The State Council's Opinions on Establishing a Unified Basic Endowment Insurance System for Urban and Rural Residents

People's governments of all provinces, autonomous regions and municipalities directly under the Central Government, ministries and commissions and institutions directly under the State Council:

According to the spirit of the 18th National Congress of the Communist Party of China and the requirements of the Third Plenary Session of the 18th Central Committee on integrating the basic old-age insurance system for urban and rural residents, according to the relevant provisions of the Social Insurance Law of People's Republic of China (PRC), and on the basis of summarizing the pilot experience of the new rural social endowment insurance (hereinafter referred to as the new rural social endowment insurance) and the urban social endowment insurance (hereinafter referred to as the urban residential insurance), the State Council decided to merge the new rural social endowment insurance and the urban residential insurance to establish a unified national basic old-age insurance for urban and rural residents. We hereby put forward the following opinions:

I. Guiding ideology

Hold high the great banner of Socialism with Chinese characteristics, take Deng Xiaoping Theory, Theory of Three Represents and Scientific Outlook on Development as the guidance, implement the decision-making arrangements of the CPC Central Committee and the State Council, comprehensively promote and continuously improve the basic old-age insurance system covering urban and rural residents in accordance with the principle of full coverage, flexibility and sustainability, and give full play to the important role of social insurance in safeguarding people's basic livelihood, regulating social income distribution and promoting coordinated economic and social development in urban and rural areas.

Second, the mission objectives

Adhere to and improve the system mode of combining social pooling with individual accounts, consolidate and broaden the financing channels of combining individual contributions, collective subsidies and government subsidies, improve the treatment payment policy of combining basic pensions with individual account pensions, strengthen the incentive mechanism of long-term payment and more, establish the normal adjustment mechanism of basic pensions, improve the service network, improve the management level, and provide convenient and fast services for insured residents. At the end of the Twelfth Five-Year Plan, the new rural insurance and urban residential insurance systems will be basically implemented throughout the country, and will be linked with the basic old-age insurance system for employees. By 2020, a fair, unified and standardized old-age insurance system for urban and rural residents will be established in an all-round way, which will be matched with other social security policies such as social assistance and social welfare, and give full play to the positive role of traditional security methods such as family pension to better protect the basic livelihood of insured urban and rural residents.

Third, the scope of insurance.

Staff of non-state organs and institutions and urban and rural residents who have reached the age of 16 (excluding students at school) and are not included in the basic old-age insurance system for employees can participate in the old-age insurance for urban and rural residents at their domicile.

Fourth, raise funds.

The endowment insurance fund for urban and rural residents consists of individual contributions, collective subsidies and government subsidies.

(1) individual payment.

Those who participate in the old-age insurance for urban and rural residents shall pay the old-age insurance premium in accordance with the regulations. At present, the payment standards are set at 100 yuan, 200 yuan, 300 yuan, 400 yuan, 500 yuan, 600 yuan, 700 yuan, 800 yuan, 900 yuan, 1000 yuan, 1500 yuan, 2000 yuan, and the people's governments of provinces (autonomous regions and municipalities) can add payment grades according to actual conditions. Ministry of Human Resources and Social Security will, together with the Ministry of Finance, adjust the payment grade standards in a timely manner according to the income growth of urban and rural residents. Insured people choose their own grades to pay, and pay more.

(2) Collective subsidies.

Conditional village collective economic organizations shall give subsidies to the insured, and the subsidy standard shall be determined by the villagers' committee holding a villagers' meeting, and encourage qualified communities to include collective subsidies in the financing scope of community public welfare undertakings. Encourage other social and economic organizations, charitable organizations and individuals to provide financial support for the insured. Subsidies and the amount of subsidies shall not exceed the highest payment grade standard stipulated by the local authorities.

(3) government subsidies.

The government pays the basic pension in full to the insured who meet the conditions for receiving the old-age insurance for urban and rural residents. Among them, the central government gives full subsidies to the central and western regions and 50% subsidies to the eastern regions in accordance with the basic pension standards set by the central government.

