Ways to handle personal debt disputes include: letting the parties negotiate on their own; asking a third party to mediate; applying to an arbitration institution for arbitration in accordance with the law; or filing a civil lawsuit with the People's Court and applying for enforcement in accordance with the law after winning the lawsuit.
The law is based on Article 2 of the Arbitration Law of the People's Republic of China. Contractual disputes and other property rights disputes between citizens, legal persons and other organizations who are equal subjects can be arbitrated.
Article 120 of the Civil Procedure Law of the People's Republic of China shall submit a complaint to the People's Court and submit copies according to the number of defendants.
Article 122 If a civil dispute brought to the People's Court by the parties is suitable for mediation, mediation shall be conducted first, except where the parties refuse mediation.
Article 236 The parties concerned must fulfill any legally effective civil judgment or ruling.
If one party refuses to perform, the other party may apply to the People's Court for enforcement, or the judge may transfer the matter to an execution officer for enforcement.
Article 242 If the person subject to execution fails to perform the obligations specified in the legal document in accordance with the execution notice, the people's court has the right to inquire the relevant units about the deposits, bonds, stocks, fund shares and other property of the person subject to execution.
The people's court has the power to seize, freeze, transfer, and change the value of the property of the person subject to execution according to different circumstances.
