These regulations are formulated to meet the basic needs of the people for cultural and sports activities.
Article 2 The term "public cultural and sports facilities" as mentioned in these Regulations refers to public welfare libraries, museums, memorial halls, fine arts facilities organized by people's governments at all levels or organized by social forces and open to the public for carrying out cultural and sports activities.
Buildings, venues and equipment for museums, cultural centers (stations), stadiums (venues), youth palaces, workers’ cultural palaces, etc.
The term "public cultural and sports facilities management unit" as mentioned in these Regulations refers to social public cultural and sports institutions that are responsible for the maintenance of public cultural and sports facilities and provide services for the public to carry out cultural and sports activities.
Article 3 Public cultural and sports facilities management units must adhere to the direction of serving the people and serving socialism, make full use of public cultural and sports facilities, and disseminate information that is beneficial to improving national quality, economic development and social progress.
scientific, technological and cultural knowledge, and carry out civilized and healthy cultural and sports activities.
No unit or individual may use public cultural and sports facilities to engage in activities that endanger public interests.
Article 4 The state builds public cultural and sports facilities in a planned manner.
Support the construction of public cultural and sports facilities in minority areas, remote poverty-stricken areas and rural areas.
Article 5 Funds for the construction, maintenance and management of public cultural and sports facilities organized by people's governments at all levels shall be included in the capital construction investment plans and fiscal budgets of the people's governments at the same level.
Article 6 The state encourages social forces such as enterprises, institutions, social groups and individuals to organize public cultural and sports facilities.
The state encourages the establishment of social funds for public cultural and sports facilities through voluntary donations and other methods, and encourages the donation of property to the people's government, social welfare institutions or public cultural and sports facilities management units in accordance with the law.
Donors can enjoy preferential treatment in accordance with relevant provisions of tax laws.
The state encourages cultural and sports facilities within institutions, schools and other units to be open to the public.
Article 7 The cultural administrative department and the sports administrative department of the State Council shall be responsible for the supervision and management of public cultural and sports facilities nationwide in accordance with the duties prescribed by the State Council.
The cultural administrative departments and sports administrative departments of the local people's governments at or above the county level shall be responsible for the supervision and management of public cultural and sports facilities within their respective administrative regions in accordance with the responsibilities specified by the people's governments at the same level.
Article 8 Units and individuals that have made outstanding contributions to the construction, management and protection of public cultural and sports facilities shall be rewarded by the local people's government at or above the county level or relevant departments.
Chapter 2 Planning and Construction Article 9 The development and reform administrative department of the State Council shall, together with the cultural administrative department and the sports administrative department of the State Council, incorporate the construction of national public cultural and sports facilities into the national economic and social development plan.
Local people's governments at or above the county level shall incorporate the construction of public cultural and sports facilities within their own administrative regions into their local national economic and social development plans.
Article 10 The number, type, scale and layout of public cultural and sports facilities shall be coordinated and optimized according to the national economic and social development level, population structure, environmental conditions and the needs of cultural and sports development, and shall be in accordance with the national
Regulations on land quotas for urban and rural public cultural and sports facilities.
The land quota quota for public cultural and sports facilities shall be formulated by the land administrative department and the construction administrative department of the State Council in conjunction with the cultural administrative department and the sports administrative department of the State Council respectively.
Article 11 The location selection for the construction of public cultural and sports facilities shall comply with the principles of concentrated population and convenient transportation.
Article 12 The design of public cultural and sports facilities shall meet the requirements of practicality, safety, science, aesthetics, etc., and barrier-free measures shall be adopted to facilitate the use of disabled persons.
Specific design specifications shall be formulated by the construction administrative department of the State Council in conjunction with the cultural administrative department and sports administrative department of the State Council.
Article 13 If state-owned land is used for the construction of public cultural and sports facilities, it may be obtained through allocation with approval in accordance with the law.
Article 14 The land reserved for the construction of public cultural and sports facilities shall be included in the overall land use plan and urban and rural planning by the land administration department and urban and rural planning administrative department of the local people's government at or above the county level in accordance with the relevant national land use quota indicators.
and be reviewed and approved in accordance with legal procedures.
No unit or individual may encroach on public land reserved for the construction of cultural and sports facilities or change its use.
If it is necessary to adjust the reserved land for the construction of public cultural and sports facilities due to special circumstances, the urban and rural planning shall be adjusted in accordance with the law, and the construction reserved land shall be re-determined in accordance with the provisions of the preceding paragraph.
The redetermined land reserved for the construction of public cultural and sports facilities shall not be less than the original area.
Article 15 When building, renovating or expanding residential areas, corresponding cultural and sports facilities shall be planned and constructed in accordance with relevant national regulations.
The supporting cultural and sports facilities in residential areas should be designed, constructed and put into use at the same time as the main projects in residential areas.
