What should I pay attention to when applying for trademark registration online?
In order to standardize the online application of trademarks submitted by the online application system of the Trademark Office (version 20 17), the relevant contents of these Provisions are formulated in accordance with the Trademark Law of People's Republic of China (PRC) and the Regulations for the Implementation of the Trademark Law of People's Republic of China (PRC). Article 1 Where a trademark applicant and a trademark agency submit an online trademark application, they shall sign a User Agreement for Online Trademark Application System with the Trademark Office in advance to confirm their consent. Article 2 A trademark applicant may submit an online application by himself or entrust a legally established trademark agency to submit an online application for a trademark. Foreigners or foreign enterprises that have no habitual residence or business office in China shall entrust a legally established trademark agency to apply for online trademark registration. Where a trademark applicant submits an online application by himself, it shall submit an online user registration application before submitting the online trademark application, and fill in the true and effective user information as required. Where a trademark applicant holds an electronic business license, he may apply for user registration using the electronic business license. Article 4 To submit an online trademark application, the application documents shall be submitted through the online trademark application system in accordance with the file format, data standards, operation specifications and transmission methods stipulated by the Trademark Office. If the online application documents do not meet the above requirements, they shall be deemed as not submitted. Article 5 Where an online trademark application is submitted, the application date shall be the date when the application documents are successfully submitted to the online application system of the Trademark Office. Article 6 When submitting an online trademark application, the application information shall be subject to the records in the database of the Trademark Office. However, unless the parties do have evidence to prove that there are errors in the archives and database records of the Trademark Office. Article 7 When submitting an online trademark application, a trademark applicant and a trademark agency shall pay the trademark fee by online payment within the opening hours of the system on the same day, and those who fail to pay shall be deemed as not having submitted the application. Article 8 All provisions on paper applications are applicable to online trademark applications except those specifically for trademark applications submitted in paper form. Article 9 The Trademark Office shall be responsible for the interpretation of these Provisions. Article 10 These Provisions shall be implemented as of March 17, 2065.
