers themselves, and schools shall not charge students.
Legal basis:
Article 31 of the Measures for Handling Student Injury Accidents (implemented on June 25, 2002) stipulates that schools should participate in school liability insurance in accordance with the relevant provisions of the Insurance Law if conditions permit. The administrative department of education may, according to the actual situation, encourage students to participate in school liability insurance.
The Opinions of the Ministry of Education and other five departments on Improving the Handling Mechanism of Safety Accidents and Maintaining the Order of School Education and Teaching form a diversified compensation mechanism for school safety accidents. Schools or school operators shall take out school liability insurance according to regulations, and can purchase school liability insurance without fault and liability insurance in the fields of food safety, off-campus practice and sports injuries if conditions permit. It is necessary to raise funds through various channels such as financial subsidies and parents' sharing, promote the establishment of comprehensive school safety insurance, and increase security. It is necessary to enhance the insurance awareness of teachers, students and parents, and guide parents to buy life insurance for students, and subsidies can be given where conditions permit. Schools can guide and use social donation funds to set up safety risk funds or student relief funds, and improve the relief mechanism. Encourage qualified places to establish school safety compensation reserves, or carry out mutual aid programs to improve the compensation mechanism for school safety accidents.
