What are the procedures for starting a private aviation club?
1. Authority: The General Administration of Civil Aviation of China (hereinafter referred to as CAAC) and the Regional Civil Aviation Administration are the authorities in charge of general aviation activities. Without the approval of the General Administration of Civil Aviation or the Regional Administration of Civil Aviation, no unit or individual may build general aviation enterprises or aviation clubs, purchase and lease civil aircraft to engage in general aviation business activities without authorization.

Those engaged in non-operating general aviation shall register with the competent civil aviation authority of the State Council. Engaged in general aviation business, it shall apply to the competent civil aviation authority of the State Council for general aviation business license, and handle industrial and commercial registration according to law; Without obtaining a business license, the administrative department for industry and commerce shall not apply for industrial and commercial registration.

Two, to obtain a general aviation business license, should have the basic conditions:

(1) The established general aviation enterprise must be an enterprise legal person, and its legal representative is a citizen of China;

(two) the main person in charge of the enterprise shall have the corresponding aviation professional knowledge. The person in charge of flight and operation technology and quality should not only have the corresponding aviation professional knowledge, but also work in the aviation department or professional field for more than three years, and have certain organizational management experience;

(3) The registered capital of an enterprise or aviation club shall meet the requirements of national laws and administrative regulations;

(4) Enterprises or aviation clubs operating different types of general aviation projects shall meet the minimum requirements for purchasing aircraft (including special facilities and equipment for air operations): (5) Having more than two civil aircraft registered in People's Republic of China (PRC) and meeting the airworthiness standards;

(6) Having aircrew members who are suitable for civil aircraft, have received professional training, obtained licenses or training certificates and have the required conditions;

(7) Having a base airport suitable for civil aircraft and its corresponding infrastructure;

(eight) facilities and equipment that are suitable for the business project and meet the requirements of business quality;

(9) Other conditions deemed necessary by CAAC.

Three, the implementation of the general aviation business license includes two stages:

General aviation enterprises applying for the preparation of Class A business projects shall put forward their opinions in the preliminary examination by the local regional civil aviation administration and report to the General Administration of Civil Aviation for approval. Applications for the establishment of general aviation enterprises and aviation clubs with B and C business projects shall be examined and approved by the local regional civil aviation administration and reported to the General Administration of Civil Aviation for the record.

To establish a general aviation enterprise or aviation club: the applicant shall submit the application materials for establishment in triplicate to the regional civil aviation administration in the prescribed format, and declare in writing that the materials are authentic and effective. The application materials for preparation shall include:

(1) Application for preparation;

(two) to prepare a feasibility study report, which includes:

1, general aviation market demand in the region;

2. The feasibility of the project to be operated and the corresponding facilities and equipment such as the model, business area and base airport;

3. Sources and training channels of aviation personnel;

4. Reliability of operation technical quality;

5. Forecast and analysis of economic benefits;

(three) the qualification list and identity certificate of the person in charge of the preparation;

(4) Where two or more investors contribute to the preparation, an agreement and contract signed by the shareholders shall be provided. If the investor is an enterprise, provide a copy of the business license, and if the investor is a natural person, provide identification;

(5) When there is foreign investment, the applicant shall go through the examination and approval procedures for the project proposal and feasibility study report in accordance with the provisions on foreign investment in the civil aviation industry, and provide the corresponding approval documents.

The regional civil aviation administration shall, within 20 days, submit the preliminary examination opinions and all application materials directly to the CAAC to apply for the establishment of a general aviation enterprise with Class A business projects. After receiving the relevant preparation materials, the Civil Aviation Administration shall conduct an audit in accordance with the prescribed conditions. If it meets the requirements, CAAC will make a decision to approve the preparation within 20 days after accepting the application, and notify the applicant in the form of "Notice of Approval of Preparation". Do not meet the conditions, it shall notify the applicant in writing within 05 days from the date of making the decision not to approve the preparation, explain the reasons, and inform the applicant of the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.

The regional civil aviation administration shall, after receiving the applications of general aviation enterprises and aviation club applicants for the preparation of Class B and Class C business projects, review them in accordance with the prescribed conditions. If it meets the requirements, it shall make a decision to approve the preparation within 20 days after accepting the application, and notify the applicant in the form of Notice of Approval of Preparation. Do not meet the conditions, it shall notify the applicant in writing within 05 days from the date of making the decision not to approve the preparation, explain the reasons, and inform the applicant of the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.

The General Administration of Civil Aviation and the Regional Administration of Civil Aviation shall announce the approved general aviation enterprises in the relevant media. Applicants who have been approved for the preparation of the project will lose their qualification if they fail to obtain a business license within two years from the date of approval. If the qualification for preparation is lost, CAAC or CAAC will no longer accept the application of the original applicant within two years.

