Chapter 2 of the Yunnan Provincial Bidding Regulations Scope and Scale Standards for Bidding

Article 6 If the following engineering construction projects, including the survey, design, construction, supervision of the project and the procurement of important equipment and materials related to the engineering construction, meet one of the scale standards stipulated by the state and the province, bidding shall be conducted: (1)

) Infrastructure projects and public utility projects related to social public interests and public safety; (2) Projects that use fiscal funds in whole or in part or are included in government special construction funds under financial management; (3) Government-financed projects;

(4) Projects in which state-owned funds hold a controlling or dominant position; (5) Projects using loans or aid funds from international organizations or foreign governments; (6) Other projects that require bidding according to laws, regulations, and rules.

The specific scope of infrastructure projects and public utility projects related to social public interests and public safety shall be implemented in accordance with relevant national regulations.

Article 7 The scale standards for engineering construction projects that are subject to bidding as stipulated in Article 6 of these Regulations shall be subject to the national regulations if they are stipulated by the state; if the state has no regulations or the state has regulations but needs to make detailed regulations based on the actual situation of the province, the provincial development and reform

The department shall work with relevant administrative departments to formulate the plan and submit it to the Provincial People's Government for approval before implementation.

Article 8 If any of the following circumstances make it inappropriate to invite bids, the bids may not be invited: (1) involving national security, state secrets or emergency rescue and disaster relief; (2) using poverty alleviation funds to implement work-relief; (3) need to adopt

Irreplaceable patents or special technologies; (4) The construction enterprise builds the project for its own use, and the qualification level of the construction enterprise meets the project requirements; (5) The additional contract amount of the project under construction does not exceed 10% of the original contract amount and does not exceed 10% of the original contract amount.

For small ancillary projects or main layer-adding projects exceeding RMB 2 million, the original winning bidder still has the ability to contract; (6) Construction projects in which private enterprises use all their own funds, except for those that require bidding according to laws, regulations, and rules;

(7) The franchised project investors who have been selected through bidding are legally able to construct, produce or provide services on their own; (8) It is necessary to purchase projects, goods or services from the original winning bidder, otherwise it will affect the construction or functional supporting requirements; (8)

9) Other special circumstances stipulated by the state.

The projects listed in the preceding paragraph are projects that are legally required to be tendered according to the national regulations and require project approval and verification procedures, and shall be approved by the project approval and verification department; other projects shall be subject to the approval of the relevant administrative departments by the bidder; the Provincial People's Government shall determine
