Chapter I General Provisions Article 1 In order to protect and improve the ecological environment, prevent and control soil pollution, safeguard public health, promote the sustainable utilization of soil resources, promote the construction of ecological civilization, and promote the sustainable development of economy and society, these Regulations are formulated in accordance with the provisions of the Law of People's Republic of China (PRC) on the Prevention and Control of Soil Pollution and other relevant laws and administrative regulations, combined with the actual situation of the autonomous region. Article 2 These Regulations shall apply to the prevention and control of soil pollution and related activities within the administrative area of the autonomous region. Article 3 The prevention and control of soil pollution shall adhere to the principles of giving priority to prevention, giving priority to protection, classified management, risk control, pollution responsibility and public participation. Fourth people's governments at all levels are responsible for the prevention and control of soil pollution and the safe use of soil within their respective administrative areas.

The people's governments at or above the county level shall organize, coordinate and urge the relevant departments to perform their duties of supervision and management in the prevention and control of soil pollution according to law, strengthen the financial guarantee for the prevention and control of soil pollution, and establish a diversified capital investment and guarantee mechanism involving the government, society and enterprises.

Township people's governments and sub-district offices shall do a good job in the prevention and control of soil pollution in accordance with their duties. Article 5 The competent department of ecological environment shall exercise unified supervision and management over the prevention and control of soil pollution within their respective administrative areas.

The competent departments of agriculture, rural areas, natural resources, housing and urban and rural construction, forestry and grassland of the people's governments at or above the county level shall supervise and manage the prevention and control of soil pollution within their respective functions and duties. Article 6 The autonomous region shall implement the target responsibility system and evaluation system for the prevention and control of soil pollution, and take the completion of the target for the prevention and control of soil pollution as the content of the evaluation of the people's governments at all levels and their responsible persons, and the departments and their responsible persons responsible for the supervision and management of soil pollution prevention and control of the people's governments at or above the county level. The evaluation results should be regularly disclosed to the public. Article 7 The people's government of the autonomous region shall set up an autonomous region soil pollution prevention and control fund in accordance with the provisions of the state, which is mainly used for the prevention and control of agricultural land soil pollution, the risk control and restoration of soil pollution that cannot be identified by the responsible person of soil pollution or the land use right holder, and other soil pollution prevention and control matters stipulated by the people's government of the autonomous region. Eighth people's governments at or above the county level shall establish and improve the training and introduction mechanism of professional and technical personnel for soil pollution prevention and control, and strengthen technical research and professional training for soil pollution prevention and control.

Encourage qualified schools to carry out professional and technical education on soil environmental protection. Article 9 The competent department of ecological environment of the people's government of the autonomous region may establish an expert database for the prevention and control of soil pollution, and provide technical consultation, technical service, evaluation and demonstration and other support for the prevention and control of soil pollution. Tenth people's governments at all levels and their relevant departments, grassroots mass autonomous organizations should strengthen the publicity and education of soil pollution prevention and control, encourage voluntary service of soil pollution prevention and control, and guide the public to participate in the work of soil pollution prevention and control according to law.

The news media should carry out publicity and popularize relevant scientific knowledge on the prevention and control of soil pollution, enhance the public's awareness of the prevention and control of soil pollution, and supervise the illegal acts of soil pollution by public opinion. Chapter II Planning, Standards, Detailed Investigation and Monitoring Article 11 The people's governments at or above the county level shall incorporate the prevention and control of soil pollution into their plans for national economic and social development and ecological environment protection.

The competent department of natural resources of the people's government at or above the county level shall incorporate the requirements of soil environmental management into the national spatial planning, and the land use shall meet the requirements of soil environmental quality.

The competent department of ecological environment of the people's government at or above the municipal level divided into districts shall, jointly with the competent departments of development and reform, agriculture and rural areas, natural resources, housing and urban and rural construction, forestry, grasslands, etc., formulate a plan for the prevention and control of soil pollution according to the requirements of national spatial planning and ecological environment protection planning, as well as the results of land use, soil pollution investigation, detailed investigation and monitoring, and report it to the people's government at the same level for approval before promulgation and implementation.

Article 14 The autonomous region shall implement a soil environmental monitoring system.

The competent department of ecological environment of the people's government of the autonomous region shall, jointly with the competent departments of agriculture and rural areas, natural resources, housing and urban and rural construction, water conservancy, sanitation, forestry, grassland, etc., uniformly plan the setting of soil environmental monitoring stations (points) in the autonomous region, establish a basic database of soil environment, and implement dynamic data updating and information sharing. Chapter III Prevention and Protection Article 15 All kinds of construction projects that involve land use planning and may cause soil pollution shall be subject to environmental impact assessment according to law. Environmental impact assessment documents should include possible adverse effects on soil and corresponding preventive measures to be taken.
