Male employees who have participated in maternity insurance have paid maternity insurance premiums continuously for 12 months, and their spouses belong to non-urban population or urban unemployed people who have not participated in maternity insurance, or they have participated in maternity insurance but paid less than 12 months, and they are entitled to a one-time maternity medical subsidy of 50% of the maternity medical expenses of female employees according to regulations.
Both husband and wife participated in maternity insurance. If the woman meets the conditions for enjoying maternity insurance benefits, she will enjoy it, and the man will no longer enjoy maternity medical expenses subsidies. If the man enjoys subsidies for maternity medical expenses, his spouse has enjoyed maternity insurance benefits according to other policies;
3, but did not meet the legal provisions of maternity medical expenses subsidy standards, the difference is made up by the maternity insurance fund; Has reached the statutory subsidy standards, maternity insurance fund will no longer pay.
The woman has her maternity insurance. If there is no maternity insurance, it will be reimbursed by the man's maternity insurance, which can reimburse the birth check-up and hospitalization expenses, but there is no maternity allowance. After discharge, the man goes to the work unit for reimbursement, which requires marriage certificate, birth certificate, diagnosis certificate and receipt of all expenses. Insured male employees who meet the reimbursement conditions and meet the following conditions may apply for a one-time maternity allowance:
1, in line with the national family planning policy and statutory fertility conditions;
2. When the spouse gives birth or miscarries due to pathological reasons, the employer has participated in maternity insurance and paid maternity insurance premium for male employees for more than 10 months;
3, the spouse is not included in the scope of maternity insurance, and the birth of the first child.
This law is based on Article 54 of the Social Insurance Law of People's Republic of China (PRC).
The employer has paid maternity insurance, and its employees enjoy maternity insurance benefits; Unemployed spouses of employees enjoy maternity medical expenses in accordance with state regulations. The required funds are paid from the maternity insurance fund.
Maternity insurance benefits include maternity medical expenses and maternity allowance.
Article 55
Maternity medical expenses include the following contents:
(1) Maternity medical expenses;
(two) family planning medical expenses;
(3) Other project expenses stipulated by laws and regulations.
