Article 1 on August 1, 2006 is to implement the directives of the Central Committee of the Communist Party of China and the State Council on “Integrating characteristic agricultural product brands and supporting the development of bigger and stronger famous brand products” and “Protecting well-known agricultural product brands”. ” requirements, in accordance with the "Opinions of the Ministry of Agriculture on Further Promoting Agricultural Branding Work", we will now complete the selection and recognition of China's famous brand agricultural products in 2006 and formulate these measures.
Article 2 The term “agricultural products” as mentioned in these Measures refers to primary agricultural products such as planting, animal husbandry, and aquatic products produced within the territory of the People’s Republic of China. The selection scope in 2006 is primary products (excluding varieties) in the pollution-free agricultural product certification catalog.
Article 3 The selection and recognition of China’s famous brand agricultural products shall implement an overall promotion mechanism based on market evaluation, guaranteed by government promotion, guidance, and supervision, and with the core of comprehensively improving the quality and competitiveness of agricultural products.
Article 4 The selection and recognition of China’s famous brand agricultural products adheres to the principles of free, voluntary, open, fair and impartial. Agricultural administrative departments at all levels are not allowed to charge any fees from applicants.
Article 5 For applicants who have obtained the title of China’s Famous Brand Agricultural Products, the agricultural administrative departments at all levels should provide support for their products in the construction of production bases and product marketing. Article 6 The China Famous Agricultural Products Promotion Committee is responsible for organizing the selection, recognition, publicity, release and certification of China’s famous brand agricultural products, and supervises and manages the selection and recognition work.
Article 7 The Office of the China Famous Agricultural Products Promotion Committee is located in the Department of Market and Economic Information of the Ministry of Agriculture and is responsible for the organization, coordination and daily work of China’s famous brand agricultural products.
Article 8 The China Famous Brand Agricultural Products Promotion Committee will appoint relevant experts to form an evaluation committee based on work needs. The evaluation committee will carry out the evaluation work under the leadership of the China Famous Agricultural Products Promotion Committee.
Article 9 The agricultural administrative departments of each province (autonomous regions, municipalities directly under the Central Government, and cities under separate state planning) are responsible for reviewing the application materials of applicants within their own administrative regions, forming recommendations, and are responsible for organizing and implementing the evaluation of Chinese famous brand agricultural products within their respective administrative regions. supervision.
Article 10: Selection of 100 Chinese famous brand agricultural products in 2006. In principle, the number of applicants recommended by the comprehensive administrative departments (bureaus, commissions, and offices) of each province (autonomous regions, municipalities, and cities under separate state planning) shall not exceed 4, and the number of applicants recommended by the independent administrative departments (bureaus, commissions, and offices) shall not exceed 2. , and report in order.
Article 11 Applicants applying for China’s famous brand agricultural products should meet the following conditions:
(1) Comply with relevant national laws, regulations and industrial policies;
(2) Have independent Legal person status and registered trademark;
(3) The product has a fixed production base and has been in mass production for three years;
(4) The product adopts international standards or national standards , industry standards, local standards, and enterprise standards organize production;
(5) Products are produced domestically;
(6) Products have a certain production scale, with market sales volume and popularity ranking first. It is at the forefront of similar products in the country and occupies an important position in local agriculture and rural economy;
(7) It has stable sales channels and perfect after-sales service, with high consumer satisfaction;
(8) A documented management system has been established, with a sound quality control system and environmental protection system, and product quality responsibilities can be traced; (9) Obtained certifications for pollution-free agricultural products, green food, and organic agricultural products. Any certification;
(10) Provide inspection reports issued by testing institutions authorized by the Ministry of Agriculture after January 1, 2005 or other testing institutions qualified to undertake inspections through national metrology certification.
Article 12 Anyone who has any of the following circumstances cannot apply for the title of “China Famous Brand Agricultural Products”:
(1) The applicant’s registered address is not in the country, or the applicant’s registered address is outside the country (territory) ) foreign trademark;
(2) In the past three years, the product has unqualified records in routine quality and safety monitoring and quality inspections at the county and above levels;
( 3) Major quality and safety accidents have occurred in the past three years, or major quality complaints have been verified to be true;
(4) The use of agricultural production materials and raw materials prohibited by the state and those that do not meet quality and safety requirements Records of agricultural inputs;
(5) Producing products restricted by national industrial policies and relevant laws and regulations;
(6) Tax evasion, adulteration, false advertising, etc. Violation of laws and regulations;
(7) Other violations of the application conditions for Chinese famous brand agricultural products. Article 13: Establish an evaluation index system that focuses on market evaluation and quality evaluation and takes into account benefit evaluation and development evaluation.
Article 14 Market evaluation is mainly reflected in two indicators: market sales volume and export situation. Market sales reflect consumers' recognition and acceptance of the applied products, and product exports reflect the ability and extent of the product to participate in international competition.
Article 15 Quality evaluation mainly assesses the physical quality level of the product being evaluated and the quality assurance ability to continuously maintain this level. The physical quality level of the product is mainly compared with the advanced level of domestic and international similar products. The quality assurance capability reflects the applicant's ability to stably maintain the corresponding quality level and continuously improve quality, indicating the effectiveness of the applicant's quality management.
