Full text of Shanghai Intangible Cultural Heritage Protection Regulations 2018 General Principles of Shanghai Intangible Cultural Heritage Protection Regulations Article 1 In order to strengthen the protection of intangible cultural heritage, inherit and develop Shanghai’s historical context, and inherit and promote the excellent traditional culture of the Chinese nation,

These regulations are formulated in accordance with the Intangible Cultural Heritage Law of the People's Republic of China (hereinafter referred to as the Intangible Cultural Heritage Law) and other laws and administrative regulations, and in light of the actual situation of this city.

Article 2 These regulations shall apply to the investigation, preservation, identification, utilization, inheritance, dissemination and other protection activities and related management work of intangible cultural heritage within the administrative region of this city.

Article 3 The municipal, district and county people's governments shall incorporate the protection of intangible cultural heritage into the national economic and social development plan at the same level, include the funds required for the protection of intangible cultural heritage in the fiscal budget at the same level, and establish a system that is in line with economic and social development.

Appropriate funding guarantee mechanism.

Township and town people's governments and sub-district offices should cooperate in the work related to the protection of intangible cultural heritage.

Article 4 The cultural administrative departments of the municipal, district and county people’s governments are responsible for the protection of intangible cultural heritage within their respective administrative regions.

Development and reform, finance, education, human resources and social security, press and publication, planning, land and resources, economic information, commerce, industry and commerce, agriculture, health and family planning, ethnic and religious, intellectual property and other departments are responsible for relevant intangible culture within the scope of their respective responsibilities.

Heritage conservation work.

The cultural administrative department shall, in conjunction with relevant departments, establish a departmental joint meeting system to coordinate and resolve major issues in the protection of intangible cultural heritage.

Article 5 The intangible cultural heritage protection agency affiliated to the municipal cultural administrative department shall undertake specific work related to the protection of intangible cultural heritage.

District and county people's governments should establish and improve protection institutions based on the actual needs of intangible cultural heritage protection within their respective administrative regions, and strengthen the training of specialized talents and the construction of professional teams.

Article 6 This city shall establish an expert committee for the protection of intangible cultural heritage.

The expert committee is composed of people from history, culture, art, science and other fields, and provides decision-making advice for the city's intangible cultural heritage protection work.

Article 7 The Municipal Intangible Cultural Heritage Protection Association and other relevant social organizations shall, in accordance with their respective charters, carry out intangible cultural heritage protection and related academic exchanges, consulting services, rights protection, etc.

Article 8: Encourage and support other social organizations, citizens, and legal persons to participate in the protection of intangible cultural heritage through research, collection, display, inheritance, donation, volunteer service, etc.

Article 9 The municipal, district and county people's governments shall strengthen the publicity of the protection of intangible cultural heritage and raise the awareness of the whole society in protecting intangible cultural heritage.

Radio stations, television stations, newspapers, magazines, websites and other media should publicize the protection of intangible cultural heritage and popularize the knowledge of intangible cultural heritage protection.

Investigation and Preservation Article 10 The municipal, district and county people's governments shall organize intangible cultural heritage investigations based on the needs of intangible cultural heritage protection.

District and county cultural administrative departments are specifically responsible for the investigation of intangible cultural heritage within their respective administrative regions.

Municipal cultural administrative departments should strengthen guidance and coordination, and conduct investigations into intangible cultural heritage that are difficult to cover in investigations by district and county cultural administrative departments.

Other relevant departments of the municipal and district and county people's governments may investigate intangible cultural heritage within their work areas in accordance with the law.

Citizens, legal persons and other organizations can conduct intangible cultural heritage investigations in accordance with the law.

The specific methods and requirements for cultural administrative departments and other relevant departments, citizens, legal persons and other organizations to conduct investigations of intangible cultural heritage shall be implemented in accordance with the relevant provisions of the Intangible Cultural Heritage Law.

Article 11 When conducting investigations of intangible cultural heritage, cultural administrative departments and other relevant departments shall identify, record, and file intangible cultural heritage, and establish and improve a mechanism for sharing investigation information.

When conducting investigations of intangible cultural heritage, cultural administrative departments and other relevant departments shall collect representative physical objects that are components of intangible cultural heritage, organize the information obtained during the investigation, and properly preserve them to prevent damage and loss.

Physical pictures and copies of materials obtained by other relevant departments shall be submitted to the cultural administrative department at the same level.

Article 12 The cultural administrative department shall establish intangible cultural heritage archives and related databases.

Except for those that should be kept confidential according to law, intangible cultural heritage files and related data and information should be made public and accessible to the public.
