Measures for Natural Disaster Relief in Gansu Province (revised in 2020)
Chapter I General Provisions Article 1 In order to standardize the natural disaster relief work, improve the natural disaster relief ability and ensure the basic livelihood of the affected people, these measures are formulated in accordance with the Regulations on Natural Disaster Relief of the State Council and relevant laws and regulations, and in combination with the actual situation of this province. Article 2 These Measures shall apply to natural disaster relief preparation, emergency rescue, post-disaster relief, money and materials management and social forces' participation in disaster relief within the administrative area of this province. Where laws and regulations have already provided for natural disaster relief, those provisions shall prevail.

The term "natural disaster relief" as mentioned in these Measures refers to the timely provision of necessary life assistance to those who have caused or may cause personal injury, property loss and production and life affected by natural disasters, so as to ensure their basic living needs such as food, drinking water, clothing, heating, safe shelter, medical treatment and epidemic prevention. Third natural disaster relief work follows the principles of people-oriented, government-led, graded responsibility, territorial management, social mutual assistance and self-help for victims. Article 4 The people's governments at or above the county level shall lead the natural disaster relief work within their respective administrative areas in a unified way, implement the administrative leadership responsibility system, and set up a disaster reduction committee as a comprehensive emergency coordination body of the government at the corresponding level to be responsible for organizing and coordinating the natural disaster relief work within their respective administrative areas.

The emergency management departments of the people's governments at or above the county level shall be responsible for the natural disaster relief work within their respective administrative areas and undertake the daily work of the disaster reduction committees at the corresponding levels.

The relevant departments of the people's governments at or above the county level shall, in accordance with their respective duties, do a good job in natural disaster relief within their respective administrative areas. Fifth Township People's governments (street offices) should do a good job in the specific implementation of natural disaster relief within their respective administrative areas. Village (neighborhood) committees organize village (neighborhood) people in their respective areas to carry out self-help and mutual rescue of natural disasters and assist in natural disaster relief according to law. Article 6 Social organizations such as the Red Cross, charities and public offering foundations shall assist the government to carry out natural disaster relief work according to law.

The government encourages and guides units and individuals to participate in natural disaster relief donations, voluntary services and other activities. Article 7 The people's governments at or above the county level shall incorporate natural disaster relief work into the national economic and social development plan, incorporate natural disaster relief funds, disaster relief materials procurement funds and natural disaster relief work funds into the fiscal budget at the corresponding level, and establish and improve a fund and material guarantee mechanism that is compatible with natural disaster relief needs and economic and social development level. Article 8 People's governments at or above the county level shall implement natural disaster relief through disaster emergency relief, transitional life relief, subsidies for housing restoration and reconstruction of residents damaged by disasters, temporary relief for living difficulties in drought, relief for living difficulties in winter and spring, and appeasement of families of victims.

The financial and emergency management departments of the provincial people's government shall, according to the relevant provisions of the state and the level of economic and social development of this province, formulate guidelines for natural disaster relief, and make timely adjustments according to factors such as economic and social development, financial growth and price changes. City (state) and county people's governments shall formulate specific implementation standards according to the guiding standards for natural disaster relief and local conditions. Article 9 People's governments at all levels shall establish and improve the popular science propaganda system for disaster prevention and mitigation, strengthen the construction of popular science propaganda and education bases, organize and carry out popular science propaganda activities for disaster prevention and mitigation, and improve citizens' awareness of disaster prevention and avoidance and their ability of self-help and mutual assistance.

Villagers' committees, residents' committees, enterprises and institutions shall, according to the arrangements of local people's governments and the needs of disaster prevention and mitigation, carry out publicity and popularization activities on emergency knowledge of disaster prevention and mitigation. Chapter II Disaster Relief Preparations Article 10 People's governments at or above the county level shall, in accordance with relevant laws and regulations, the emergency plans of the people's governments at higher levels and relevant departments, and in combination with the investigation of natural disaster risks within their respective administrative areas, formulate comprehensive disaster prevention and mitigation plans and special plans and organize their implementation, formulate and improve emergency plans for natural disaster relief, and organize emergency rescue drills for natural disasters every year. Article 11 The people's governments at or above the county level shall establish and improve the technical support system for emergency command of natural disaster relief and the information sharing platform for natural disasters, and form a fully functional and efficient emergency command system for natural disaster relief, equipped with necessary disaster relief equipment such as transportation, communication and disaster verification. Article 12 The people's governments at or above the county level shall establish and improve the standard system for disaster prevention and mitigation, and the urban and rural construction planning and major project construction shall meet the requirements of national and provincial standards for disaster prevention and mitigation, so as to improve the fortification level and disaster-bearing capacity of schools, hospitals, residents' housing and infrastructure in disaster-prone areas. Article 13 The people's governments of cities (prefectures) and disaster-prone counties shall consider the regional disaster characteristics, geographical conditions, population distribution, transportation and other conditions, and build disaster relief materials storage warehouses at the corresponding level, with management personnel, and set up disaster relief materials storage points in towns (streets) and urban and rural communities in disaster-prone areas with inconvenient transportation as appropriate.

People's governments at or above the county level shall implement the responsibility of graded storage of disaster relief materials, formulate and organize the implementation of disaster relief materials storage plans and annual procurement plans, reasonably determine the variety and quantity of reserve materials, reserve living materials and emergency rescue tools according to regional characteristics, and ensure the material demand during disaster emergency rescue. Fourteenth people's governments at or above the county level shall establish an emergency transportation guarantee mechanism for disaster relief materials. During the emergency rescue of disasters, measures such as opening special passages and implementing traffic control can be taken to ensure the priority transportation and passage of disaster relief personnel, materials, equipment and victims. With the approval of the provincial people's government, vehicles carrying out emergency rescue and disaster relief are exempt from vehicle tolls.
