Chapter I, General Provisions

Article 3 The National Natural Science Fund is mainly funded by the central finance. The central finance will include the funds of the National Natural Science Foundation in the budget. Article 4 The funding work of the National Natural Science Foundation follows the principles of openness, fairness and justice, and implements the principles of respecting science, promoting democracy, advocating competition, promoting cooperation, encouraging innovation and leading the future. Chapter II, Organization and Planning

Article 7 A fund management institution shall formulate a fund development plan and an annual fund project guide according to the national economic and social development plan, the scientific and technological development plan and the scientific and technological development situation. The fund development plan shall specify the priority development areas, and the annual fund project guide shall specify the priority support project scope. The National Natural Science Foundation of China has set up special funds to train young scientific and technical talents. When formulating the fund development plan and the annual fund project guide, the fund management institution shall widely listen to the opinions of institutions of higher learning, scientific research institutions, academic groups and relevant state organs and enterprises, and organize relevant experts to conduct scientific argumentation. The annual fund project guide shall be published 30 days before the start of accepting applications for fund-funded projects. Article 8 Institutions of higher learning, scientific research institutions and other public welfare institutions with independent legal personality that carry out basic research in People's Republic of China (PRC) can be registered as supporting units in the fund management institutions. Before the implementation of these regulations, the fund management institution shall be registered as a supporting unit. The fund management institution shall publish the name of the supporting unit registered. Article 9 Supporting units shall perform the following duties in the management of fund support: (1) Organizing applicants to apply for the support of the National Natural Science Foundation; (two) the authenticity of the materials submitted by the applicant or the project leader; (three) to provide conditions for the implementation of the project funded by the fund, and to ensure the time for the project leader and participants to implement the project funded by the fund; (4) Tracking the implementation of projects funded by the Fund and supervising the use of funds funded by the Fund; (five) to cooperate with the fund management institutions to supervise and inspect the implementation of the projects funded by the fund. The fund management institution shall guide and supervise the management of fund support by the supporting units.

