Article 2 These regulations shall apply to gas development planning, facility construction, operation, use, safety management and other activities within the administrative area of ??this city.
This regulation does not apply to the production and import of natural gas and liquefied petroleum gas, the transmission of natural gas pipelines outside urban natural gas gate stations, the use of gas as raw materials for industrial production, and the production and use of biogas and straw gas. Article 3 The term “gas” as mentioned in these Regulations refers to gaseous fuels used as fuel and meeting certain requirements, including natural gas (including coalbed methane), liquefied petroleum gas, artificial coal gas, etc. Article 4 The municipal public utility administrative department is the administrative department in charge of gas management in this city and is responsible for the city’s gas management work.
The gas administrative departments of district and county people’s governments and the development zone management committees are responsible for gas management within their jurisdiction.
Subdistrict offices and township people's governments accept the guidance of the gas administrative department and supervise and inspect gas safety within their jurisdiction.
Departments of development and reform, planning, land, construction, public security, industry and commerce, quality supervision, safety supervision, pricing, housing management, transportation, meteorology, environmental protection, education and other departments should do a good job in gas management in accordance with their respective responsibilities. . Article 5: Gas development adheres to the principles of safety first, overall planning, coordinated development, energy conservation and efficiency, fair competition, and standardized services. Article 6 Relevant departments of the municipal, district and county people's governments and the development zone management committee shall establish and improve the gas safety supervision and management system, publicize and popularize gas laws, regulations and safety knowledge, and improve citizens' gas safety awareness. Chapter 2 Planning and Construction Article 7 The municipal gas administrative department shall, in conjunction with the development, reform, planning and other departments, prepare a municipal gas development plan based on the national economic and social development plan, overall land use plan, urban and rural planning, etc., and submit it to the Municipal People's Government Organize implementation after approval.
The district and county gas administrative departments shall, in conjunction with relevant departments, organize the preparation of district and county gas development plans based on the municipal gas development plan, submit them to the people's government at the same level for approval before implementation, and report to the municipal gas administrative department Filing.
The Development Zone Management Committee shall, in accordance with the municipal gas development plan, organize the preparation of the development zone gas development plan and submit it to the municipal gas administrative department for filing. Article 8 The municipal, district, and county people's governments and the development zone management committees shall increase investment in the construction of gas facilities in accordance with the gas development plan, and encourage social funds to invest in the construction of gas facilities. Article 9: Urban construction shall construct corresponding gas facilities or reserve land for the construction of gas facilities in accordance with urban and rural planning and gas development planning.
The supporting gas facilities project shall be planned, designed and constructed simultaneously with the main project of the construction project. Article 10: New construction, expansion, and reconstruction of gas facility projects shall comply with the gas development plan.
When applying for an administrative license for a gas facility project, the department accepting the license shall seek the opinions of the gas administrative department, and the gas administrative department shall issue a written opinion. The department accepting the permit shall not make a permit decision without the review and approval of the gas administrative department.
No unit or individual may obstruct the construction of an approved gas facility project. Article 11 Units engaged in gas facility engineering survey, design, construction and supervision activities shall have corresponding qualifications and undertake relevant business within the scope permitted by their qualification levels in accordance with the law.
The construction, survey, design, construction and supervision units of gas facility projects should strictly implement relevant technical specifications, standards and regulations to ensure the quality of gas facility projects.
Gas facility project construction units shall go to the gas facility project quality supervision agency to handle gas facility project quality supervision procedures in accordance with relevant national regulations. Article 12 After the gas facility project is completed, the construction unit shall submit the completion acceptance report and the acceptance documents issued by the relevant departments to the local gas administrative department for record within fifteen days after the completion acceptance is passed.
If the gas facility project has not been inspected and accepted or fails to pass the inspection, it shall not be delivered for use. Article 13 The construction unit shall establish and improve the gas facility project archives management system and promptly transfer the gas facility project archives to the municipal, district, and county urban construction archives and relevant departments. Chapter 3 Operations and Services Article 14 For gas facilities invested and constructed by the government, gas operators shall be selected through bidding.
For gas facilities invested and constructed by social funds, investors can operate them themselves or choose another gas operator. Article 15 A license system is implemented for gas operations. The gas operating license is valid for five years.
Enterprises engaged in gas business activities shall, after obtaining a gas business license in accordance with the law, go through registration procedures with the industrial and commercial administrative department and engage in gas business activities in accordance with the prescribed business scope, period and scale. Article 16 Gas business licenses shall be issued by the district and county gas administrative departments and the development zone management committee.
The gas operating licenses of pipeline gas operating enterprises in Xincheng, Lianhu, Beilin, Yanta, Baqiao, Weiyang District and the Development Zone shall be issued by the municipal gas administrative department.
