Legal analysis: the industry Committee has the right to use the maintenance fund. After the establishment of the owners' committee, the owners' committee has the right to decide to re-employ or renew the property management company. The owners' committee selects the property management company on behalf of the owners. The owners' committee may entrust the property management company to collect the maintenance fund approved by the owners' committee, set up a special account and keep it on its behalf. The owners' committee owns the ownership of the maintenance fund on behalf of all owners, and the property management company has no right to use the maintenance fund without authorization. Only the owners' committee held a meeting and decided to use the maintenance fund.
Legal basis: Article 18 of the Guiding Rules of Owners' Congress and Owners' Committee shall stipulate the following main items:
(a) the use, maintenance and management of the property;
(two) the collection, management and use of special maintenance funds;
(three) the operation and income distribution of this part of the property;
(four) to safeguard the interests of the owners;
(5) The owner * * * exercises the management right;
(six) the obligations of the owners;
(seven) responsibility for violation of management regulations.
