2. The term "construction enterprises" as mentioned in this implementation plan refers to construction general contracting enterprises, professional contracting enterprises and labor subcontracting enterprises that have the qualification of employing workers and are engaged in production and business activities such as civil construction, mechanical and electrical equipment installation, decoration (excluding residential decoration), pipeline laying, landscaping and municipal infrastructure.
3. The deposit for payment of wages of migrant workers shall be paid at 3% of the project contract cost. If the construction enterprise has not defaulted on the wages of migrant workers for three consecutive years, and has not violated the labor and employment management regulations and other illegal acts, it may pay the wage deposit of migrant workers according to 1% of the project contract cost.
4, migrant workers' wages to pay the deposit account special storage, special withdrawal, no unit or individual may misappropriate. The deposit for migrant workers' wages is mainly used to prevent construction enterprises from deducting and defaulting on migrant workers' wages.
Legal basis: Article 7 of the Regulations on Guaranteeing Wage Payment for Migrant Workers The administrative department of human resources and social security is responsible for ensuring the organization and coordination of wage payment for migrant workers, conducting management guidance, supervision and inspection on wage payment for migrant workers, and investigating cases of wage arrears for migrant workers.
Housing and urban and rural construction, transportation, water conservancy and other related industries, the competent department of engineering construction shall, in accordance with their duties, perform their duties of industry supervision, and supervise the cases of wage arrears of migrant workers caused by illegal contracting, subcontracting, illegal subcontracting, linking, and arrears of project funds.
The development and reform department is responsible for the examination and approval management of government investment projects according to its responsibilities, examines the sources of funds and financing methods of government investment projects according to law, arranges government investment in a timely manner according to regulations, strengthens the construction of social credit system, and organizes joint disciplinary targets for wage arrears and dishonesty of migrant workers according to laws and regulations to limit and punish them.
The financial department is responsible for the budget management of government investment funds, and timely and fully allocates government investment funds in accordance with the approved budget.
The public security organs are responsible for promptly accepting and investigating criminal cases suspected of refusing to pay labor remuneration, and handling social security cases caused by wage arrears of migrant workers according to law.
Judicial administration, natural resources, people's bank, auditing, state-owned assets management, taxation, market supervision, financial supervision and other departments shall, in accordance with their duties, do a good job in ensuring the payment of wages for migrant workers.
