I. Principles of application

1. Affordable housing is supported by the government and borne by individuals. If the application conditions are met, the purchase shall be limited to 1 set. Families applying for affordable housing may not apply for low-rent housing security in that year. After enjoying affordable housing, you may not enjoy other government policy housing concessions.

2. Apply for affordable housing to implement the application, review, publicity and waiting system, which shall be determined in accordance with the principles of openness, fairness and impartiality.

Second, the type and conditions of applying for a family

(1) Types of families applying for affordable housing

1. A family consisting of a couple (or a single resident with a deceased or divorced spouse) and underage or unmarried children under the age of 33 (excluding).

2. Families composed of married or childless couples.

3.33-year-old single residents (including divorced or widowed persons).

Family members who study or work in other places (excluding overseas) (including those whose registered permanent residence has moved out) should be included in the range of family members who have applied.

(two) the applicant for affordable housing shall meet the following application conditions at the same time

1. The applicant's family members * * * and the recommended applicant's representative must have full civil capacity (if the applicant's representative does not have full civil capacity, his legal guardian will apply for it on his behalf) and the county's urban resident account (excluding the student account), and at least one of the applicant's family members has obtained the county's urban resident account for more than 3 years (inclusive), and the account time is counted to the date of acceptance of the announcement (inclusive).

Military families who have obtained permanent residence in cities and towns in this county are not restricted by 3 years.

2. The applicant must be a married resident (including divorced or widowed children) or a single resident over 33 years of age, and the age is calculated to the date of acceptance of the announcement (including). Among them, the last divorce of divorced people must be more than 3 years. The date of divorce is calculated to the date of acceptance of the announcement.

3. It is a low-income family. The per capita annual disposable income of the applicant family is lower than 80% (inclusive) of the per capita disposable income of urban residents in the previous year announced by the county statistics bureau.

4. The current housing construction area of the applicant family is less than 48 square meters (inclusive) or the current housing per capita (the only child is calculated as a single person, the same below) is less than 18 square meters (inclusive).

5. Applicants who are renting public housing and other affordable housing must withdraw from the rented public housing and other affordable housing after enjoying the affordable housing policy.

6. The family members of the applicant have not used the rural collective homestead.

(3) The following houses are included in the approved scope of the applicant's family housing area.

1. Purchased housing reform houses (including poverty relief houses, affordable houses, fund-raising cooperative houses, etc.). According to the preferential policies of the government) whether it is transferred or not, it is included in the approved housing area (such houses with an area of more than 48 square meters are not eligible).

2. All kinds of housing rights (including auction houses) obtained by means of purchase, demolition, inheritance and gift, and all houses transferred within 5 years from the date of acceptance of the announcement (including the area of houses to be demolished or the compensation and resettlement area agreed in the monetary compensation agreement for demolition).

3. For non-residential houses such as shops transferred within the prescribed time limit, the applicant family entrusts a professional appraisal institution to conduct asset appraisal according to the regulations, and the total assets are converted into the area of ordinary commodity housing in the same lot and included in the approved area; At the same time, rental income should be included in the scope of family income.

Third, apply for appraisal.

(1) acceptance

The applicant shall, within the time limit for accepting the application for affordable housing announced, apply to the community neighborhood committee where the registered permanent residence is located, truthfully fill out the Application Approval Form for Urban Residents to Purchase Affordable Housing in Jiashan County (hereinafter referred to as the Application Approval Form), and provide the following relevant supporting materials:

1. Original and photocopy of the ID card of the applicant's family member (or single).

2. The original and photocopy of the applicant's household registration book for family members (or singles). If the husband and wife's household registration is not in the same household registration book, a marriage certificate and a copy are required; In case of divorce, provide divorce agreement and its copy or court divorce judgment and its copy, and provide proof of current marital status; If you are unmarried, you need to provide proof of unmarried; If the unit has a collective account, the unit shall issue a certificate.