The local people's government subsidizes the insured person's payment, and the subsidy standard is not lower than the 30 yuan per person per year for choosing the lowest grade standard payment; Choose a higher payment standard and appropriately increase the subsidy amount; Choose 500 yuan and above, the subsidy standard is not less than 60 yuan per person per year, and the specific standards and measures are determined by the people's governments of all provinces (autonomous regions and municipalities). The local people's government pays part or all of the minimum old-age insurance premium for severely disabled people and other groups with payment difficulties.

Five, the establishment of personal accounts

The state establishes a personal account for old-age insurance for each insured person, which is recorded for life. Individual contributions, local people's government subsidies, collective subsidies and contributions from other social and economic organizations, charitable organizations and individuals are all credited to individual accounts. The amount stored in individual accounts shall bear interest according to the provisions of the state.

Six, pension insurance benefits and adjustment

Endowment insurance for urban and rural residents consists of basic pension and personal account pension, which is paid for life.

(1) basic pension. The central government determines the minimum standard for basic pensions, establishes a normal adjustment mechanism for the minimum standard for basic pensions, and timely adjusts the national minimum standard for basic pensions according to economic development and price changes. The local people's government can appropriately raise the basic pension standard according to the actual situation; For long-term payment, the basic pension can be appropriately increased, and the increased and increased funds will be paid by the local people's government. The specific measures shall be formulated by the people's governments of all provinces (autonomous regions and municipalities) and reported to Ministry of Human Resources and Social Security for the record.

(2) Personal account pension. At present, the monthly calculation and payment standard of personal account pension is the total storage amount of personal account divided by 139 (the same as the calculation and payment coefficient of personal account pension in the current basic old-age insurance for employees). If the insured person dies, the balance of personal account funds can be inherited according to law.

Seven, pension insurance benefits to receive conditions

Individuals who participate in the old-age insurance for urban and rural residents, who have reached the age of 60, have paid a total of 15 years, and have not received the basic old-age security benefits stipulated by the state, can receive the old-age insurance benefits for urban and rural residents on a monthly basis.

When the new rural insurance or urban residential insurance system is implemented, it has reached the age of 60, and those who have not received the basic old-age security benefits stipulated by the state before the date of publication of this opinion do not need to pay. From the date of implementation of this opinion, you can receive the basic pension for urban and rural residents' old-age insurance on a monthly basis; If the collection period is less than 15 years, the payment shall be made year by year, and supplementary payment is allowed, and the accumulated payment shall not exceed 15 years; Those who have received the payment for more than 15 years shall be paid annually, and the accumulated payment shall not be less than 15 years.

The pension for urban and rural residents will be stopped from the next month if the recipients of the pension insurance benefits die. Conditional local people's governments can explore the establishment of a funeral subsidy system in light of local conditions. The social insurance agency shall check the receipt of pension insurance benefits for urban and rural residents every year; Village (neighborhood) committees should assist social insurance agencies to carry out their work, publicize the eligibility of the insured person's treatment within the administrative village (community), and compare it with the record of employees' basic old-age insurance treatment to ensure that it is not heavy, not leaking and not bad.

Eight, transfer and system convergence

Those who participate in the old-age insurance for urban and rural residents need to transfer the old-age insurance relationship between urban and rural residents across regions during the payment period, and can apply for the transfer of the old-age insurance relationship at the place where they move in, transfer all the storage amount in their personal accounts at one time, and continue to pay the insurance premium according to the regulations of the place where they move in, and the payment period is calculated cumulatively; Persons who have received pension insurance benefits for urban and rural residents according to regulations, regardless of whether the household registration is transferred or not, their pension insurance relationship is not transferred.

The connection between the old-age insurance system for urban and rural residents and the basic old-age insurance for employees, special care and resettlement, the minimum living guarantee for urban and rural residents, the five guarantees in rural areas and the reward and assistance system for some rural family planning families shall be implemented in accordance with the relevant provisions.

