An enterprise may apply for the recognition of a well-known trademark when its trademark right is damaged for the following reasons:

(1) The registration of non-similar goods or services by others or the use of marks identical with or similar to the trademark applied by the applicant may harm the rights and interests of the applicant;

(2) Others register or use words identical or similar to the trademark applied by the applicant as part of the enterprise name, which may cause public misunderstanding;

(3) The trademark applied for by the applicant is maliciously registered by others abroad, which may cause damage to the business development of the applicant abroad;

(4) The trademark rights and interests applied for by the applicant have suffered other damages, which are difficult to solve.
