Legal basis: Article 37 of the Regulations of the State on the Administration of Postgraduates Studying Abroad (Trial) violates the agreement, such as changing the country and status of studying abroad without authorization, voluntarily giving up the funding of the national study abroad fund and the status of studying abroad, unilaterally terminating the agreement, returning to China ahead of schedule without completing the study abroad plan, engaging in activities unrelated to study, seriously affecting study, performing particularly badly, studying abroad for more than three months (excluding), failing to return home within the prescribed time limit, and failing to complete the service period of returning home. The defaulting personnel shall compensate all the expenses funded by the study abroad fund and pay 30% of the liquidated damages. Failure to return to China within 3 months (inclusive) after the prescribed study abroad period constitutes a partial breach of contract. The defaulting personnel shall compensate 20% of the total expenses funded by the study abroad fund as liquidated damages. With the approval of the embassy or consulate, round-trip air tickets can still be provided. Those who arrive in China beyond the prescribed study period 1 month (inclusive) due to special reasons such as flights shall not be considered as breach of contract.
