The legal basis for the compensation standards and objects of compensation for requisitioned forest land is:
(1) Forest compensation fee
1. Shelter forest: The investment in the whole process of afforestation and cultivation (fertilization management, pest control, forest protection and fire prevention, etc., the same below) plus the added value of forest trees or the requisitioned , calculation of the actual value of the forest trees on the forest land at the time of occupation. The tentative fee for afforestation is 1,000 yuan per mu in the current year, and will be increased by 500 to 800 yuan for each additional year.
2. Timber forest: the same as protective forest.
3. Economic forests (orchards, mulberry orchards, the same below) and bamboo forests: calculated based on the investment in the whole process of afforestation and cultivation plus added value or three to five times the average output value per mu in the three years before expropriation and occupation. It is tentatively estimated that the price per mu will be 1,500-5,000 yuan before production and 5,000-30,000 yuan per mu after production.
4. Special-purpose forests (including national defense forests, experimental forests, parent forests, environmental protection forests, scenic forests, scenic spots and historic sites forests, memorial forests, nature reserve forests and rare tree species forests, the same below): The calculation shall be based on two to three times the forest compensation fee for the protection forest or the actual value at the time of expropriation or occupation. It is tentatively determined that the cost of afforestation is 2,000 to 3,000 yuan per mu in the current year, and will be increased by 1,000 to 2,400 yuan for each additional year thereafter.
5. Seedlings: calculated based on the average output value per mu in the year of requisition and occupation or the previous three years. Tentatively, the compensation fee for general timber saplings is 1,500-2,000 yuan per mu for one-year seedlings, 2,500-3,000 yuan per mu for biennial seedlings, and 3,500-6,000 yuan per mu for three-year-old and above seedlings. Precious evergreen saplings are compensated at two to five times the forestry compensation fee for general timber saplings. Calculated or negotiated by both parties.
6. "Surrounding" forests: Calculated based on the investment in the entire process of planting and cultivating trees plus added value. Tentatively, the compensation fee for general timber trees is 5 yuan per tree in the year of planting, and will be increased by 3 to 5 yuan for each additional year. For precious evergreen trees, the forest compensation fee for general timber trees will be calculated at two to five times the compensation fee for general timber trees, or it can be negotiated by both parties.
Small attachments other than forest trees and seedlings, building facilities, etc. on the forest land shall be calculated separately according to relevant regulations.
(2) Forest vegetation restoration fee
Tentatively set at 30,000 yuan per mu, exempt from the reclamation fund. Units that requisition or occupy forest land will not pay forest vegetation restoration fees if they replenish forest land adjacent to the requisitioned or occupied forest land.
(3) Forest land compensation fee
It shall be handled in accordance with the city’s standards and regulations for requisitioning and occupying vegetable land.
(4) Labor force resettlement subsidy
Follow the provisions of the "Shanghai Agricultural Population Resettlement Measures for Acquisition of Collectively-owned Land for Residential Construction" (Municipal Government Order No. 62).
4. The trees and seedlings cut down or removed from the forest land requisitioned or occupied shall belong to the original forest and seedling ownership unit or operator. If the trees or seedlings that are taken out can be cultivated in other places, they should be cultivated in other places and reused for afforestation and greening.
5. Compensation fees for trees and woodland should be based on the principle of “whoever owns (uses), collects”. Compensation fees for trees and forest land collected shall be paid to the units that enjoy the ownership or use rights of the original forest land and forest trees, except for the compensation for trees, attachments and young crops that originally belonged to individuals. Compensation fees for trees and forest land are used for reforestation, restoration of forest vegetation and development of forestry production, and shall not be used for other purposes.
