If it is a new house, it usually takes three months after the house is handed over to get the real estate certificate. If it is a second-hand house, then it takes about one month after the transfer.
Real estate certificate application process: Step 1: Sign an entrustment agreement. Usually the "House Purchase Contract" contains a clause about entrusting the developer to apply for the real estate certificate. This clause itself can be regarded as a separate entrustment agreement.
In addition, many developers will also require home buyers to sign a separate power of attorney in addition to the "Purchase Contract" entrusting them with the real estate certificate, and agree to hand over the deed tax and public maintenance funds to them before moving in.
Sometimes, developers will entrust the handling of relevant procedures to specialized agencies or lawyers.
At this time, you can choose that the developer or agency will only handle the relevant procedures, and you will pay the deed tax, company maintenance fund and other taxes yourself.
Step 2: Pay the real estate certificate agency fee, public house maintenance fund, deed tax, and stamp tax. When going through the house closing and check-in procedures, developers often require payment of these fees.
Notes: 1. Before paying, please understand the collection standards of these taxes and fees to verify whether the developer's calculations are correct. Please refer to Appendix 11 of this book.
2. After paying the money, be sure to keep the receipt of payment, and be sure to ask the receiving unit to stamp it with its official seal, and do not accept "white slips".
Step 3: Receive the real estate certificate according to the agreed time. After the developer or agency pays the above taxes and fees, apply for the real estate certificate and complete the mortgage registration, you can receive the real estate certificate.
If the lending bank seizes the real estate certificate and the "Purchase Contract", be sure to find an opportunity to carefully check the records on the real estate certificate. If there is a recording error, you should promptly request changes.
