Chapter 1 General Provisions Article 1 These measures are formulated in accordance with the "Xiamen Residential Area Property Management Regulations" (hereinafter referred to as the "Regulations") and other relevant regulations and in combination with the actual situation of this city.
Article 2 The term "Special Fund for Public Facilities in Residential Areas" as mentioned in these Measures (hereinafter referred to as the "Special Fund") refers to the fund established in accordance with the "Regulations" and specifically used for the maintenance, renewal and renovation of public facilities in residential areas.
Article 3 These Measures shall apply to the collection, use and management of special funds.
Article 4 The municipal construction administrative department is responsible for supervising the allocation and use of special funds.
Chapter 2 Collection of Special Funds Article 5 After the implementation of the Regulations, development and construction units shall allocate a one-time special fund of 2% of the total construction investment in accordance with the provisions of the Regulations.
The development and construction unit may incorporate special funds into the project budget and include them in the development costs.
Special funds for poverty alleviation housing, unified housing, dilapidated housing, and affordable housing shall be allocated in one go by the unified organization construction unit based on 2% of the total construction investment.
The total construction investment mentioned in the preceding paragraph does not include land price.
The total construction investment is denominated in RMB.
For investments in foreign currencies, the investment shall be converted into RMB based on the foreign exchange rate announced by the state on the day of investment allocation.
Article 6 After the implementation of the "Regulations", if part of the houses in the residential area are sold and part has not been sold, the development and construction unit shall convert the unsold houses into a special fund based on the proportion of the total investment.
Chapter 3 Use of Special Funds Article 7 Special funds are used for the maintenance and renovation of public facilities invested by residential area development and construction units, and are strictly prohibited from being used for other purposes.
Upon decision of the owners' meeting or owners' representative meeting, the special fund can also be used to purchase treasury bonds, corporate bonds and other investments approved by the government; it can also be used to insure public facilities in accordance with regulations.
Investment income is put into a special fund.
Article 8 In principle, the value-added part of the special fund shall be used for the maintenance, renewal and renovation of public facilities.
If special circumstances require the use of principal, it should be decided by the owners' meeting or owners' representative meeting and approved by the municipal construction administrative department.
Article 9 If public facilities in residential areas fall within the scope of maintenance responsibilities of development and construction units according to law, the required maintenance costs shall not be included in the special fund.
Article 10 The maintenance of public facilities is divided into three standards: large, medium and small.
Property management companies and owners' committees are not allowed to dismantle or lower the maintenance items and maintenance standards of public facilities without authorization.
Article 11 If public facilities need to be repaired or renovated, the property management enterprise shall submit an application to the owners' committee.
If the owners committee agrees to the maintenance application, it will be reported to the construction administrative department for approval.
Before reporting to the construction administrative department for approval, the owners' committee may submit the maintenance budget for medium and minor repairs or renovations of public facilities with a cost of less than 100,000 yuan to a qualified engineering consulting agency for review;
If the cost of facility overhaul or renovation exceeds 100,000 yuan, the maintenance budget of public facilities shall be submitted to a qualified engineering consulting agency for review.
Article 12 If the cost of overhaul or renovation of public facilities exceeds 100,000 yuan and it is necessary to apply for the use of special funds, the following materials should be submitted to the owners committee: (1) Basic project name, scale, etc. of public facilities
situation; (2) The current use status of public facilities and the existence of major problems; (3) Plans and programs for maintenance, renovation and renovation; (4) The budget for maintenance and renovation; (5) Other materials required by the owners' committee

Article 13: The municipal construction administrative department shall allocate special funds based on the consent submitted by the owners' committee and the review opinions of the engineering consulting agency.
Article 14 If public facilities need emergency repairs, the property management company shall organize emergency repairs first and report to the owners committee within 24 hours.
After the maintenance is completed, the special fund appropriation procedures shall be completed in accordance with the relevant provisions of these Measures.
Article 15 After the maintenance of public facilities is completed, the owners' committee or others entrusted by the owners' committee shall inspect and accept the repairs and review the use of funds.
If the budget exceeds the budget, it should be reported to the municipal construction administrative department for appropriation; the property management enterprise should return the balance and include it in a special fund.
Chapter 4 Management of Special Funds Article 16 The special funds should be directly deposited into the special fund account established by the municipal construction administrative department, and a special account should be established and managed by the owners' committee as a unit.
Article 17 The municipal construction administrative department shall promptly allocate special funds in accordance with the provisions of these Measures, shall not misappropriate special funds, and shall not interfere with the normal use of special funds by the owners' committee.
Article 18 The owners' committee and the property management enterprise shall announce the use of special funds for public facilities at least once a year and accept the supervision of all owners and users.
Chapter 5 Supplementary Provisions Article 19 These Measures shall come into effect on the date of promulgation.
