Legal basis: Management Measures for Bidding of State-owned Capital Investment Projects in Jiangsu Province.

Article 1 In order to regulate the bidding activities of state-owned capital investment construction projects and protect the national interests, social interests and the legitimate rights and interests of the parties involved in bidding activities, these Measures are formulated in accordance with the Bidding Law of People's Republic of China (PRC) and the Regulations for the Implementation of the Bidding Law of People's Republic of China (PRC).

Article 2 Within the administrative region of this province, these Measures shall apply to the tendering and bidding activities of engineering construction projects in which state-owned funds occupy a controlling or leading position and meet the scope and scale standards that must be tendered according to law.

Article 3 The development and reform departments of local people's governments at or above the county level shall guide and coordinate the bidding work within their respective administrative areas, and the departments of housing and urban and rural construction, transportation, water conservancy, economy and informatization, commerce and other departments shall supervise the bidding activities according to the division of responsibilities.

The local people's governments at or above the county level may determine an administrative department to perform the unified supervision and management duties of bidding activities.

The administrative service institutions of the local people's governments at or above the county level shall, in accordance with the principle of optimizing services, strengthen the guidance of bidding services for state-owned capital investment construction projects within their respective administrative areas, strengthen on-site supervision, and improve service quality.

Fourth provincial and district people's governments shall establish a unified and standardized public resource trading center to provide services for the bidding activities of state-owned capital investment projects. The public resource trading center is not subordinate to the bidding administrative supervision department.

Article 5 Bidding activities shall be conducted through the public resource trading platform, and the whole process of bidding shall be electronic, so as to realize the information disclosure of bidding activities and accept public supervision.
