Trademark registration process:

(1) Pre-inquiry for trademark registration

Trademark inquiry means that the trademark registration applicant or his agent submits a registration application before , to inquire whether the trademark applied for is identical or similar to the trademark with prior rights. The scope of the search is limited to registered trademarks and trademark applications that have entered the Trademark Office database since the date of the search. The results have no legal effect and are only for reference. They are not the basis for the Trademark Office to approve or reject the application.

1. Provide the trademark name (including: text, English, numbers, pinyin and graphics)

(2) Provide valid certification documents of the trademark applicant

b. If a natural person applies, provide a copy of the ID card and relevant licenses (enlarged twice for clarity) and a copy of the corresponding individual business license or relevant licenses. The natural person should also provide an autograph.

(3) Handling specific trademark matters

1. The staff will issue a trademark application and a power of attorney, which will be signed or sealed by the trademark applicant.

(4). Trademark registration formal review

Trademark formal review (about 20 days). Trademark formal review refers to the trademark registration authority’s examination of whether the documents and procedures for trademark registration are in compliance with the requirements. The law stipulates that if the legal provisions are met, the review agency will assign an application number, determine the application date, and issue a "Registration Acceptance Notice." It is very important to establish the filing date. Since my country's trademark registration adopts the first-to-file principle, once the filing date occurs, it becomes the legal basis for determining trademark rights. The filing date for trademark registration shall be based on the date when the Trademark Office receives the application documents.

(5) Substantive review of trademark registration

Trademark substantive review (about 24 months). Trademark substantive review is the trademark registration authority’s determination of whether the trademark registration application complies with the provisions of the Trademark Law. A series of activities including inspection, data retrieval, analysis and comparison, investigation and research, and decision to give preliminary approval or reject the application.

(6). Trademark Registration Preliminary Examination Announcement

Trademark Preliminary Examination Announcement (3 months) means that after the trademark registration application has been reviewed, those that comply with the relevant provisions of the Trademark Law are allowed to its registration decision. And be announced in the "Trademark Announcement". If no one raises any objection to a preliminary approval trademark within three months from the date of publication of the preliminary approval announcement, the trademark will be registered, a registration announcement will be published, and a registration certificate will be issued.

(7) Time required after registration application

Four steps: Trademark inquiry (immediate) - Trademark form review (about 30 days, an acceptance notice will be issued, and the trademark can be use)—trademark substantive examination (about 12 months)—trademark announcement (3 months)—receipt of registration certificate (1 month).
