Article 1: In order to standardize the recognition of famous trademarks in Jilin Province and protect the legitimate rights and interests of famous trademark holders, these regulations are formulated in accordance with relevant laws and regulations and in combination with the actual situation of this province. Article 2 The term "famous trademark of Jilin Province" as mentioned in these Regulations refers to a trademark holder whose registered address is within the administrative region of this province, whose goods or services are of excellent quality, are known to the relevant public in the market and enjoy a high reputation, and are registered by the province. Registered trademarks recognized by the industrial and commercial administration departments in accordance with the provisions of these regulations. Article 3 These regulations shall apply to the identification, protection, supervision and management of Jilin Province’s famous trademarks within the administrative region of this province. Article 4 People's governments at or above the county level shall encourage and support trademark holders to improve the quality and reputation of goods or services and create famous trademarks in Jilin Province. Article 5 The provincial industrial and commercial administration department is responsible for the identification, protection, supervision, management and service of famous trademarks in Jilin Province.

Municipal and county-level industrial and commercial administrative departments are responsible for the recommendation, protection, supervision, management and service of famous trademarks within their respective administrative regions. Article 6 If a registered trademark in this province has been continuously used for goods or services for one year from the date of approval, the trademark holder may directly apply to the provincial industrial and commercial administration department for recognition of Jilin Province’s famous trademark or obtain approval from the trademark holder. It is agreed that the municipal and county industrial and commercial administration departments will recommend it to the provincial industrial and commercial administration department. Article 7 To identify a famous trademark in Jilin Province, the following conditions must be met:

(1) The goods or services using the registered trademark are known to the relevant public in the market and enjoy a high reputation;

(2) The goods or services using the registered trademark have excellent quality or service among the same type and grade of goods or services in the province;

(3) The goods using the registered trademark Or service, the business volume, tax payment, and market share in the past three years have led the same industry in the province. Article 8: After receiving the application or recommendation materials, the provincial administrative department for industry and commerce shall conduct an review in accordance with the identification conditions stipulated in Article 7 of these Regulations.

Those that meet the identification conditions shall be announced in provincial newspapers and periodicals and on government public websites. If there is no objection within 20 days from the date of public announcement, it will be recognized and a "Jilin Province Famous Trademark Certificate" will be issued.

Any objection to the proposed famous trademark shall be submitted to the provincial industrial and commercial administration department within 20 days from the date of public announcement. The provincial industrial and commercial administration department shall listen to the facts and reasons stated by the opponent and the objected person, and after investigation and verification, make a ruling within 15 days from the expiration of the public notice period.

If the application is not recognized, the applicant or recommender shall be notified in writing and the reasons shall be explained. Article 9 No fees shall be charged for identifying famous trademarks in Jilin Province. Article 10 The famous trademark words or logos of Jilin Province can be used simultaneously with the registered trademark, unless otherwise stipulated by the state. Article 11 Jilin Province famous trademark holders shall perform the following obligations:

(1) Jilin Province famous trademark words and logos must be used within the scope of recognized goods or services and shall not expand the scope;

(2) Ensure the quality of goods or services and maintain the reputation of famous trademarks;

(3) When licensing others to use its Jilin Province famous trademarks, the licensor shall be responsible for the licensee’s Responsible for the quality of goods or services, and after signing a contract in accordance with the law, report it to the provincial industrial and commercial administration department for record;

(4) If the name, address and other registration matters of the trademark registrant are changed, the trademark registrant shall be responsible for the change on the date of approval of the change in accordance with the law. Within thirty days, the changes will be reported to the provincial industrial and commercial administration department for filing. Article 12 Without the approval of the provincial industrial and commercial administration department, no unit or individual may use Jilin Province’s famous trademark words or signs.

Article 13 If the holder of a famous trademark in Jilin Province has any of the following circumstances, the provincial industrial and commercial administration department will revoke the recognized famous trademark in Jilin Province:

(1) Providing false certification materials, etc. Using various means to defraud the recognition of famous trademarks in Jilin Province;

(2) The quality or service standards of goods using famous trademarks in Jilin Province have been reduced;

(3) Being included in the directory of abnormal business operations More than six months ago or included in the list of serious illegal enterprises;

(4) Has changed business or gone bankrupt;

(5) The trademark has not been used for two consecutive years without justifiable reasons ;

(6) Being punished by relevant departments due to violation of laws and regulations in production and operation, and the circumstances are serious and the social impact is large;

(7) Other losses in Jilin Province Famous trademark recognition conditions. Article 14 Anyone who uses someone else’s well-known Jilin Province trademark as a trade name in a business name to mislead the public and constitute unfair competition shall be dealt with in accordance with the Law of the People’s Republic of China and the State Against Unfair Competition. Article 15 If a company name uses words that are the same as or similar to others’ Jilin Province famous trademarks and applies for registration and use after the Jilin Province famous trademarks are recognized, which may deceive the public or cause misunderstandings among the public, the industrial and commercial administrative department will not approve the registration. However, this is excepted if the trademark has other meanings or other circumstances stipulated by laws and regulations. Article 16 If someone copies, imitates, or translates another person’s Jilin Province famous trademark or its main part, and uses it as a trademark on his goods, which may mislead the public, the industrial and commercial administration department at or above the county level shall order him to immediately stop the infringement, and confiscate and destroy the infringing act. products and their logos.
