The Madrid System is a convenient and cost-effective solution for global trademark registration and management. Simply submit an application and pay a set of fees to apply for protection in up to 125 countries. Global trademarks can be changed, renewed or expanded through a centralized system. 1. Registration process
(1) Submission
Prepare trademark application documents and submit the application to the International Division of the Trademark Office;
( 2) Review
The International Office will conduct a formal review of the application documents;
(3) Submit to the International Bureau
After the International Office passes the formal review, it will be submitted to the International Bureau for formal review Review;
(4) Issuance of certificate
The application procedures for international trademark registration are complete. In about 6 months, the International Bureau will issue a certificate of international trademark registration (equivalent to the notice of acceptance in my country) ;
(5) Review by the designated country
The International Bureau will provide the application to the designated protecting country for review;
(6) Approval of protection by the designated country
The countries designated for trademark international registration applications decide whether to provide protection according to their respective national laws.
2. Registration information
(1) Applicant’s Chinese and English name and address;
(2) Applicant’s email address;
(3) Basic application/registration number;
(4) Trademark pattern;
(5) Clearly specify which countries;
(6) Business license , Power of attorney (need to be stamped with company seal, color scanned copy);
(7) If the United States is designated, the MM18 form is also required (signed by the relevant person in charge of the applicant company, scanned copy is sufficient).
3. Period for obtaining the certificate
After submitting the application and paying the fees on time, you can get the international trademark registration certificate in about 6 months. If the designated country does not send a notification of refusal to the International Bureau within 12 months (member countries of the Agreement) or 18 months (member countries of the Protocol) from the date of registration of this international trademark by the International Bureau, the mark will be registered in the designated country. 4. Notes
(1) The applicant must meet the following conditions: The applicant should be an individual, enterprise or other organization that is a party to the Madrid System, and can also apply in my country Based on the registered trademark, file an application with the World Intellectual Property Organization; the basic trademark can be a trademark that has been accepted or registered in my country.
(2) The name and address of the Madrid applicant must be consistent with the basic application/registration;
(3) The scope of goods/services applied for in Madrid can be smaller than or equal to the goods in the basic application /Service scope, but cannot exceed the scope of the original basic application;
(4) Because some member states also adopt their own goods/service classification tables based on the Nice Normative Classification (usually more detailed than the Nice Normative Classification) ), it is easy to issue review opinions due to product description issues.
