The provincial administrative department of small and medium-sized enterprises is responsible for organizing the implementation of policies and plans for small and medium-sized enterprises, and comprehensively coordinating, guiding and serving the work of small and medium-sized enterprises in the province; Other relevant administrative departments shall provide guidance and services to the work of small and medium-sized enterprises within their respective functions and duties.
City, county (District) people's governments and their administrative departments responsible for the work of small and medium-sized enterprises and other relevant administrative departments shall provide guidance and services for small and medium-sized enterprises within their respective administrative areas within the scope of their respective duties. Article 4 The provincial statistical department shall, jointly with the provincial administrative department of small and medium-sized enterprises, establish and improve the statistical index system of small and medium-sized enterprises, formulate the statistical system of small and medium-sized enterprises, and accurately reflect the development and operation of small and medium-sized enterprises. Article 5 The legitimate rights and interests of small and medium-sized enterprises are protected by law, and no unit or individual may infringe upon them.
Small and medium-sized enterprises shall fulfill their obligations stipulated by laws and regulations, establish social credit and enhance their sense of social responsibility, and shall not harm the public interests and the legitimate rights and interests of employees. Chapter II Entrepreneurial Support Article 6 Small and medium-sized enterprises can equally enter industries and fields that are not explicitly prohibited by laws and administrative regulations and promised by the state to open to the outside world.
People's governments at all levels and relevant administrative departments shall protect the rights of small and medium-sized enterprises to participate in fair market competition according to law, and shall not set discriminatory market access conditions for small and medium-sized enterprises. Seventh people's governments at or above the county level and the relevant administrative departments shall, according to the overall land use planning and urban and rural construction planning, and according to the development needs of small and medium-sized enterprises, reasonably arrange the land for the development of small and medium-sized enterprises according to law. Eighth people's governments at or above the county level and the relevant administrative departments shall regularly announce to the public the relevant preferential tax policies of the state and the province to promote the development of small and medium-sized enterprises, and use the tax policies to encourage and support the establishment and development of small and medium-sized enterprises.
The following small and medium-sized enterprises that meet the requirements of national and provincial policies shall enjoy preferential taxes and fees within the time limit stipulated in the tax and fee policies:
(1) Small and medium-sized enterprises founded by unemployed people;
(two) small and medium-sized enterprises that absorbed unemployed people in that year and met the conditions stipulated by the state;
(three) high-tech small and medium-sized enterprises in line with the national and provincial policies to support and encourage development;
(4) Small and medium-sized enterprises established in minority areas and poverty-stricken areas;
(five) small and medium-sized enterprises that meet the requirements of the state for the placement of the disabled;
(six) other small and medium-sized enterprises that meet the policy requirements. Article 9 The people's governments at or above the county level and the relevant administrative departments shall, through the news media and websites, timely announce to the public policy information related to the development of small and medium-sized enterprises, such as industry and commerce, taxation, prices, financing, labor and social security, and provide consulting, information and guidance services for small and medium-sized enterprises and entrepreneurs. Article 10 Individuals or legal persons are encouraged to invest and set up small and medium-sized enterprises with intangible assets such as industrial property rights and non-patented technologies according to law.
If small and medium-sized enterprises are established by investing in intangible assets such as high-tech achievements and proprietary technology, the proportion of their investment can be determined by all investors through consultation within the scope prescribed by the state. Where small and medium-sized enterprises take the form of limited liability companies or joint stock limited companies, the provisions of the Company Law of People's Republic of China (PRC) and relevant laws and administrative regulations shall apply. Chapter III Financial Support Article 11 The provincial budget shall arrange special funds to support small and medium-sized enterprises. The people's governments at or above the county level shall, according to the actual situation, provide financial support for promoting the development of small and medium-sized enterprises. Twelfth special funds to support the development of small and medium-sized enterprises and related financial support funds are mainly used to support the technological innovation and technological transformation of small and medium-sized enterprises, the construction of credit guarantee system, the construction of service system, the matching of national small and medium-sized enterprise development fund and technological innovation fund for small and medium-sized enterprises. Article 13 Commercial banks, credit cooperatives and non-bank financial institutions shall, in accordance with the national credit policy, adjust the credit structure, innovate credit methods, improve the financing environment of small and medium-sized enterprises, improve the credit system of small and medium-sized enterprises, and provide credit, settlement, financial consultation and investment management services for small and medium-sized enterprises.
Commercial banks, credit cooperatives and non-bank financial institutions should give priority to providing credit support to high-tech achievements transformation and technological transformation projects of small and medium-sized enterprises that conform to the national industrial policy, have market development prospects, have high technology content and good economic benefits. Fourteenth people's governments at or above the county level and the relevant administrative departments shall develop and standardize the property rights trading market and promote capital flow and restructuring. Encourage, guide and support qualified small and medium-sized enterprises to directly finance through equity financing, project financing, bond financing, lease financing, domestic and overseas listing and intellectual property pledge.
The relevant administrative departments and securities institutions of the people's governments at or above the county level shall cultivate the listing resources of small and medium-sized enterprises and provide guidance and services for qualified small and medium-sized enterprises to raise funds and issue corporate bonds.
