How to avoid examination opinions on US design patents?

Unfortunately, you have received an examination opinion from the USPTO on the artwork. Fortunately, we can use this to correct the deficiencies in the application. The examination opinion on the design patent may be entirely due to problems with the drawing.

Fortunately, there are remedies for many problems in appearance patent drawings. If the drawing is not submitted in accordance with the patent drawing rules, your drawing is likely to be rejected. When an examination opinion is issued, the USPTO will issue a communication letter "Office Action Summary-Form PTOL-326 (Rev.08-06)". This document will indicate whether the examination opinion is a final or non-final opinion. , and give the time to respond to the review opinions, relevant fees, examiner contact information and how to respond. In the review report, find the "Detailed action" column to find the detailed problems in the review comments. The examiner may be able to explain why the drawing or alternative drawings do not overcome the review opinion. The examiner not only asks questions but also suggests ways to solve them.

When resubmitting revised figures, even though only one figure has been corrected, the entire set of figures must be resubmitted, and the header of each figure must be marked "Replacement Sheet" or "New Sheet". If a picture is discarded, the corrected page must also be removed from the replacement page, the remaining pictures need to be renumbered, and the picture description must be consistent with the corrected picture.

In a U.S. appearance patent application, the drawings must show a three-dimensional structure with clear structure, including design features, and meet the standards that industry insiders can manufacture products according to the drawings.

If some aspects of the drawing are inconsistent or the design is not fully disclosed, you are not allowed to correct the drawing unless your modification will not add new inventions or new structures (new matter). (New matter cannot add or delete content that does not exist on the original drawing)

It is unwise to submit appearance patent drawings that are not drawn according to standards, especially "any incomplete and non-standard drawings may cause "Incomplete disclosure of rights cannot apply for a patent." In this case, improving the drawings will add new matter.