4. Family housing certificate. 5. When applying for a family, an application for verifying the family income status shall be submitted at the same time, and other materials deemed necessary by the audit department shall be provided.

(2) Audit

1. First instance. The community neighborhood committee shall verify the original and photocopy of the application approval form and related materials submitted by the applicant, review whether the applicant's family members, income and housing meet the prescribed conditions within 20 days from the end of the acceptance period, put forward preliminary examination opinions, and publicize them in the community where the household registration is located (the publicity period shall not be less than 7 days), sign and seal the preliminary examination opinions according to the examination opinions and publicity results, and report the preliminary examination opinions and application materials to the town people's government (street office) together.

2. review. The people's government of a town (street) shall, within 20 days from the date of receiving the application materials, put forward an audit opinion and affix its seal on whether the family members, income and housing conditions of the applicant meet the prescribed conditions, and transfer the application materials of the qualified applicant to the office of the county housing committee.

3. Income audit. The civil affairs department at the county level shall, jointly with the departments of industry and commerce administration and public security vehicle management. , within 20 days from the date of receipt of the application materials, put forward audit opinions on whether the applied family income meets the prescribed conditions, and make a written income audit conclusion.

4. Housing approval. County construction administrative departments shall, within 60 days from the date of receiving the application materials, put forward examination and approval opinions on whether the applicant's family housing situation meets the prescribed conditions, and make a written conclusion on housing audit.

(3) publicity

After the application is accepted and audited by the relevant departments, the applicants who meet the application conditions for urban affordable housing will be submitted to the county housing committee, which will publicize their family members' composition, income and housing situation in Jiaxing Daily (Jiashan Edition) and other relevant media, the applicant's domicile and the community for a period of 15 days, and accept public supervision. If the family members who apply for publicity have died before the deadline, they need to be re-examined.

(4) Recognition

After publicity, there is no objection (including objection except verified objection), and the county housing committee office is registered as the object of affordable housing security.

(5) Draw lots to choose houses

The office of the County Housing Committee issued the "Quasi-Purchase Certificate for Urban Affordable Housing in Jiashan County" (hereinafter referred to as the "Quasi-Purchase Certificate") to the selected applicants through the public lottery procedure.

Fourth, the sales process.

1. Publish information. According to the progress of affordable housing construction in this county, the county construction administrative departments and other departments will promptly announce to the public basic information such as housing area, quantity, price, apartment type and pre-sale time.

2. Pull out the number and wait. According to the total number of eligible families, the number is randomly selected based on family representatives and registered on the spot. The number left on the spot because there is no room selection is invalid, and the number generated by the room selection is the room selection sequence number.

3. Choose your own house. The applicant's family representative, with his ID card, will go to the designated place within the time specified in the announcement according to the house selection sequence number determined by the public lottery. Family representatives who apply for house purchase will choose from the available houses according to the house selection sequence number, and receive the quasi-purchase certificate after the house selection, until all the houses are selected. The rest of the serial numbers shall be invalidated automatically and shall not be postponed.

If the approved purchase family does not participate in the lottery, or gives up the house selection after the lottery, or the purchase family does not purchase the house after the house selection, the qualification for the purchase of this batch will be cancelled, and those who need to purchase the house in the future must re-apply; If a family who buys a house receives a quasi-purchase permit but eventually gives up buying a house, they may not apply for affordable housing again within two years (excluding the current year). If the applicant abandons the purchase after receiving the "quasi-purchase certificate", it shall return the "quasi-purchase certificate" to the county housing Committee for verification; Refused to return, shall not participate in the application for affordable housing in the future.

4. Sign the contract. Prospective families can apply for personal housing loans from commercial banks within the prescribed time limit. If they meet the conditions of bank loans, they can sign a contract for the purchase of affordable housing with the owner of affordable housing by virtue of the prospective purchase certificate and apply for personal housing provident fund loans.