Chapter III Application and Examination

Article 10 Scientific and technical personnel of supporting units may apply for the support of the National Natural Science Foundation if they meet the following conditions: (1) They have undertaken basic research projects or have other basic research experiences; (two) two scientific and technical personnel with senior professional and technical positions (titles) or doctoral degrees, or with senior professional and technical positions (titles) in the same research field. Scientific and technical personnel engaged in basic research who meet the conditions specified in the preceding paragraph, have no work units or work units that are not supporting units, may apply for funding from the National Natural Science Foundation in accordance with the provisions of these Regulations after consultation with the supporting units registered in the fund management institutions and with the consent of the supporting units. Relying units shall regard them as scientific and technological personnel of their own units and implement effective management in accordance with the provisions of these regulations. The applicant shall be the person in charge of the project funded by the application fund. Article 11 An applicant applying for the support of the National Natural Science Foundation shall determine the research project according to the annual fund project guide, and submit a written application to the fund management institution through the supporting unit within the prescribed time limit. When applying for the support of the National Natural Science Foundation of China, the applicant shall submit materials that prove that the applicant meets the conditions stipulated in Article 10 of these regulations; If the annual fund project guide has special requirements for the applicant, the applicant shall also submit supporting materials that meet the requirements. If the research content of the project for which the applicant applies for fund support has obtained other funding, the funding situation shall be explained in the application materials. The applicant shall be responsible for the authenticity of the application materials submitted. Article 12 The fund management institution shall complete the preliminary examination of the application materials within 45 days from the deadline for applying for fund-funded projects. In accordance with the provisions of these regulations, it shall be accepted, and the basic information of the applicant and the name of the supporting unit and the name of the project applying for fund support shall be announced. In any of the following circumstances, it will not be accepted, and the applicant will be notified in writing through the supporting unit, explaining the reasons: (1) the applicant does not meet the conditions stipulated in these regulations; (two) the application materials do not meet the requirements of the annual fund project guide; (3) The number of funded projects applied by the applicant exceeds the number stipulated by the fund management institution. Article 13 A fund management institution shall employ peer experts with high academic level and good professional ethics to review the applications for fund-funded projects. The specific measures for hiring evaluation experts shall be formulated by the fund management institution. Article 14 The fund management institution shall first randomly select more than 3 experts from the peer expert database for communication review, and then organize experts to conduct meeting review; Due to the special needs of national economic and social development or other special circumstances, the temporary application for fund-funded projects can only be reviewed by communication or meeting. If the evaluation experts think it is difficult to make academic judgment or have no energy to evaluate the application for fund-funded projects arranged by the fund management institution, they shall promptly inform the fund management institution; The fund management institution shall, in accordance with the provisions of these regulations, select other evaluation experts for evaluation. Fifteenth evaluation experts shall independently judge and evaluate the application for funded projects from the aspects of scientific value, innovation, social impact and feasibility of the research scheme, and put forward evaluation opinions. The evaluation experts shall put forward evaluation opinions on the application of fund-supported projects, and shall also consider the research experience of the applicant and the participants, the rationality of the use plan of fund-supported funds, the fact that the research content has obtained other funds, the fact that the applicant has implemented the fund-supported projects and the necessity of continuing funding. The review opinions put forward by the meeting review shall be voted. Article 16 Most experts in communication review think that it should not be funded, but the projects that apply for funding from the Innovation Fund can be reviewed at the meeting after being signed by two experts attending the meeting. However, except for the temporary application for fund-supported projects due to special needs or special circumstances as stipulated in Article 14 of these regulations. The fund management institution shall publish the recommendation opinions of the evaluation experts. Article 17 The fund management institution shall decide the research projects to be funded according to the provisions of these Regulations and the evaluation opinions put forward by experts. The fund management institution shall not deny the evaluation opinions of experts on the grounds that they are different from the academic opinions of the evaluation experts. If the fund management institution decides to grant funding, it shall promptly notify the applicant and the supporting unit in writing, and announce the basic information of the applicant, the name of the supporting unit, the name of the project to be funded and the amount to be funded. If it decides not to grant funding, it shall promptly notify the applicant and the supporting unit in writing and explain the reasons. The fund management institution shall sort out the expert review opinions and provide them to the applicant. Article 18 If an applicant refuses to accept the decision made by the fund management institution not to accept or grant funding, he may submit a written review request to the fund management institution within 05 days from the date of receiving the notice. If there are different opinions on the academic judgment of the evaluation experts, it shall not be used as a reason for requesting a review. The fund management institution shall complete the examination of the applicant's application within 60 days from the date of receiving the application. If the original decision is considered to be in compliance with the provisions of these regulations, it shall be maintained and the applicant shall be notified in writing; If the original decision is not in conformity with the provisions of these Regulations, the original decision shall be revoked, and the applicant's fund-funded project shall apply to organize the review experts to re-evaluate and make a decision, and notify the applicant and the supporting unit in writing. Article 19 In the evaluation of fund-funded projects, the staff and evaluation experts of the fund management institution shall apply for withdrawal under any of the following circumstances: (1) The staff and evaluation experts of the fund management institution are close relatives of the applicant and participants, or have other relations with the applicant and participants that may affect the fair evaluation; (2) The funded projects applied by the evaluation experts themselves are the same as or similar to those applied by the applicants; (3) The evaluation experts belong to the same legal entity as the applicants and participants. According to the application, the fund management institution makes a decision on whether to withdraw after examination; You can also make an exit decision directly without applying. Applicants for funded projects can provide the fund management institution with a list of no more than 3 experts who are not suitable for evaluating their applications, and the fund management institution will consider the selection of experts according to the actual situation. Article 20 The staff of a fund management institution shall not apply for or participate in the support of the National Natural Science Foundation, and shall not interfere with the evaluation work of evaluation experts. The staff of fund management institutions and evaluation experts shall not disclose the basic information, evaluation opinions, evaluation results and other information related to the evaluation of undisclosed evaluation experts.

