Trade associations and chambers of commerce shall carry out industry standardization work in accordance with laws, regulations and articles of association. Article 5 Encourage the development and adoption of advanced standards.
People's governments at all levels shall take active measures to guide and promote producers and operators to develop and adopt advanced standards in a planned way, and arrange a certain proportion of funds in science and technology investment funds to support producers and operators to develop and adopt advanced standards; Those who have achieved remarkable social and economic benefits in formulating and adopting advanced standards shall be commended and rewarded.
The "advanced standards" as mentioned in these Regulations refer to standards that are stricter than national standards, industrial standards and local standards, are linked with international standards, and are close to or reach the international advanced level.
Measures for the evaluation and encouragement of advanced standards shall be formulated by the administrative department of quality and technical supervision of the province in conjunction with the relevant administrative departments of the province and implemented after the approval of the provincial people's government. Article 6 The administrative departments of quality and technical supervision, relevant administrative departments, trade associations and trade associations shall strengthen the guidance, training and services for the standardization work of producers and operators, and help producers and operators to improve the standardization level of enterprises. Seventh people's governments at all levels, the administrative department of quality and technical supervision, the relevant administrative departments and the mass media should strengthen the publicity and education of standardization laws and regulations, popularize standardization knowledge, and improve the legal awareness of standardization in the whole society. Chapter II Formulation of Local Standards Article 8 Local standards may be formulated for technical requirements such as industry, agriculture (including forestry, animal husbandry and fishery, the same below), service industry and engineering construction that need to be unified throughout the province, or for technical requirements that need to be unified within a certain scope in agricultural production. Ninth the formulation of local standards, should proceed from the actual needs of social and economic development in this province, adhere to the "People's Republic of China (PRC) Standardization Law" provisions of the principle of conducive to the development of socialist market economy.
Encourage and support producers and operators, trade associations and trade associations to participate in the formulation of local standards. Tenth local standards are divided into mandatory standards and recommended standards.
The following local standards are mandatory:
(1) Standards for safeguarding human health and personal and property safety;
(2) Standards that must be implemented according to laws and administrative regulations such as environmental protection and food hygiene.
Other local standards are recommended standards. Article 11 Project proposals for formulating local standards are generally put forward by relevant administrative departments and industry associations in the province; Project proposals for formulating local standards for agricultural production technology may be put forward by the administrative departments of quality and technical supervision of cities, counties and districts or the relevant administrative departments of agriculture, forestry and fisheries.
The provincial administrative department of quality and technical supervision shall, after determining the local standard-setting project, prepare the local standard-setting plan and organize its implementation. The plan for the formulation of local standards shall be reported to the competent administrative department of quality and technical supervision of the State for the record. Twelfth local standards are generally drafted by the unit that puts forward the project proposal; The provincial administrative department of quality and technical supervision can also directly organize the drafting.
When drafting local standards, we should fully listen to the opinions of users, consumers, producers and operators, relevant administrative departments, industry associations, scientific research institutions and academic groups; The draft compulsory local standards shall be open to the public for comments. Thirteenth local standards draft technical review, the drafting unit shall entrust the technical centralized professional standardization technical committee; Where there is no corresponding professional standardization technical committee, the drafting unit shall organize professional and technical personnel of relevant units such as production, use, distribution, scientific research and academic organizations, as well as relevant administrative departments, trade associations and consumer representatives to conduct a review.
The establishment scheme of the professional standardization technical committee shall be determined by the provincial administrative department of quality and technical supervision in conjunction with the relevant administrative departments of the province. Fourteenth local standards by the provincial administrative department of quality and technical supervision unified examination and approval, number and release; Local standards involving agricultural production technology can be examined and approved by the administrative department of quality and technical supervision of the city, county and district in conjunction with the administrative departments of agriculture, forestry and fishery, and reported to the administrative department of quality and technical supervision of the province for serial number release.
