Chapter 1 General Provisions Article 1 These Measures are formulated in accordance with the Constitution in order to strengthen social assistance, protect citizens' basic lives, promote social fairness, and maintain social harmony and stability.
Article 2: The social assistance system adheres to the bottom line, emergency relief, sustainability, and is connected with other social security systems. The level of social assistance is consistent with the level of economic and social development.
Social assistance work should follow the principles of openness, fairness, impartiality and timeliness.
Article 3 The civil affairs department of the State Council shall coordinate the construction of the national social assistance system.
The civil affairs, health and family planning, education, housing and urban-rural development, human resources and social security departments of the State Council are responsible for the corresponding social assistance management work in accordance with their respective responsibilities.
The civil affairs, health and family planning, education, housing and urban-rural development, human resources and social security departments of local people's governments at or above the county level are responsible for the corresponding social assistance management within their respective administrative regions in accordance with their respective responsibilities.
The administrative departments listed in the first two paragraphs are collectively referred to as the social assistance management departments.
Article 4 Township people's governments and sub-district offices are responsible for the acceptance, investigation and review of applications for social assistance, and the specific work is undertaken by social assistance agencies or personnel.
Villagers’ committees and residents’ committees shall assist in relevant social assistance work.
Article 5 The people's governments at or above the county level shall incorporate social assistance into the national economic and social development plans, establish and improve the coordination mechanism for social assistance work under government leadership, civil affairs departments taking the lead, relevant departments cooperating, and social forces participating, and improve social assistance funds and material guarantees.
Mechanism to incorporate social assistance funds and social assistance work funds arranged by the government into the fiscal budget.
Social assistance funds are subject to special management, separate accounting, and earmarked funds. No unit or individual may misappropriate them.
The payment of social assistance funds shall be carried out in accordance with the relevant regulations on fiscal and treasury management.
Article 6 People's governments at or above the county level shall establish a social assistance management information system in accordance with the unified national plan to achieve social assistance information interconnection and resource sharing.
Article 7: The state encourages and supports social forces to participate in social assistance.
Article 8: Units and individuals that have made outstanding achievements in social assistance work shall be commended and rewarded in accordance with relevant national regulations.
Chapter 2 Minimum Living Security Article 9 The state provides minimum living security to families where the per capita income of the family members living together is lower than the local minimum living security standard and meets the local minimum living security family property status regulations.
Article 10 The minimum living security standard shall be determined and announced by the people's government of the province, autonomous region, municipality directly under the Central Government or city divided into districts based on the necessary living expenses of local residents, and shall be adjusted in a timely manner according to the local economic and social development level and price changes.
The methods for determining the income status and property status of households receiving minimum living security shall be formulated by the people's governments of provinces, autonomous regions, municipalities directly under the Central Government, or municipalities divided into districts in accordance with relevant national regulations.
Article 11 To apply for minimum living security, the following procedures should be followed: (1) Family members living together with *** submit a written application to the township people's government or sub-district office where the household registration is located; if family members have difficulty applying, they can entrust someone to

(2) Township people's governments and sub-district offices should investigate and verify the applicant's family income and property status through household surveys, neighborhood visits, letter requests, public comments, information verification, etc., and put forward preliminary opinions.
The village or community where the applicant is located will be publicized and submitted to the civil affairs department of the county-level people's government for review and approval.
(3) The civil affairs department of the people's government at the county level shall, after review, approve the application that meets the conditions and announce it in the applicant's village or community; it shall disapprove the application that does not meet the conditions and explain the reasons in writing to the applicant.
Article 12 For families approved to receive minimum living security, the civil affairs department of the people's government at the county level shall issue minimum living security payments on a monthly basis based on the difference between the per capita income of family members living in the same household below the local minimum living security standard.
For the elderly, minors, severely disabled people and seriously ill patients who still have difficulty living after receiving the minimum living allowance, local people's governments at or above the county level shall take necessary measures to provide living security.
Article 13 If the population status, income status, or property status of a household receiving minimum living allowance changes, the township people's government and sub-district office shall be notified in a timely manner.
The civil affairs departments of the people's governments at the county level, as well as the township people's governments and sub-district offices shall regularly check the population status, income status and property status of families receiving minimum living security.
If the population status, income status, and property status of the minimum living security family change, the civil affairs department of the people's government at the county level shall promptly decide to increase, reduce, or stop the payment of minimum living security funds; if it decides to stop the payment of minimum living security funds, it shall explain in writing
reason.
