How to take responsibility for institutional violations?
If an agent violates the law and causes damage to a third party, he shall bear civil liability, but whether the principal or the agent shall bear it shall be determined according to different circumstances:
1. If the agency matters are illegal, but the principal does not know or should not know that the agency matters are illegal, the principal shall bear civil liability at this time.
2. If the agency matters are illegal and the principal knows or should know that the agency matters are illegal, the agent and the principal shall bear joint liability.
3. If the agency matters are not illegal, but the principal has committed an illegal agency act, and the principal does not know or should not know that the act is illegal, or raises an objection after knowing it, the agent shall bear civil liability at this time.
4. If the agency matters are not illegal, but the principal has carried out an illegal agency act, and the principal knows or should know that the act is illegal and has not raised any objection, then the principal shall be jointly and severally liable with the principal.
Legal basis: Article 214 of the Criminal Law of People's Republic of China (PRC), whoever knowingly sells goods with counterfeit registered trademarks in a large amount shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention and shall also or only be fined; If the sales amount is huge, he shall be sentenced to fixed-term imprisonment of not less than three years but not more than seven years and shall also be fined.