5. Listing statement. After the house is sold, the owners of affordable housing units need to submit the list of applicants and houses and the "quasi-purchase certificate" to the county construction administrative department, and the remaining houses will be carried forward to the next batch of affordable housing applications.

Verb (abbreviation of verb) price and enjoyment standard

The price of affordable housing is set by the government, and the specific sales price is subject to the price approved by the county price department.

Buyers can enjoy the standard of affordable housing price and construction area, which is 60 square meters per multi-storey household and 70 square meters per small high-rise and high-rise household. If the purchase area exceeds the above control standard, it shall be priced according to the price of commercial housing in the same lot approved by the county price department.

The over-standard area purchased in kind is priced according to the same lot of commercial housing, and the price difference is collected by the county economic applicable housing development department and incorporated into the urban housing development fund.

The standard of affordable housing needs to deduct the part enjoyed by the applicant family, that is, the first type stipulated in the above-mentioned "included in the approved scope of the existing housing area of the applicant family": purchased housing reform housing. However, for the applicant families who have been divorced for three years (inclusive) before the announcement date, if the housing belongs to the other party at the time of divorce and the property right registration formalities are completed and one party meets other application conditions, half of the construction area of the family that originally participated in the housing reform purchase will be included in the construction area that has enjoyed the housing reform purchase.

Six, listing access

1. When employees and residents purchase affordable housing, they must pay the deed tax and other related taxes in accordance with the regulations and register the property rights. The ownership of the purchased house belongs to the purchaser, but it shall not be listed and traded within 5 years from the date of issuance of the real estate license.

2. Buyers of affordable housing have limited property rights, and the contract for the purchase of affordable housing in kind must clearly stipulate the "minimum payment" to be paid to the government at the time of listing, that is, the land transfer fee, administrative fees and government funds reduced or exempted by the government when purchasing affordable housing. The property registration department shall mark "affordable housing" on the issued "Housing Ownership Certificate" and "State-owned Land Use Certificate".

3. If the affordable housing purchased by the purchaser needs to be listed and traded after reaching the specified residence period, it shall pay the land income and other prices to the government according to 60% of the difference between the transfer transaction price of ordinary commodity housing or affordable housing in the same lot at that time and the original purchase price (the amount paid shall not be less than the "minimum amount paid"). Affordable housing purchased by individuals shall not be used for rental operation before obtaining full property rights. The relevant departments shall not go through the relevant procedures for renting. The price difference of commercial housing in the same lot, as a special fund for urban housing in our county, is included in the two lines of fiscal revenue and expenditure management of affordable housing construction in our county.

4. During the restricted listing of affordable housing, if the purchaser transfers the ownership of the house due to inheritance, divorce, etc., it is allowed to handle the transaction transfer procedures after approval by the county construction administrative department. After the transfer, the property is still affordable, and the starting date of listing transaction is unchanged.

If the ownership of the house must be transferred according to law due to court judgment, mediation or arbitration institution's ruling, after the approval of the county construction administrative department, it must pay the relevant price such as the land income of the house in accordance with the regulations, and allow the listing in advance.

Seven. Legal liability

1. The relevant government departments should earnestly perform their duties, strengthen the follow-up management of purchased affordable housing, regularly check the living and housing use of families who have purchased affordable housing, and promptly correct violations when found.

2 relevant government departments should strengthen the investigation and punishment of violations of discipline and law in the construction and trading of affordable housing.

In violation of the "Jiashan county urban affordable housing management measures" and its implementation rules, the "Zhejiang province affordable housing management measures" and other relevant laws, regulations and rules have been punished, from its provisions.

3. National staff in the construction and management of affordable housing dereliction of duty, abuse of power, corruption, by the competent authorities in accordance with the management authority to be punished. Those suspected of committing a crime shall be transferred to judicial organs for handling.

Eight. supplementary terms

The county construction administrative department is responsible for the interpretation of these rules.
