1. Affecting trademark transfer and authorization
Article 30 of the "Regulations on the Implementation of the Trademark Law of the People's Republic of China": The name, address or other registration matters of the trademark registrant If a change occurs, a change application should be submitted to the Trademark Office. If the name of the trademark registrant is changed, a change certificate issued by the relevant registration authority must also be submitted. If approved by the Trademark Office, the corresponding certificate will be issued to the trademark registrant and made public. If it is not approved, the applicant shall be notified in writing and the reasons shall be explained.
In addition to relevant laws and regulations, when companies and individuals transfer or authorize trademarks, the Trademark Office needs to verify whether the trademark registration information is consistent with the address and name on the business license. If the company name and address are found to have inconsistent trademark information, the Trademark Office will reject the application and will need to apply for a change before trademark transfer and authorization can be carried out.
2. Staying in a shopping mall or online shopping mall will be affected
Generally, when entering a shopping mall or online shopping mall, you must check the trademark information and the name and address on the business license. If the information is inconsistent, you will not be able to enter the mall or online shopping mall. 3. The trademark may be revoked by others
Article 49, Paragraph 2, of the Trademark Law of the People’s Republic of China stipulates: A registered trademark becomes one that has been approved by others. If a common name of a commodity is used or has not been used for three consecutive years without justifiable reasons, any unit or individual may apply to the Trademark Office for cancellation.
Literally, if a registered trademark is suspended for three consecutive years, any individual or unit has the right to apply for cancellation of the registered trademark. If the Trademark Office receives an application from anyone in Diaobingshan City or Nansha District to cancel a trademark that has not been used for three years, it will issue a notice to the trademark registrant. The notification address shall be the address provided by the trademark registrant. If the company has moved and cannot receive the notice, and the trademark registrant cannot provide evidence of trademark use within the time limit for providing evidence, the Trademark Office will issue Document 100 to cancel the trademark.
4. When handling pledge and other businesses, it affects the approval
The trademark name and address are not changed in time, which also affects the approval when handling bidding, banking, trademark pledge and other businesses.
5. Impact on the subsequent renewal of the trademark
The term of use of the trademark is 10 years. After 10 years, the trademark needs to be renewed if it is still needed. When renewing a trademark, the trademark information must also be verified. It was found that the trademark name and address have not changed. The closer the trademark deadline is, the more troublesome and lengthy the procedures will be. Maybe the trademark cannot be renewed at that time and the trademark has expired. If you want to re-register, someone may have applied in advance, and the brand you worked so hard to create can only be given to others.