Work carried out by the applicant who has obtained the construction permit:

(1) Handling the declaration procedures for purchasing civil aircraft;

(2) Applying for the nationality registration certificate, airworthiness certificate and enterprise logo of civil aircraft;

(three) to apply for the relevant aviation personnel license or training certificate;

(4) applying for an airborne radio station license;

(five) the ground third party liability insurance;

(six) to draft a sample operation service contract and operation service price;

(seven) to apply for the airport use permit of the self-built base airport or to sign an airport road protection agreement with the airport used;

(eight) signed with the relevant units of communication, meteorology, navigation information service guarantee agreement or agency letter of intent;

(nine) in accordance with the relevant provisions of the General Administration of Civil Aviation, prepare the following manuals:

1, operation manual; 2. Quality manual; 3, airport runway support manual; 4, aviation safety management manual; 5. Safety plan; 6. Other necessary relevant documents and manuals.

Foreign investors who invest in general aviation enterprises shall also apply for the approval documents of contracts and articles of association and the approval certificate of foreign-invested enterprises in accordance with the provisions on foreign investment in civil aviation industry.

Four, apply for a general aviation business license:

After the preparatory work is completed, the applicant shall apply to the Regional Administration of Civil Aviation for a general aviation business license (hereinafter referred to as the business license) in the prescribed format, and submit the application materials in triplicate, with a written statement to ensure the authenticity and validity of the materials. The application materials shall include:

(1) An application for the general aviation business license and a report on the preparatory work;

(two) a copy of the notice of pre-approval of the enterprise name issued by the administrative department for industry and commerce where the enterprise is located;

(3) Enterprise logo and approval documents approved by CAAC;

(4) Articles of association of the enterprise;

(five) the approval documents for approving the purchase;

(6) Civil aircraft nationality registration certificate, airworthiness certificate and airborne radio station license;

(seven) a copy of the relevant aviation personnel license or training certificate;

(eight) the airport use license of the self-built base airport or the airport road protection agreement signed with the airport;

(nine) the legal representative and the person in charge of operation, the person in charge of flight and operation technology and quality and their identity certificates;

(10) A capital verification certificate issued by a legally qualified capital verification institution;

(eleven) if the company is a limited liability company or a joint stock limited liability company, it shall also submit documents indicating the names and residences of the company's directors, supervisors and managers, as well as certificates of appointment, election or employment; If the investor is an enterprise, provide a copy of the business license, and if the investor is a natural person, provide identification;

(twelve) the third party liability insurance certificate on the ground;

(thirteen) operation service contract (sample) and operation service price list;

(fourteen) approved or recognized enterprise operation manual, enterprise quality manual, airport runway guarantee manual, aviation safety management manual and security plan.

Foreign investors investing in general aviation enterprises shall also provide the approval documents of contracts and articles of association and the approval certificate of foreign-invested enterprises.

For general aviation enterprises or aviation clubs that apply for B and C business projects, the Regional Civil Aviation Administration will issue business licenses within 20 days from the date of acceptance after reviewing the application materials and preparations submitted by the applicants. If it does not meet the business license conditions, it shall make a decision not to issue the business license according to law, but it shall notify the applicant in writing within 05 days from the date of making the decision, explain the reasons, and inform the applicant of the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.

For general aviation enterprises applying for Class A business projects, the regional civil aviation administration shall, within 20 days from the date of receiving all the application materials submitted by the applicant, put forward preliminary examination opinions and submit them to the General Administration of Civil Aviation together with all the application materials. The Civil Aviation Administration shall, within 20 days from the date of receiving the preliminary examination opinions and materials submitted by the regional civil aviation administration, make a decision on whether to approve the applicant's business license. To meet the conditions of business license, issue a business license; For those who do not meet the business license conditions, a decision shall be made not to issue the business license according to law, but the applicant shall be notified in writing within 15 days from the date of making the decision, explaining the reasons and informing the applicant that he has the right to apply for administrative reconsideration or bring an administrative lawsuit according to law.

5. Business license: the validity period is three years, and the contents shall be specified: license number, enterprise name, enterprise address, base airport, enterprise category, registered capital, amount of self-owned funds for aircraft purchase, legal representative, business items and scope, validity period, date of issuance, and seal of the licensing authority;

An applicant who has obtained a business license shall apply for industrial and commercial registration to the local administrative department for industry and commerce with the business license issued by the General Administration of Civil Aviation or the Regional Administration of Civil Aviation, and send a copy of the license to the General Administration of Civil Aviation and the Regional Administration of Civil Aviation for the record within 20 days from the date of obtaining the business license of an enterprise as a legal person. An applicant who has obtained a business license shall complete the examination and approval of business qualification in accordance with the relevant provisions of civil aviation.
