Renmin University of China Law School holds seminar on climate change legislation

The Law School of Renmin University of China successfully held the “2016 Climate Change Legislation Seminar”.

This seminar was co-sponsored by the Law School and the Peng Zhen Democratic and Legal Thought Research and Education Fund, and co-organized by the Supreme People's Court Environmental Resources Judicial Theoretical Research Base of Renmin University of China and the Environmental Resources Law Research Association of the Beijing Law Society.

The School of Law of Renmin University of China has 1 national key first-level discipline (including all second-level disciplines) (Law) and 4 national-level key second-level disciplines. It has been approved to establish China’s first law postdoctoral mobile station (including all Ph.D.

degree subject points).

It has 1 undergraduate major (Law), 1 second bachelor's major (Intellectual Property), and 1 legal professional related certificate.

The conference organized by the School of Law of Renmin University of China focused on "The Situation and Tasks of my country's Climate Change Legislation after the Paris Conference". Environmental law scholars from Renmin University of China, Tsinghua University, China University of Political Science and Law, Ocean University of China, Capital University of Economics and Business and other universities As well as the Climate Change Strategy Research and International Cooperation Center, Peng Zhen Democratic and Legal Thought Research and Education Fund, Environmental Resources Tribunal of the Supreme People's Court, Beijing Law Society Environmental Resources Law Study Association, National People's Congress Environmental Resources Committee Law Office, Development Research More than 40 people including experts from the Center for Resource and Environmental Policy Research, the "Law Journal" and other relevant departments, as well as Professor Li Yanfang, Professor Zhu Xiao, Professor Yang Xiaoqing, Professor Zhu Liyu, Professor Zhou Ke from our school attended the seminar.

Under the chairmanship of Professor Zhou Ke from the School of Law of Renmin University of China, the seminar was conducted enthusiastically and orderly.

First, President Han Dayuan and Ms. Liu Na, who attended the meeting on behalf of Vice Chairman Fu Yang, delivered speeches as representatives of the organizer.

Dean Han affirmed the importance of this seminar and expressed his opinions on environmental protection, the development of environmental law disciplines and climate change.

Ms. Liu introduced the Peng Zhen Democratic and Legal Thought Research and Education Fund and expressed her support and recognition for this climate change legislation seminar.

This seminar is divided into three parts.

In the first part, the main speaker, Director Li Junfeng of the National Center for Strategic Research and International Cooperation on Climate Change, gave a speech on "The Situation and Tasks of my country's Climate Change Legislation after the Paris Conference".

Director Li focused on three aspects: issues resolved by the Paris Agreement, issues still to be resolved, and China’s contribution.

Director Li pointed out that the greatest contribution of the Paris Agreement is to allow all countries to respond to climate change on the premise of their independent contributions. He deeply analyzed the legal binding issue of the Paris Agreement and believed that China should legislate to address climate change based on the world.

The second part consists of key speeches by other participating experts and scholars.

First, Lin Dan, Director of the Bill Office of the National People's Congress Environmental and Resources Committee, delivered a speech on the theme of "my country's Legal Issues on Climate Change."

Taking the UK, Japan, South Korea and other countries as examples, Director Lin introduced in detail the legislative models and legislative styles to deal with climate change. He believed that my country's current climate change legislation should reflect China's national conditions, embody Chinese characteristics, and solve China's practical problems.

Then, Chang Jiwen, director of the Institute of Resources and Environmental Policy of the Development Research Center, gave a speech on "China's independent emission reduction commitments and the achievement of the Paris Agreement", arguing that China should adopt more appropriate negotiation methods to deal with climate change; the Paris Agreement

Although it is progressive, it may not be implemented for many reasons.

Next, Professor Wang Canfa from the School of Civil and Commercial Economics of China University of Political Science and Law gave a speech on "my country's Legislative Suggestions for Responding to Climate Change." Based on his experience in participating in legislation, Professor Wang Canfa introduced in detail the background, content and focus of controversy on the drafting of laws related to addressing climate change, and gave an in-depth It analyzes five aspects: whether it is necessary to introduce a law to respond to climate change as soon as possible, whether to stipulate clear goals in the legislation, what management systems the law should contain, whether there is a need for international cooperation chapters, and how the climate change adaptation system connects with other legal issues. question.

After that, Professor Xu Xiangmin of Ocean University of China gave a speech on "Equal Rights, Development Rights and Responsibility for Addressing Climate Change". Professor Xu Xiangmin discussed the principle of same but differentiated responsibilities from three aspects: historical emissions, legitimate priority needs, and those who can do more work.

Explain, and then put forward the "principle of equal development opportunities", that is, a country's level of development should be proportional to the extent of its responsibility to address climate change.

Afterwards, Professor Cao Mingde from the School of Civil, Commercial and Economic Law of China University of Political Science and Law gave a speech on "Research on the Implementation Issues of the Paris Climate Agreement", analyzing the pros and cons of whether the Paris Agreement is legally binding, and providing insights on the calculation of the carbon market.

Finally, Professor Hou Jiaru from the School of Civil and Commercial Economics of China University of Political Science and Law gave a speech on "Human Rights Law and International Climate Negotiations", analyzing the international climate change response from the new perspective of negotiation, and giving a detailed explanation based on human rights law.

The third part is the discussion and summary stage. Experts and scholars participating in the meeting actively spoke, published unique insights on climate change response legislation, and conducted in-depth analysis focusing on issues such as the carbon market and carbon tax.

Professor Wang Mingyuan, Professor Yang Xiaoqing, lawyer Luan Zhengming, and Manager Sun Wei of the German Rosa Luxemburg Foundation also spoke.

At the conclusion of the meeting, Professor Zhu Liyu spoke positively of this seminar and believed that the pragmatic style of environmental law experts and scholars demonstrated in this seminar was very beneficial to the smooth development of climate change legislation.

Finally, Professor Zhou Ke expressed his gratitude to all the guests for their wonderful speeches, and hoped that experts and scholars could continue to participate in research and discussions in the field of climate change legislation.
