Black intermediaries in Torch District of Zhongshan City were "encircled"
Yesterday morning, a joint law enforcement team composed of the Torch District Human Resources and Social Security Bureau and local public security, urban management, industry and commerce departments went to the job introduction street on Torch Road to carry out special rectification actions. During the operation, we investigated and dealt with the "Tong Ling Employment Agency" (hereinafter referred to as "Tong Ling Employment Agency") reported by this newspaper, and ordered the person in charge of the agency to refund the illegal referral fee to the job seekers, and collected a batch of documents and materials of the agency for investigation and evidence collection.
Job seekers gathered at the employment agency to discuss a statement.
Yesterday morning 10, according to the reporter's earlier report, the Human Resources and Social Security Bureau of Torch Development Zone, together with the public security, urban management, industry and commerce departments, went to Torch Road Employment Market Street to carry out special inspections. During the inspection, Mr. Niu and other migrant workers reported to the law enforcement team on the spot that the employment agency charged him 600 yuan's referral fee on February 22, but a week later, he never received the interview notice and no one answered his phone call. "I suspect that I have been cheated." Mr. Niu said.
According to Mr. Niu's clue, the joint law enforcement team immediately went to the employment agency and found that more than 30 job seekers gathered at the scene. Without exception, they said that they had paid hundreds of yuan to the employment agency in Tong Ling last week.
At the scene, the joint law enforcement team asked each job seeker to write down the process and amount of the referral fee he paid to the Tong Ling Employment Agency, and then stamped them one by one to confirm, and ordered the person in charge of the Tong Ling Employment Agency to return the money to the job seeker who had paid the fee but failed to find a job.
Prompted by Xu Jianmin, deputy director of the Human Resources and Social Security Bureau of Torch Development Zone, the reporter noticed that the receipts issued by Tong Ling Employment Agency to job seekers are very tricky. Receipts with an amount between 20 yuan and 30 yuan will be stamped with the company's special business seal, but receipts beyond this range, such as bills with charges as high as 300 yuan to 600 yuan, will not be stamped with the company's special business seal. Xu Jianmin said that by operating separately in this way, the employment agency could not take the receipt as valid evidence to avoid "risks".
Yesterday, the reporter learned from the Human Resources and Social Security Bureau of Torch Development Zone that under the supervision of the joint law enforcement team, 73 job seekers received refunds yesterday, involving an amount of 17450 yuan, and some job seekers were temporarily unable to refund due to incomplete bills.
The most lacking evidence in investigating illegal employment agencies.
Chen Huaren, captain of the Labor Security Supervision Detachment of the Municipal People's Social Security Bureau, said that in the past inspection and law enforcement processes, employment agencies were able to produce documents and materials that met relevant laws and regulations when they were inspected, so it was difficult to prove whether there were violations.
When asked whether law enforcement agencies can collect evidence through unannounced visits, Chen Huaren said that according to relevant laws and regulations, law enforcement agencies cannot conduct fishing law enforcement or collect evidence through unannounced visits, and only informants can provide valid evidence. However, due to the weak awareness of protecting their legitimate rights and interests in the process of job hunting, many job seekers often lack effective information such as the official seal of the charging unit after payment, which leads to the lack of legal effect of these receipts as evidence and is very difficult to investigate.
He said that there are still many imperfect laws and regulations on the supervision of employment agencies, and he hopes to further explore and deepen this so that they can better enforce the law and investigate and deal with illegal employment agencies according to law.
Two major "crimes" of black intermediary
One crime: illegal collection of referral fees
In the process of law enforcement, Xu Jianmin said that the introduction fee charged by Tong Ling Employment Agency has exceeded the relevant standards of Zhongshan Price Bureau, which is definitely illegal. As for the specific disposal methods, it is necessary for the joint law enforcement team to take the materials away for investigation and handling.
Two crimes: unauthorized recruitment
According to the verification of the joint law enforcement team, Canon, Casio and other enterprises have not authorized the Tong Ling Employment Agency to recruit employees for themselves. As for the Tong Ling Employment Agency's claim to job seekers that it is recruiting employees for the above-mentioned enterprises, Xu Jianmin said that it is deceptive and needs to be verified before it can be handled.
Reminder: Pay the introduction fee and ask the other party to issue a valid bill.
Feng Xuan, director of the Human Resources and Social Security Bureau of Torch Development Zone, reminded that according to the relevant regulations of Guangdong Province, the highest agency fee for job seekers who successfully introduced general workers is 150 yuan. When paying the fee, the job seeker should ask the intermediary to provide the bill in advance, confirm whether the amount and official seal are in line with the actual situation, and keep the bill well. If there is any problem, it should be reported to the local human resources and social security bureau and the price department in time.
The reporter was informed that if the legitimate rights and interests of job seekers are damaged when applying for a job in Torch Development Zone, they can call the Comprehensive Management and Stability Center of Torch Development Zone at 0760-85339767 for help.
Note: Help migrant workers to protect themselves by popularizing the law.
The reporter learned that almost 80% of these job seekers were born after 1990, and they are not deeply involved in the world. After paying the money, they didn't pay attention to whether the bills issued by the employment agency were stamped with the official seal, and they didn't know the standards that the employment agency allowed to charge according to the regulations. The information they usually get is often a few words between fellow villagers, classmates or friends, or a description from an employment agency. For them, besides needing a good job at this stage, how to protect their legitimate rights and interests from infringement may be more urgent. Therefore, the relevant departments should popularize more legal knowledge to these migrant workers so that they can fundamentally protect themselves.