Article 16 The efficiency evaluation focuses on three indicators: production cost profit rate, total asset contribution rate and realized profits and taxes, mainly to evaluate the applicant's operating performance and management level.
Article 17 The development evaluation mainly assesses the applicant’s long-term sustainable and stable development capabilities, including three indicators: technology development investment level, applicant scale level, and production technology and equipment. It mainly evaluates the applicant's product innovation, technological innovation capabilities and market expansion capabilities.
Article 18: The formulation of scoring standards in comprehensive evaluation, the distribution of weights of different evaluation indicators, evaluation methods that cannot directly quantify indicators, simplification of complex factors in evaluation, determination of investigation plans for different products, and comprehensive The determination of the evaluation results, etc., are determined by the China Famous Brand Agricultural Products Promotion Committee. Article 19 Applicants should directly download the "Application Form for Chinese Famous Agricultural Products" from the China Agricultural Information Network or the Ministry of Agriculture's Quality Agricultural Products Information Network, and submit an application to the provincial agricultural administrative department before August 20.
Article 20 The agricultural administrative departments of each province (autonomous regions, municipalities directly under the Central Government, and cities under separate state planning) will review applicant materials in August, form recommendations, and submit the ranking of qualified materials to China before August 31 Famous Agricultural Products Promotion Committee Office. (2) Copy of trademark registration certificate;

Article 21 Before September 15, the Office of the China Famous Brand Agricultural Products Promotion Committee will organize a formal review of the submitted materials and conduct on-site inspections if necessary.
Article 22 Before September 27, the China Famous Brand Agricultural Products Review Committee will select the applicants who have passed the formal review, and the selection results, evaluation indicators, etc. will be made available to the public through the China Agricultural Information Network and other media. 7 days notice.
Article 23 The China Famous Brand Agricultural Products Promotion Committee will issue the China Famous Brand Agricultural Products Certificate at the 4th China International Agricultural Products Fair in mid-October.
Article 24 The certificate of China's famous brand agricultural products is valid for three years. If you want to continue to use the title of China's famous brand agricultural products after the validity period, you should reapply 90 days before the expiration. Article 25 Applicants who have been awarded the title of "China Famous Brand Agricultural Products" shall perform the following obligations within the validity period:
(1) Maintain stable and qualified product quality;
(2) ) adopt various forms to actively promote famous brand products, and display and promote quality management experience and results to the society.
Article 26 During the validity period, the certificate holder may use the unified Chinese brand name in products that have won the title of China’s Famous Brand Agricultural Products and their packaging, decoration, instructions, advertising, exhibitions and other business activities. The title of the famous brand agricultural product and the validity period are indicated.
Article 27 If an applicant who has obtained the title of China’s Famous Brand Agricultural Products falls under any of the following circumstances, his title will be revoked:
(1) Transfer or expansion of the scope of application ;
(2) Those who have not re-applied after the validity period or have not received recognition after re-applying;
(3) Those who have major accidents in product quality or major problems in production and operations;

Article 28 Agricultural administrative departments at all levels must conduct regular and irregular quality and credibility inspections on applicants who have obtained the title of China’s famous brand agricultural products; applicants should actively cooperate.
Article 29 Anyone who fraudulently uses or forges "Chinese famous brand agricultural products" shall be investigated and punished in accordance with the law.
Article 30: Relevant personnel involved in the selection and recognition work must strictly abide by laws, regulations and other relevant provisions. Anyone who practices favoritism, abuses power, neglects duties, leaks applicant product secrets, or interferes with the selection and determination process at work, resulting in unfair selection and determination, will be subject to administrative disciplinary sanctions by the relevant units in accordance with relevant regulations; if a crime is constituted, criminal liability will be pursued in accordance with the law. .
Article 31 Any unit or individual may report to the Ministry of Agriculture any disciplinary and illegal issues in the selection and recognition of China's famous brand agricultural products, or may appeal to the Ministry of Agriculture regarding different opinions on the selection and recognition of China's famous brand agricultural products. . The complainant and whistleblower shall provide written materials, indicate their true identity, and provide necessary supporting materials. The Ministry of Agriculture investigates and responds to reports and complaints, and protects the legitimate rights and interests of those who report and complain in accordance with laws and relevant regulations.
Article 32 The quality inspection agency authorized by the Ministry of Agriculture or other testing agencies that have passed national metrology certification should provide true and accurate product inspection reports. Quality inspection agencies authorized by the Ministry of Agriculture that issue false reports will be disqualified from the Ministry of Agriculture's quality inspection agencies upon verification, and other testing agencies that have passed national metrology certification will be disqualified from being China's famous agricultural products testing agencies.
Article 33 The inspection fees for the samples submitted by each reporting unit shall be implemented in accordance with relevant national regulations. The funds required for the organization of the selection and recognition of famous brand agricultural products shall be paid by the administrative expenses of the agricultural administrative departments at all levels or apply for special projects Funding solution. Article 34 The China Famous Brand Agricultural Products Promotion Committee is responsible for the interpretation of these Measures.
Article 35 These Measures shall come into effect on the date of promulgation.
