China's legal system does not stipulate that administrative leaders may not concurrently hold real or honorary positions in public institutions.

On the contrary, there are actually many administrative leaders who work part-time in public institutions.

* * * After the Notice of the General Office of the Central Committee and the General Office of the State Council on Leading Cadres of Party and Government Organs Not Holding Leading Positions in Social Organizations (No.1998, hereinafter referred to as 17) was issued, the party committees of all provinces, autonomous regions and municipalities directly under the Central Government and all departments of the central state organs carried out information on leading cadres of party and government organs holding leading positions in social organizations. At present, all localities and departments have asked the central management cadres (including those who have retired from leadership positions and have not yet gone through retirement procedures, the same below) to take up leadership positions in social organizations. According to document the General Office of the Central Committee of the CPC 17, "If it is really necessary to hold the leadership position of a social organization due to special circumstances, it must be examined and approved according to the cadre management authority". In order to further standardize the examination and approval procedures and strengthen the management of this work, relevant issues are hereby notified as follows:

A, leading cadres who hold leadership positions in social organizations should be strictly in accordance with the the Central Committee of the Communist Party of China 17 document, the General Office of the State Council forwarded the notice of the Ministry of Civil Affairs on rectifying the opinions of social organizations (the State Council 1997+0 1 document), the Regulations on the Administration of Registration of Social Organizations and the Measures for the Administration of Foundations. The person in charge of the post of Secretary-General of a social organization or above shall be in good health and be able to work normally, with a term of no more than two terms and an age of no more than 70 years; Leading cadres shall not concurrently serve as legal representatives of more than two social organizations; The leading members of the foundation shall not be concurrently held by the current government staff. The above provisions apply to leading cadres who have gone through retirement procedures and still need to work part-time in social organizations.

Two, the central management cadres who hold leading positions in social organizations should be strictly controlled. If it is really necessary for cadres under the central management to work part-time, social organizations must play an important role in the country, region, industry and economic, political and social life, and have certain influence at home and abroad, and have been formally approved by the civil affairs department. Leading cadres have no other part-time jobs because of their work needs, and the part-time leadership positions are related to their own business work. With approval, they can concurrently hold the leadership position of a social group. Persons who hold leading positions in social organizations shall not receive any remuneration from social organizations. When leading cadres who hold leading positions in social organizations reach retirement age, they shall go through retirement procedures in accordance with state regulations.

Cadres under the central management shall not concurrently hold leadership positions (including honorary positions) of overseas social organizations.

Third, the central management cadres concurrently hold the leadership positions of social organizations, and the competent business units of social organizations shall solicit the opinions of the party group (party committee) of the unit where the cadres work in advance, and after the approval of the cadre (personnel) department of the unit where the cadres work, the party group (party committee) shall report to the Central Organization Department for examination and approval in the name of the party group (party committee) of the unit where the cadres work. Among them, the central and state organs at or above the ministerial level leading cadres work part-time, and the unit where the cadres work must first seek the opinions of the leading comrades in charge of the Central Committee or the State Council and report to the Central Organization Department.

Four, report to the central management of cadres who hold leadership positions in social organizations, need to explain the following contents: (1) the nature, tasks and establishment time of social organizations, and the departments and business units that approved the establishment of social organizations. (2) whether the current or original positions of leading cadres and part-time reasons are concurrently legal representatives; Have I ever worked part-time in other social organizations? (three) the leading cadres have held leading positions in social organizations, and need to continue to work part-time, it shall explain the time and duration of the cadres themselves; Leading cadres who are new presidents (directors) of social organizations should explain the reasons why the former presidents (directors) no longer hold part-time jobs. (4) Attached are the approval form for appointment and removal of cadres and the list of current leading cadres of social organizations in triplicate, and a copy of the articles of association and registration certificate of social organizations.

Five, non-financial enterprises and institutions that do not have the administrative functions of the government, belong to the central management of cadres and social organizations, do not need to report to the Central Organization Department for approval.