Chapter IV, Funding and Implementation

Article 21 The supporting unit and the person in charge of the project shall, within 20 days from the date of receiving the notice of fund support from the fund management institution, fill in the project plan according to the evaluation opinions of the evaluation experts and the amount of fund support determined by the fund management institution, and report it to the fund management institution for approval. Relying on the unit and the person in charge of the project to fill in the project plan, the content of the application submitted shall not be changed except according to the evaluation opinions of the evaluation experts and the amount of fund support determined by the fund management institution. Twenty-second fund management institutions shall, in accordance with the "Budget Law of the People's Republic of China" and the relevant provisions of the state, timely apply to the financial department of the State Council for the budget allocation of fund-funded projects. However, except for the temporary projects funded by the fund as stipulated in Article 14 of these regulations due to special needs or special circumstances. The supporting unit shall notify the fund management institution and the project leader within 7 days from the date of receiving the funds. The person in charge of the project shall use the funds funded by the fund according to the requirements of the project plan, and the supporting unit shall supervise the use of the funds funded by the project leader. The person in charge of the project and the supporting unit shall not occupy or misappropriate the funds funded by the fund in any way. The specific measures for the administration of the use of funds funded by the fund shall be formulated by the financial department of the State Council in conjunction with the fund management institution. Article 23 The person in charge of the project shall organize and carry out research work according to the project plan, make original records of the implementation of the projects funded by the fund, and submit the annual progress report of the project to the fund management institution through the supporting unit. The supporting unit shall review the annual progress report of the project, check the original records of the implementation of fund-funded projects, and submit the annual fund-funded project management report to the fund management institution. The fund management institution shall review the annual progress report of the project and the annual fund-funded project management report. Twenty-fourth in the implementation of fund-funded projects, the supporting unit shall not change the person in charge of the project without authorization. The person in charge of the project is under any of the following circumstances, and the supporting unit shall timely put forward an application for changing the person in charge of the project or terminating the implementation of the project funded by the fund, and report it to the fund management institution for approval; The fund management institution can also directly make a decision to terminate the implementation of the fund-funded projects: (1) No longer rely on the scientific and technological personnel of the unit; (two) can not continue to carry out research work; (3) plagiarizing other people's scientific research achievements or practicing fraud in scientific research. If the person in charge of the project is transferred to another supporting unit, the supporting unit and the original supporting unit shall reach an agreement through consultation, and the original supporting unit shall put forward an application for changing the supporting unit and report it to the fund management institution for approval. If no consensus is reached through consultation, the fund management institution shall make a decision to terminate the implementation of the project funded by the fund. Twenty-fifth fund-funded projects in the implementation process, the research content or research plan needs to be significantly adjusted, the person in charge of the project shall timely apply, and the supporting unit shall report to the fund management institution for approval. Twenty-sixth within 60 days from the date of the expiration of the funded project, the person in charge of the project shall submit a closing report to the fund management institution through the supporting unit; If the funded project has achieved research results, it shall also submit a report on the research results. The supporting unit shall review the closing report and establish the archives of fund-funded projects. Relying on the audit report of the unit, we should check the original records of the implementation of the fund-funded projects. Article 27 The fund management institution shall timely review the transaction report. Do not meet the requirements of the conclusion, it shall put forward opinions, and notify the supporting units and project leaders in writing. The fund management institution shall publish the closing report, research report and application summary of the fund-funded projects, and collect public opinions. Twenty-eighth published research results of funded projects, should indicate the national natural science fund.

Chapter V Supervision and Administration

Twenty-ninth fund management institutions shall conduct spot checks on the implementation of fund-funded projects and the performance of duties by supporting units, and shall check the original records of the implementation of fund-funded projects during spot checks. The results of spot checks shall be recorded and published for public inspection. The fund management institution shall establish the credit files of the project leaders and supporting units. Thirtieth fund management institutions shall regularly evaluate the performance of evaluation experts; According to the evaluation results, establish the reputation files of bid evaluation experts; Experts who plagiarize other people's scientific research achievements or cheat in scientific research will no longer be employed. Thirty-first fund management institutions shall, at the end of each fiscal year, announce the projects funded by the fund this year, the disbursement of funds funded by the fund and the penalties for violations of these regulations. The fund management institution shall regularly evaluate the fund support work, issue an evaluation report, and take the evaluation report as the basis for formulating the fund development plan and the annual fund project guide. Thirty-second experts to review the fund-funded projects applied by the applicant, the applicant can put forward opinions on the expert review work to the fund management institution; The fund management institution shall refer to the opinions of the applicant when evaluating the performance of the evaluation duties by the evaluation experts. Any unit or individual may report or accuse the fund management institution and its staff, evaluation experts, supporting units, personnel responsible for the management of fund-funded projects, applicants or project leaders and participants who violate the provisions of these Regulations. The fund management institution shall publish the contact telephone number, mailing address and e-mail. Thirty-third fund management institutions in accordance with the regulations to disclose relevant information, should abide by the relevant state confidentiality provisions.

