The above-mentioned responsible subjects bear strict responsibility and joint responsibility for governance costs, and the responsibility is traced back to the source. Joint liability enables the superfund or the federal government to recover all the governance costs from any of the above-mentioned responsible persons. Moreover, this kind of liability is in fact unlimited, and will not be limited because the responsible party is in the form of limited liability, that is, if the responsible party is unable to pay the pollution clean-up expenses and damage compensation expenses that should be paid according to this law, any organization or individual holding shares in it can become the object of responsibility. Tracing back to the source, even if the original disposal was completely legal and may constitute environmental pollution according to the standards of this law, it can be considered that abandoned enterprises should bear the responsibility of governance, and at the same time, the current owners and users should bear the legal responsibility of governance. While determining the subject of responsibility, the law also stipulates that in the case of force majeure, war or action, the behavior of the third party and the combination of the above three reasons, the above-mentioned subject of responsibility will not bear the governance costs, and the governance costs will be paid by the super fund.
Super fund has been implemented for 30 years, and some achievements have been made in the process of implementation.
