Legal basis: Article 12 of the Trial Measures for the Management of Social Assistance Fund for Road Traffic Accidents, under any of the following circumstances, the assistance fund shall advance the funeral expenses and part or all of the rescue expenses of the victims of road traffic accidents: (1) The rescue expenses exceed the compulsory insurance liability limit; (two) the motor vehicle did not participate in compulsory insurance; (3) A motor vehicle escapes after an accident. In accordance with the law, if part or all of the funeral expenses or rescue expenses of the victim should be paid by the relief fund, the relief fund management institution in the place where the road traffic accident occurred should pay it in time. The relief fund generally pays the victim's relief expenses within 72 hours after receiving the relief. Under special circumstances, if the rescue cost exceeds 72 hours, the medical institution shall explain the reasons in writing.
