The 9-level disability appraisal standard is also called the 9-level labor ability appraisal standard for work-related injuries, which means that anyone who is identified as a 9-level disability can enjoy the 9-level disability compensation standard; For example, but not limited to the following: mild epilepsy; Toxic peripheral neuropathy with mild sensory impairment; Brain contusion and laceration has no dysfunction; No dysfunction after craniotomy; Intracranial foreign bodies have no dysfunction; The common carotid artery and internal carotid artery were narrowed due to neck trauma, and there was no dysfunction after stent implantation or vascular bypass surgery; Two items that meet the standard of moderate disfigurement or mild disfigurement; Hairline edge cicatricial baldness or baldness in other parts, who needs to wear a wig; The total body scar accounts for more than or equal to 5% of the body surface area; There are scars greater than or equal to 8 square cm or more than three places greater than or equal to lcm2 on the face; More than two transverse process fractures; Vertebral compression fracture, the height of the anterior edge of the vertebral body is reduced by less than 1/2; After discectomy; 1-2 spinal internal fixation; 1/2 of the distal segment of a thumb is missing; 2-3 segments of the index finger of one hand are missing; The interphalangeal joint of a thumb is stiff in the functional position; Except the big toe, the other 3 to 4 fingers are missing; Loss of the distal toe of one foot; Except the big toe, the other two toes are missing or scarred, and the function is not complete; The metatarsal or tarsal fracture affects the arch of the foot; There was no dysfunction after meniscectomy, patella resection and cruciate ligament repair of knee joint after trauma; After internal fixation or external fixation stent for long tubular bone fracture of limbs; After internal fixation of patella, calcaneus, talus, mandible or pelvic fracture;
2. The industrial injury insurance fund pays a one-time disability allowance according to the disability level. The criteria are: 13 months for the seventh grade disability, 11 months for the eighth grade disability, 9 months for the ninth grade disability and 7 months for the tenth grade disability;
3. If the labor or labor contract expires, or the employee himself proposes to terminate the labor or labor contract, the industrial injury insurance fund will pay the one-time medical subsidy for work-related injuries, and the employer will pay the one-time disability employment subsidy. The people's governments of provinces, autonomous regions and municipalities directly under the Central Government have stipulated specific standards for one-time medical subsidies for work-related injuries and one-time employment subsidies for disabled people.
Legal basis
Article 37 of the Regulations on Work-related Injury Insurance, employees who are identified as being disabled at level 7 to level 1 due to work-related injuries shall enjoy the following benefits:
(1) Pay a one-time disability subsidy from the work-related injury insurance fund according to the disability level, with the standard as follows: level 7 disability is 13 months' salary, level 8 disability is 11 months' salary, level 9 disability is 9 months' salary and level 1 disability is 7.
(2) If the labor or employment contract expires, or the employee himself proposes to terminate the labor or employment contract, the industrial injury insurance fund will pay the one-time medical subsidy for work-related injuries, and the employer will pay the one-time disability employment subsidy. The specific standards of one-time medical subsidy for work-related injuries and one-time disability employment subsidy shall be formulated by the people's governments of provinces, autonomous regions and municipalities directly under the Central Government.