Chapter VI, Legal Liability

Article 34 Where an applicant or participant forges or alters the application materials, the fund management institution shall give it a warning; If the application project has been funded, the original funding decision shall be revoked and the allocated funds shall be recovered; If the circumstances are serious, it is not allowed to apply for or participate in the application for funding from the National Natural Science Foundation within 3 to 5 years, and it is not allowed to be promoted to professional and technical positions (titles). Thirty-fifth project leaders and participants in violation of the provisions of these regulations, one of the following acts, given a warning by the fund management institutions, suspend the allocation of funds from the fund, and ordered to make corrections within a time limit; If no correction is made within the time limit, the original appropriation decision shall be revoked and the allocated fund funds shall be recovered; If the circumstances are serious, you may not apply for or participate in the application for funding from the National Natural Science Foundation within 5 to 7 years: (1) Do not carry out research according to the project plan; (2) changing the research content or research plan without authorization; (three) failing to submit the annual progress report, conclusion report or research report of the project in accordance with the provisions of these regulations; (4) submitting false reports, original records or related materials; (5) Embezzling or misappropriating funds. The person in charge of the project and the participants have the acts listed in Items (4) and (5) of the preceding paragraph, and if the circumstances are serious, they shall not be promoted to professional and technical positions (titles) within 5 to 7 years. Thirty-sixth supporting units in any of the following circumstances, given a warning by the fund management institution, ordered to make corrections within a time limit; If the circumstances are serious, informed criticism shall not be used as a supporting unit for 3 to 5 years: (1) failing to perform the duties of research conditions for projects funded by the security fund; (2) Failing to examine the authenticity of the materials or reports submitted by the applicant or the project leader; (3) Failing to submit the annual progress report, annual fund-funded project management report, concluding report and research report in accordance with the provisions of these Regulations; (four) conniving or shielding the applicant or the person in charge of the project from practicing fraud; (five) to change the person in charge of the project without authorization; (six) do not cooperate with the fund management institutions to supervise and inspect the projects funded by the fund; (seven) interception, misappropriation of funds. Thirty-seventh experts have one of the following acts, the fund management institution shall give a warning and order them to make corrections within a time limit; If the circumstances are serious, informed criticism and the fund management institution may not employ him as an evaluation expert again: (1) failing to perform the evaluation duties stipulated by the fund management institution; (2) Failing to apply for withdrawal in accordance with the provisions of these Regulations; (three) disclosure of unpublished information related to the review; (four) an application for unfair evaluation of the projects funded by the fund; (five) the use of work convenience to seek illegitimate interests. Article 38 Any staff member of a fund management institution who commits any of the following acts shall be punished according to law: (1) Failing to apply for withdrawal in accordance with the provisions of these Regulations; (two) disclosure of unpublished information related to the review; (3) Interfering with expert evaluation; (four) the use of work convenience to seek illegitimate interests. Article 39 Whoever, in violation of the provisions of these Regulations, commits any of the following acts, which constitutes a crime, shall be investigated for criminal responsibility according to law: (1) embezzling or misappropriating fund funds; (two) the staff of the fund management institution and the evaluation experts perform their duties as stipulated in these regulations, and ask for or illegally accept other people's property or seek other illegitimate interests; (three) the applicant or the person in charge of the project or the participants forged or altered the official documents and certificates of the state organs or forged or altered the seals; (four) the applicant or the person in charge of the project, participants, supporting units, fund-funded project managers to seek illegitimate interests, giving property to the staff of the fund management institutions, evaluation experts; (5) divulging state secrets. If the applicant or project leader or participant is subject to criminal punishment for the acts specified in the preceding paragraph, he shall not apply for or participate in the support of the National Natural Science Foundation for life. Fortieth whoever violates the provisions of relevant financial laws and administrative regulations and should be punished shall be punished in accordance with the provisions of relevant laws and administrative regulations.

Chapter VII Supplementary Provisions

Forty-first research projects that have been decided to be funded before the implementation of these regulations shall be implemented in accordance with the relevant provisions of the state at the time of making the decision. Forty-second fund management institutions involved in the use and management of project organization and implementation fees, basic research-related academic exchange activities, and basic research environment construction activities in the fund support work shall be implemented in accordance with the relevant provisions of the the State Council Municipal Finance Department. Article 43 These Regulations shall come into force as of April 6, 2007.