Nine. Fund management and operation

The new rural insurance fund and the urban residential insurance fund will be merged into the urban and rural residents' endowment insurance fund, and the financial accounting system and various business management rules and regulations of the urban and rural residents' endowment insurance fund will be improved. The endowment insurance fund for urban and rural residents shall be included in the financial special account of the social security fund, and two lines of revenue and expenditure shall be managed, with separate bookkeeping and independent accounting. No region, department, unit or individual may misappropriate, falsely report or impersonate. All localities should gradually promote the provincial management of the endowment insurance fund for urban and rural residents on the basis of integrating the endowment insurance system for urban and rural residents.

The endowment insurance fund for urban and rural residents shall be invested and operated in accordance with the unified provisions of the state to maintain and increase the value.

X. Financial supervision

Human resources and social security departments at all levels shall, jointly with relevant departments, earnestly perform their supervisory duties, establish and improve the internal control system and the fund audit supervision system, supervise and inspect the fund raising, transfer, distribution, storage and management, disclose information according to regulations, and accept social supervision. The financial department and the audit department shall, according to their respective responsibilities, supervise the income and expenditure, management and investment operation of the fund. The relevant departments shall severely deal with such violations of discipline and law as false reporting, fraudulent use, misappropriation, corruption and waste in accordance with relevant state laws and regulations. Actively explore effective ways for village (neighborhood) representatives to participate in social supervision, so that the fund is open and transparent and the system operates in the sun.

Eleven, handling management services and information construction

The people's governments of all provinces (autonomous regions and municipalities) should earnestly strengthen the capacity building of urban and rural residents' old-age insurance handling, scientifically integrate existing public service resources and social insurance handling management resources according to local conditions, enrich and strengthen the grassroots handling power, and realize accurate management and convenient service. We should pay attention to the use of modern management methods and the government's purchase of services to reduce administrative costs and improve work efficiency. Strengthen the professional training of urban and rural residents' endowment insurance staff, and constantly improve the level of public services. The social insurance agency shall carefully record the payment and treatment of the insured, establish the insured files, and keep them properly according to the regulations. The local people's governments shall provide the dispatched offices with necessary workplaces, facilities, equipment and funds. The endowment insurance fund for urban and rural residents shall be included in the fiscal budget at the same level, and shall not be spent from the endowment insurance fund for urban and rural residents. In areas where grassroots finance is indeed difficult, provincial and municipal finance can give appropriate subsidies.

All localities should integrate and form a provincial centralized information management system for urban and rural residents' old-age insurance on the basis of the existing new rural insurance and urban residential insurance business management systems, incorporate them into the construction of the "Golden Insurance Project", and share information resources with other citizens' information management systems; It is necessary to extend the information network to the grassroots level to realize real-time networking of provinces, cities, counties, towns (streets) and communities, and areas with conditions can be extended to administrative villages; It is necessary to vigorously promote the national unified social security card to facilitate the insured to pay by card, receive benefits and inquire about the insurance information.

Twelve, strengthen organizational leadership and policy propaganda.

Local people's governments at all levels should fully understand the significance of establishing the old-age insurance system for urban and rural residents, incorporate it into the local economic and social development plan and the annual target management assessment system, and earnestly strengthen organizational leadership; It is necessary to optimize the financial expenditure structure, increase financial input, and provide necessary financial support for the construction of the old-age insurance system for urban and rural residents. Human resources and social security departments at all levels should earnestly perform the duties of the competent departments, and do a good job in overall planning, policy formulation, unified management, comprehensive coordination, supervision and inspection of urban and rural residents' endowment insurance in conjunction with relevant departments.

All regions and relevant departments should conscientiously do a good job in the publicity of the old-age insurance policy for urban and rural residents, comprehensively and accurately publicize and interpret the policy, correctly grasp the direction of public opinion, pay attention to the use of easy-to-understand language and ways easily accepted by the masses, go deep into the grassroots to carry out publicity activities, guide urban and rural residents to actively participate in insurance, continue to pay fees, increase accumulation, and protect the legitimate rights and interests of insured personnel.

The people's governments of all provinces (autonomous regions and municipalities) shall formulate specific implementation measures according to this opinion and the actual situation in the region, and report them to Ministry of Human Resources and Social Security for the record.

This opinion shall be implemented as of the date of issuance. If the existing provisions are inconsistent with this opinion, this opinion shall prevail. (General Office of the State Council)
